RE: APPROVAL OF RECORDED EXEMPTION NO. 279 - VERN JOHNSON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 26th day of September, 1977, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land being described as Part of the Sz of Section 9 ,
Township 4 North, Range 64 West of the 6th P.M. , Weld County,
Colorado, more particularly described as follows , to-wit:
The South Half (S1) of Section 9, Township 4 North, Range 64 West of
the 6th P.M. , Weld County, Colorado. Said described parcel of
land contains 320 acres, more or less, including a strip of ground
30 feet in width along the South, East and West lines of said
described parcel reserved for County Road ROW purposes and is
subject to any rights-of-way of other easements as recorded by
instruments of record or as nag existing on said described parcel
of land,
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Vern Johnson, be exempt from
the definition of the terms, "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS, 1973 .
BE IT FURTHER RESOLVED that it has been requested that the
recorded plat reflect that the Farmers Reservoir and Irrigation
Company has a deed to the Gilmore Canal through the above-referenced

parcel of land, being an area 45 feet in width, 20 feet right
and 25 feet left, which is recorded in Book 429 at page 262
of the Weld County Records. The request made by Farmers Reservoir
and Irrigation Company, when reflected on the recorded plat, shall
defer future problems.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 26th day of
September, A.D. , 1977.

The FaunLrs Reservoir and Irrigation Company has no
objections to the above referenced case, as long as
it is noted that the Farne s Reservoir and Irrigation
Comany has a deed to the Gilnore Canal through the
referenced land. The deed, recorded in Weld County,
nook 429, page 262, states that we have a 45 foot wide
strip; tetenty (20) feet right and twenty-five (25)
feet left. The Faiiu_rs Reservoir and Irrigation
Company feels it is necessarv'tb have this stated on
the plat to help defer future problens.

Dear Commissioners:
The attached application, plat, and related are materials are in
reference to a request by Vern Johnson for a Recorded Exemption.
The parcel of land is described as Pt. Si of Section 9, T4N, R64W
of the 6th P.M. , Weld County, Colorado. Said property is located
4 miles south of Kersey. The subject property contains 320 acres
more or less of Class III irrigated soils.
The request is to split the property into parcels of 16.5 acres
and 303. 5 acres, each of which would contain an existing set of
improvements. As indicated in a letter dated August 25, 1977
submitted by Vern Johnson, Mr. Johnson desires to sever the 16.5
acre parcel from the south half of the section since he no longer
has the need for the improvements to house farm labor employees.
Also, as indicated in that letter, the Gilmore ditch forms a
natural boundary between the two proposed parcels
Based upon the information submitted and the adopted policies in
the County, the Planning Commission Staff recommends the request
be approved for the following reasons:
1. The proposed split conforms with the intent clause of the
Recorded Exemption Procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agri-
cultural District (Section 3. 3a of the Weld County Zoning
Resolution) , and the Weld County Comprehensive Plan since
each resulting parcel would have an existing set of improve-
ments and the use would be compatible with the surrounding
agricultural uses.
2. The request complies with the provisions of Section 9-4(a)
of the Weld County Subdivision Regulations.

Dear Sir:
I am requesting a recorded exemption of approximately 16 acres from
my farm situated on the South 1 of Section 9, Township 4 North, Range
64 West, Weld County, Colorado.
The reason for this exemption is that I am cutting back in my operation
and do not need the house for my workers. This piece of land has
natural boundaries to the East and South by the Gilmore Ditch and
on the West side by a North-South county road. The property has a
house and out buildings, together with sewer and Central Weld County
Water Tap. The major part of the farm has all improvements such as
a house and out buildings.
I hope that you will look at this matter favorably, as I do not need
it in my future operation.

The Farmers Reservoir and Irrigation Company has no
objections to the above referenced case, as long as
it is noted that the Farriers Reservoir and Irrigation
Corpany has a deed to the Gilnore Canal through the
referenced land. The deed, recorded in Weld County,
Book 429, page 262, states that we have a 45 foot wide
strip; twenty (20) feet right and twenty-five (25)
feet left. The Farmers Reservoir and Irrigation
Company feels it is necessary to have this stated on
the plat to help defer future problems.
