Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated May 18, 2017, and duly published May 23, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of the State of Colorado, State Board of Land Commissioners, c/o Bonanza Creek Energy Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0020, for a 190 -foot tall Telecommunications Tower in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and described the site location and stated staff sent out nine (9) referrals and received four (4) responses. She explained the new USR will replace the old USR14-0004, which will be vacated after approval and construction. Ms. Aungst described the taller tower and explained the services it will provide to include increased capacity, larger service area with better coverage, and co -location. She also reviewed the Decommissioning Plan, stated there are no lights or landscaping proposed, and that it meets the setback requirements. Ms. Aungst stated no correspondence has been received regarding the application and the site is not located in a three (3) mile referral area of any municipality or intergovernmental agreement area. She entered the favorable recommendation of the Planning Commission into the record as written, and displayed images of the site and surrounding views. In response to Chair Cozad, Ms. Aungst explained the applicant preferred a new USR to an amendment. cc: PLCOa./nnm), puce), H L C LL) , CT e c -r 7/ag/ aol-7 2017-1850 PL2266 HEARING CERTIFICATION - STATE OF COLORADO, STATE BOARD OF LAND COMMISSIONERS, C/O BONANZA CREEK ENERGY OPERATING COMPANY, LLC (USR17-0020) PAGE 2 Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, AP#16-00384, which stipulates to utilize the existing access. He provided the average daily traffic counts and truck percentages and stated there is no requirement for tracking control or an Improvements Agreement. • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated a portable toilet is acceptable for use during construction and Development Standards (DS) #10-15 address typical Environmental Health items. Melissa Mayer, represented the applicant and stated staff adequately covered the application and they have an office in Evans, Colorado. • No public testimony was offered concerning this matter. El In response to Chair Cozad, Ms. Mayer indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards. • In response to Commissioner Conway, Ms. Mayer stated she is aware of the decommissioning timeframe and it is acceptable. • Commissioner Conway moved to approve the request of State of Colorado, State Board of Land Commissioners, do Bonanza Creek Energy Operating Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0020, for a 190 -foot tall Telecommunications Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Moreno, and it carried unanimously.
