(Serenity View Estates PUD) Lot B Recorded Exemption RE -3684 being a part of the SE4 and SW4 of Section 5, T7N, R67W of the 6th P.M., Weld County, CO North of and adjacent to County Road 84; approximately 1/4 mile east of County Road 15. +/- 59.38 acres Parcel No. 0705-0530-0016 On November 19, 2008, the Weld County Board of County Commissioners (BOCC) voted to approve -with -conditions Change of Zone, PZ-1131. This is a request to change the zone from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for nine (9) residential lots with E (Estate) Zone uses, with 9.94 acres of open space referred to as Tract 1 and Tract 2 and a five -acre non -buildable outlot for oil and gas activities. As of the date of this memorandum the plat for this Change of Zone has not been recorded. The Department of Planning Services received a letter from Mr. Todd Annand on June 13, 2017, requesting a paving variance for the internal roadway. Since the Resolution was signed by the BOCC in 2008 staff is sending this case to all referral agencies for review of Mr. Annand request for a variance from paving and any other concerns. August 15, 2007 At the request of the applicant the Board of County Commissioners granted a continuance of PZ-1131 until September 5, 2007. September 5, 2007 At the request of the applicant the Board of County Commissioners granted an indefinite continuance of PZ-1131 to allow the appropriate parties additional time to address concerns regarding property mineral rights. September 23, 2008 Staff received the executed Surface Use Agreement between the property owner and Anadarko Land Corporation and Anadarko E&P Company LP and requested a hearing before the Board of County Commissioners. November 19, 2008 The Board of County Commissioners considered and voted to approve with conditions PZ-1131. At this time, the applicant has not addressed the conditions in the Board of County Commissioner's resolution and has not recorded the change of zone plat.
