HomeMy WebLinkAbout20173676.tiffHEARING CERTIFICATION DOCKET NO. 2017-90 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0040, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE IN TWO SEGMENTS, THE NORTH SEGMENT IS APPROXIMATELY ONE (1) MILE IN LENGTH AND THE SOUTH SEGMENT IS APPROXIMATELY 4.5 MILES IN LENGTH IN THE A (AGRICULTURAL) ZONE DISTRICT — GREEN RIVER DEVCO, LP A public hearing was conducted on November 15, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Frank Haug Planning Services Department representative, Kim Ogle Public Works Department Representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated September 29, 2017, and duly published October 4, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Green River DevCo, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0040, for a greater than 12 -inch high pressure natural gas pipeline in two segments, the North Segment is approximately one (1) mile in length and the South Segment is approximately 4.5 miles in length in the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of record. a Kim Ogle, Department of Planning Services, presented a brief summary of the Phase Two proposal and reviewed the Phase One development previously approved under USR17-0034. He described the proposed Phase Two development consisting of two (2) additional natural gas pipelines that will connect to the Phase One pipelines. Mr. Ogle reviewed the lengths and routes of the proposed pipelines, the SCADA monitoring system, and the requirement for an Emergency Action Plan. He stated thirteen (13) referrals were sent out and three (3) agencies responded with comments that have been considered by staff as a part of the recommendations. Mr. Ogle stated no correspondence has been received in opposition of this matter and he entered the favorable recommendation of the Planning Commission into the record as written. Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements, and listed the County roads and Section Line rights -of -way c.c: PLC KO/ Mn^), PT.(' MO. He reviewed the requirements for Access Permits, Right -of -Way Permits, and Special Transport Permits. Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements, stating pipelines are excepted from requirements for a drainage report and detention design. She reviewed the relevant Conditions of Approval and Development Standards and stated a Flood Hazard Development Permit will be required for any pipeline being constructed in the floodplain. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating portable toilets are acceptable for the construction route, an Air Emissions Permit will be required if disturbing over 25 acres, and Development Standards (DS) #12-18 address typical Environmental Health items. Ryan Kacirck, TetraTech, represented the applicant and stated the Phase Two development is located in the Mustang Integrated Development Plan (IDP Area) and that the Phase Two pipeline segments will connect to the south area Phase One pipeline. He reviewed compliance with federal Department of Transportation regulations and ground cover depths in relation to boring under a roadway or burying under a field. Mr. Kacirck stated the pipeline will pass under County Roads 55,18, and 16, and under Interstate 76, and he reviewed the secured easements from all property owners. Mr. Kacirck explained dust abatement during construction and the return of surface ground cover to pre -construction conditions. He further described safety measures to include centerline placed markers that clearly identify Green River as the owner and operator, Green River's commitment to participate in the "One Call" System, monitoring by the use of a SCADA System, inspection tools, and the operations and control center which is staffed 24/7 to handle any circumstance or emergency. Mr. Kacirck reported no concerns from the referral process and clarified the effort to go above and beyond the requirement by reaching out to surrounding property owners within 500 feet to be more inclusive. No public testimony was offered concerning this matter. In response to Chair Cozad, Mr. Kacirck, on behalf of Green River DevCo, LP, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards. El Commissioner Kirkmeyer moved to approve the request of Green River DevCo, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0040, for a greater than 12 -inch high pressure natural gas pipeline in two segments, the North Segment is approximately one (1) mile in length and the South Segment is approximately 4.5 miles in length in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
