Surface of hard dirting to be 10 feet wide, and 9 inches deep and to be done at the price of 75 4' per cubic yard. A.J.Luther, Clerk. } By F.C.Peterson, Deputy . gJ-IN THE MATTER OF CHANGING POSITION • OF BOILERS IN NEW COUNTY JAIL: - `.,/ After carefully considering the request of Sheriff McAffee relative to changing the position of the Boilers in the New County Jail, and making investigation of the same, on motion duly made and unanimously carried it was ordered that said boilers be moved from the North side of the Boiler room to the West side thereofi that in lieu of said change the County hereby agrees to pay the sum of $30.°° . IN THE MATTER OF PETITION FOR AN ADJUSTMENT OF TAXES OF C.L.WALKER: - NOW ON THIS DAY, C.L.Walker appearing before the Board, by his attorney, Elbert C. Smith, and it having been made to appear to the Board by the evidence and law deduced in that behalf, that the said Walker is the holder of a mortgage lien against the N.W.4 of Sec. 5, T. 3, N.R. 67 W. of the 6th P.M. That said lien existed prior to the year 1912, and that said land was duly assessed for the year 1910, as also the personal property of the owner of said land for the year 1910; which assessments and taxes are now due and the land about to be sold to enforce the payment thereof. And it further appearing that the said property has heretofore been sold to the said Walker under foreclosure of said lien, and that the owner of said land has only an equity of redemption at this time, and that it is not proper to sell the said real estate to enforce the payment of the said personal tax. It is therefore ORDERED, That the County Treasurer receive the taxes, viz: $100.44, assessed against said land in payment thereof, together with 40 cents, cost of advertising thus far incurred, and that a receipt in full of the demands against said land, on account of said taxes for the year 1910, be delivered therefore, and that the County Treasurer proceed to collect the $28.31 assessed against the personal property of the owner of said land for said year, by distress or suit as provided by law, and not against said land. fl IN THE MATTER OF ADDITIONS TO WIRING THE NEW COUNTY JAIL: - It appearing to the Board, after a careful investigation, that the specifications for wiring the New County Jail are faulty at several places, and it being the desire of this Board to have the same corrected, on motion duly made and unanimously carried it was ordered 146 that the following additions be made, viz: - 1st: Install the necessary wiring, instellation of Cabinets, switches and cut-outs for connect- ing up and starting the motor in attic for ventilation of cells . 2nd.: Install the necessary wiring to run from controller to motor in attic and return, con- troller to be set in basement instead of attic. 3rd : Also install bell in first story hall and second story hail of Sheriff 's residence, same t0 be operated from front door of uesidence, all to be complete with necessary batteries and push button. 4th: Install two extra outlets in boiler room as directed by Superintendent, this being done on account of change in location of boilers . IN THE MATTER OF COUNTY TREASURER COLLECT ING GENERAL TAXES AND IRRIGATION DT,STRICT TAXES. /0 Now on this day, comes R.E.Winbourn , County Attorney, and presents the following resolution for consideration by the Board, viz;-ft 1IEREAB, certain lands situate in this County and included in certain Irrigation Districts have been sold for both the general taxes and Irrigation District taxes assessed against them in 1909 and 1910, and, W1EREAS, there is a dispute concerning the validity of said tax sales, and said land owners are desirous of paying their general taxes without paying said- Irrigation District taxes at this time, and, AHEREAS, The County of Weld is the owner and holder of certain of the tax certificates of purchase issued at said sales, - NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the County Treasurer be, and he is hereby autHorized and directed to accept and receipt for said general taxes with interest to date of payment as if no sale had been made, plus the cost of advertising said lands for sale, and to endoresesaid payments upon said tax certificates now held by this county; provided, however, that this resolution shall only apply to lands in this county sold in 1910 and 1911 for both the general and irriget ion district taxes assessed against them, and for which the tax certificates of purchase are now held by this county. 155 After having discussed, and carefully considered same at length, and being fully advised in the premises, Commissioner R.W.DeVinny moved the adoption of said resolution. Atter carefully considering the request of W.R.Patterson, County Treasurer for allowance of $40. °° for making up County Clerk's 1911 Tax Sale record; *15.40 for his endorsement of Subsequent Taxes on all County certificates for 1910 and $369.50 for issui4j 779 certificates of Purchase of County Sales for the year 1911, it was, on motion of Commissioner Levis, seconded by Commissioner De Vinny and duly carried, all three Commissioners voting in the affirmative,ordered that said request be granted and that Mr. Patterson be and he is hereby, author- ized and directed to charge all of said amounts to the General County Fund and credit same to the County Treasurer's Fee Fund. W.J .Moore, having filed his affidavit showing that on September 8, 1891, x{.T.Bacon became the purchaser at said tax sale of Tax Sale Certificates 1033 to 1036 inclusive, Sales of le91 for the taxes of 1890 conveying the South half of the North West quarter of Section 17, Tp. 4 N. , R. 66 W. ; That by later conveyances W.J.Moore claims to have acquired title to said property, but has never been able to locate the Certificates; that said certificates of purchase have been lost or mislaid and after diligent search he has been and is still unable to find the same; that said tax sale is a cloud upon the title to said real estate and he asks that the Board by proper order entered of record, authorize the County Treasurer of Weld County, to issue his certificate of redemption from said sale.
