WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 26th day of September, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land being described as Part of the Sz of Section 9 , Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado, more particularly described as follows , to-wit: The South Half (S1) of Section 9, Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado. Said described parcel of land contains 320 acres, more or less, including a strip of ground 30 feet in width along the South, East and West lines of said described parcel reserved for County Road ROW purposes and is subject to any rights-of-way of other easements as recorded by instruments of record or as nag existing on said described parcel of land, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-lA (3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land owned by Vern Johnson, be exempt from the definition of the terms, "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS, 1973 . The parcel of land is described as Pt. Si of Section 9, T4N, R64W of the 6th P.M. , Weld County, Colorado. Said property is located 4 miles south of Kersey. The subject property contains 320 acres more or less of Class III irrigated soils. The request is to split the property into parcels of 16.5 acres and 303. 5 acres, each of which would contain an existing set of improvements. As indicated in a letter dated August 25, 1977 submitted by Vern Johnson, Mr. Johnson desires to sever the 16.5 acre parcel from the south half of the section since he no longer has the need for the improvements to house farm labor employees.
