WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 13th day of March, 1978, in the Chambers of the Board of County Commissioners of Weld County, rolorado, that a certain parcel of land is owned by Walter and Edward Haffner, which land is more particularly described as follows : the W1/4 of the NE4 of Section 25, Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado; WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that said applicants may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4.A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements , be, and hereby is, granted to Walter and Edward Haffner for the above-described parcel of land. The property is described as WANE* Section 25, T1N, R65W of the 6th P.M. , Weld County, Colorado. This property is located 1k miles east and 2k miles south of Hudson. The property in questions con- tains approximately 80 acres of non-irrigated land with Class IV and VI non-irrigated soils . There are no improvements located on this property at the present time . The request is to obtain a variance from the minimum lot size requirement , Section 9-4 A. (6) , so that they may make application to apply for a recorded exemption. Section 9-4 A. (6) of the Weld County Subdivision Regulations states : That the original tract or parcel of land to be divided under this section meets the minimum lot size requirement estab- lished by the Weld County Zoning Resolution; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the Comprehensive Plan area of an existing incorporated town of Weld County (Revised 4-17-74) . " If this lot size variance is granted, Walter and Edward Haffner will proceed with their application for a recorded exemption to divide the property into two parcels. One parcel is proposed to contain approximately 2 acres which will be used as a residential site for Mr. Edward Haffner, Walter Haffner' s son . The second parcel of approximately 78 acres will continue to be used for agricultural purposes. As indicated in a letter from the Haffners, the family is involved in farming a total of 400 acres in this area. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the following reasons : Board of County Commissioners Lot Size Variance #61 March 10, 1978 Page 2 1 . The request is in complaince with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) in that the pro- posed use of the property will be compatible wiht the surrounding agricultural land uses. 2 . The request is in compliance with the intent clause of the Agricultural Zone District (Section 3 3A. of the Weld County Zoning Resolution) and the Weld County Com- prehensive Plan in that the request will be encouraging a related use to agriculture which is the predominant land use. 3. My Dad Walter Haffner owns this 80 acres. He bought it in 1965. It has a existing well on it which we have applied for a Redrill Permit- 70 ft. deep is 15 gpm. I want to build there because my Dad who farms 400 acres is getting old, I have a 16 year old son who is going to help him farm. I plan on helping as much as I can. Also, I was born and raised in Hudson. I have a lot of friends in the area. If I can get a Permit to build I plan on doing so Immediately.
