RE: APPROVE VACATION OF SPECIAL USE PERMIT, SUP -327 - MARRS LAND AND
CATTLE, LLP, C/O AGPROFESSIONALS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 4, 1977, the Board approved Special Use Permit,
SUP -431, for a 300 -cow Dairy on the following described real estate, to -wit:
Part of the NW4 of Section 22, Township 1 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request, dated December 15, 2016, from the current
property owners, Marrs Land and Cattle, LLP, c/o AgPROfessionals, LLC, to vacate said Special
Use Permit, SUP -327, in its entirety to satisfy a Condition of Approval for administratively
approved, Four -lot Recorded Exemption, RECX16-0132 and RECX16-0131, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Special Use Permit, SUP -327, be, and hereby is, vacated.

RE: GRANT OF A SPECIAL UP USE
PERMIT FOR THE CONSTRUCTION OF A
DAIRY OPERATION TO
ARRS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, are vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public meeting
was held on the 30th day of
March, 1977 in the Chambers of the Board of County Commissioners,
Weld County, Colorado, for the purpose of hearing the petition
of Bruce Marrs, Route 1, Box 247, Broomfield, Colorado 80020,
requesting a Special Use Permit for the construction of a dairy
operation on the following described parcel of land:
A part of the Northwest Quarter (tom) of Section 22, Township 1 Northcularl
Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly
described as follows:
Beginning at the Northwest Corner (NW Cor) of said Section 22, and
considering the North line of said Section orth 90°00'00"
East, with all other bearings contained
herein relative thereto;
Thence North 90°00'00" East, along said North Line, 380.00 feet to the
True Point of Beginning; along said North line, 1,000.00 feet;
Thence continuing North 90°00'00" East,
Thence South 00°00'00" East, 800.00 feet;
Thence South 90°00'00" West, 1,000.00 feet; on the North line
Thence North 00°00'00" West, 800.00 feet to a point
of said Section 22 said point being the True Point of Beginning.
Said described parcel of ground contains 18.366 acres, more or less,
including a strip of ground 30 feet in width along Steallo� line to
said Section 22 reserved for County Road ROW purposes

WHEREAS, petitioner was present, and
WHEREAS, the above -described parcel of land is located in an
agricultural zone as set forth in the Weld County Zoning Resolution,
and
WHEREAS, Section 3.3.E.4 of the Weld County Zoning Resolution
authorizes such a use in an agricultural district on the grant of
a Special Use Permit by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners has considered
all the testimony and statements of those present, has studied the
request of the petitioner and has studied the recommendations

of the Weld County Planning Commission having been fully
formed and satisfied that the requested use complies with the
provisions of the
Weld County Comprehensive Plan, and
Weld County Zoning Resolution.

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application of
Bruce Marrs for a dairy operation, be, and hereby is granted,
subject to the Development Standards contained in the Special
Use Permit. Item No. 6 of said Development Standards shall read
as follows:
6. Construction shall begin within eighteen months
of approval by the Board of County Commissioners.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
March, A.D., 1977.
The above and foregoing Resolution was read into the record
and signed on the 4th day of April, A.D., 1977.

South and adjacent to County Road 8; approximately 390 feet east of County Road 19
PARCELS SIZE: +/- 144.88 acres
SUP SIZE: +/- 18.37 acres
ZONE DISTRICT: A (Agricultural)
NARRATIVE: The applicants have been administratively approved on October 11, 2016 for a Four -Lot
Recorded Exemption RECX16-0132; being located on Lot D of pending Recorded Exemption
RECX16-0131. RECX16-0132 included the following Condition of Approval:
4.A. There is a Special Use Permit SUP -327 Reception #1715761, for a dairy (300 cows) in the A
(Agricultural) Zone District. This floating SUP encumbers portions of [existing Lots A, B and D of RE -
4005 and would encumber portions of proposed] Lot A and Lot B of RECX16-0131 and Lot C of
RECX16-0132. The applicant shall address the continued operation of SUP -327 and which lot(s) it is to
be associated with. If the applicant wants to remove any of the lots from SUP -327, a partial vacation
should be done prior to recording the Recorded Exemption plat."
Marrs Land & Cattle LLP proceeded to request a partial vacation of SUP -327 on Lots A and B of RE -4005 and
modifying the boundary on Lot D of RE -4005 so that it will match the boundary of proposed Lot C of RECX16-0132.
However, after discussion with Planning Staff and the applicant, it was determined that a complete vacation of
SUP -327 was more appropriate.
Marrs Land & Cattle LLP then proceeded to request the complete vacation of SUP -327. The vacation request
letter is attached to the planning staffs memorandum.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.
If approved, the BOCC Resolution will satisfy condition 4.A of the RECX16-0132 administrative review and the
RECX16-0131, SUBX16-0016, and RECX16-0132 plats may all proceed with recording.
