RE: Serenity View Estates PUD — Change of Zone Case Number PZ-1131
Request for Paving Variance for Serenity View Way (Internal Roadway)
Dear Planning Staff:
By this letter, we are requesting a variance to modify the paving requirement for Serenity View Way from an
asphalt surface to a gravel surface. The original Change of Zone for Serenity View Estates PUD was approved by the
Weld County Board of Commissioners on November 19, 2008 and included an internal street paving requirement
based on the determination that the Serenity View Estates property was considered to be an Urban Scale
Development.
We believe that the development of Serenity View Estates PUD to be a Non Urban Scale Development at this time
for the following reasons:
.. Adjacent proposed developments in 2008 have not materialized and the Serenity View Estates PUD►
property is not adjacent to any planned unit developments, subdivisions, or municipal boundaries. The
property is located adjacent to a small segment of Prairie View Estates PUD (approximately three hundred
feet); however, the project has no other major exposure to an approved urban scale development.
2. The property is not located within a Regina) Urban Area (RUA).
3. The property is not located within any municipal planning area.
4. The property is not located within any special districts.
5. The property is not within one -quarter mile of any major transportation improvements. Access would be
provided from Weld County Road 84 which is an existing local roadway with an aggregate surface. Traffic
impacts from this proposed subdivision would not require improvements to Weld County Road 84 and no
improvements are proposed forthis roadway by Weld County's Department of Public Works.
6. The property is located one-half mile from the Town of Severance Boundary. Severance has historically
refused to comment on this land use issue because it is located outside of their existing planning area,
Section 27-2-30 (Access) located within the Planned Unit Development Chapter 27 of the Weld County Code allows
for the variance from paving to gravel surfacing for a Non Urban Scale Development. Section 22-2-30 Urban
Development) located within the Comprehensive Plan Chapter 22 of the Weld County Code provides guidelines to
define Urban Scale Developments. Based on these code sections, we do not believe we are an Urban Scale
Development and that Serenity View Estates PUD is eligible for a variance from the internal street paving
requirement.
