RE: APPROVE TEMPORARY CHANGE TO DESIGNATED HAUL ROUTES FOR USE BY
SPECIAL REVIEW PERMITS ALONG COUNTY ROAD 47 IMPROVEMENT PROJECT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has been presented with a request,
dated October 4, 2017, from Front Range Feedlots, LLC, c/o Western Sugar Cooperative, for a
change to the designated haul route for the duration of the County Road 47 construction project.
The route would to leave the site south on CR 43 to CR 60.5., and then east on CR 60.5 to the
Weld County Parkway, commencing November 1, 2017, through December 31, 2018, and
WHEREAS, on October 16, 2017, the Board of County Commissioners heard all the
testimony and statements of concern from those present, studied the request of the applicant and
the recommendation of the Weld County Departments of Planning Services and Public Works,
and having been fully informed, finds that the request to alter the haul route, be, and hereby is,
approved.
NOW THEREFORE BE IT RESOLVED, by the Board that the request from Front Range
Feedlots, LLC, c/o Western Sugar Cooperative, to change the designated haul route,
commencing November 1, 2017, through December 31, 2018, to leave the site south on CR 43
to CR 60.5, and then east on CR 60.5 to the Weld County Parkway, be, and hereby is approved.
BE IT FURTHER RESOLVED by the Board that any Use by Special Review Permits with
designated haul routes along County Road 47, be, and hereby are, granted a temporary waiver
of their respective established haul routes and are authorized to utilize County Road 43, south to
County Road 60.5, and then east on CR 60.5 to the Weld County Parkway for the duration of the
County Road 47 Improvement Project.

SUBJECT: USR-1654 Western Sugar Haul Route
Please place the attached request from Western Sugar on the BOCC Agenda as an item of new
business. At the CR 47 Neighborhood Meeting held on October 2, 2017, Western Sugar
expressed concern regarding their haul route during the construction of CR 47.
As a condition of USR-1654, Western Sugar's approved haul route is CR 66 east to CR 47 then
south to CR 60.5 for hauling beets from the site to Fort Morgan. Since the project will close CR
47 between CR 60.5 and Highway 392, their approved haul route will not be available. Therefore,
Western Sugar has submitted a letter requesting that a temporary haul route south on CR 43 to CR
60.5 and then east on CR 60.5 to the Weld County Parkway. The temporary haul route is several
miles shorter than the detour route designated for the CR 47 project.
Public Works has reviewed Western Sugar's proposed haul route and recommends the temporary
change to the haul route approved by USR-1654 to be allowed. The proposed haul route is entirely
on paved roads and is several miles shorter than the haul route designated by the project. The
temporary change to the haul route should be limited to the project construction period which is
scheduled from November 1, 2017 through December 31, 2018. If the project is completed prior
to December 31, 2018, the temporary haul route should be reverted to the approved haul route
contained in USR-1654.
I will plan on attending the BOCC hearing to answer any questions that the Board may have
regarding this agreement.

We spoke at the CR 47 information meeting at the Events Room on October 3rd in regard to
using an alternate route other than the designated bypass route during the CR 47 construction between
CR 60.5 and Hwy 392. We feel a safer route for the rehaul trucks hauling sugar beets to the Fort Morgan
factory would be to use CR 66 east to CR 43 south to CR 60.5 east to CR 47 and south to Hwy 34 and the
reverse route returning for another load. Using the designated detour route via intersections at CR 51
and CR 60.5 and on Hwy 392 at CR 51 and CR 43 present a more unsafe turning pattern for the large
quad axle trucks. While the use of CR 43 is not optimal, it is a much better choice for use during
construction until CR 47 is complete and can be used for access to Hwy 34. As you and Don Dunker
agreed with this request, we would like to formally request to use this route during construction on CR
47. We look forward to the new and improved CR 47 and appreciate your accommodating our request.

The request came about because we are closing Western Sugar's haul route down for construction. They have no option
but to use another route while construction is being completed. While we have not designated their proposed haul
route as a detour route, it will likely become one of the two preferred detour routes for the project. The primary detour
route is to the east of CR 47 utilizing CR 51. However, for those businesses west of CR 47, the detour route will likely be
down CR 43. See the attached pdf for a map showing the various routes.
According to information in the Western Sugar USR application, they haul beets from the facility on CR 66/CR 43 to Fort
Morgan between November and February. I think an argument could be made that the use of Western Sugar's
proposed haul route is temporary because it will be shorter than the 6 months generally used by the Planning
Department to determine if a use is temporary or not. The project will be completed by the time Western Sugar needs
to do the hauling for 2018/19 so their proposed haul route would only be for the 2017/18 season. I am sure other USRs
in the area will face the same issue as Western Sugar.

My original message of research info is below. The attachments are the PW recommendation, Draft Notice, Draft
Resolution, 2008 Hearing Cert, 2008 Resolution. If I understand correctly, this request is for a route that differs from the
standard construction detour and cuts off some distance. If we do need to provide notice, it would probably make more
sense to notify the folks on the new route, versus the typical 500 SPO buffer list. I've also copied Kim Ogle since he was
the original Planner on the case and may have some input on the matter.
Please advise on how you wish to proceed, considering the Board's expedited direction. Thanks!

The Reso and Cert are attached. CoA #1.G and #1.H address improvements prior to Recording the Plat and I do not
show that we ever executed an IA, so I'm assuming staff signed off on the listed improvements done up front. DS #7 and
#8 address the designated haul route and DS #36 is the standard language concerning changes requiring an Amendment
or filing through Staff. As to the question of whether there was neighborhood opposition, the Cert reflects several
individuals who spoke in opposition concerning traffic safety and truck traffic.
Please advise as to whether this can be listed on the next available Agenda or if we need to provide notice to SPOs re:
temporary change to the route.

The USR is 1654. Since Western Sugar is not set up in OnBase, it will take a while to get the new entity created. Can we
run this through the old way and follow up with getting it entered once the entity is created in OnBase.

I was under the impression we received a letter from Mike Ott? We can put this along with a staff memo explaining the
request to allow for temporary relocation of his haul route from WCR 47 to WCR 43 through construction of the WCR 47
project. I don't see why this documentation couldn't be put in On -base? The Commissioners wanted it on Wednesday's
BOCC agenda, but I think we will survive if it doesn't make it until next Monday.

The BOCC has to approve or deny the change in the haul route since it part of a USR. There is no contract, agreement, or
