HomeMy WebLinkAbout20170171RESOLUTION RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1103 - JAMES AND PAMELA ERTHAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and, WHEREAS, by Resolution dated January 24, 1996, the Board did approve the request of James and Pamela Erthal (Richard and Dorothy Schild, property owners), for a Site Specific Development Plan and Use by Special Review Permit, USR-1103, for a Home Business (Cabinet Shop) in the A (Agricultural) Zone District, on the following described real estate, to -wit: Lot B of Recorded Exemption, RE -1723; being, located in the NE 1/4 of Section 7, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owner, James and Pamela Erthal, 1817 Serramonte Drive, Fort Collins, Colorado 80524, to partially vacate Use by Special Review Permit, USR-1103, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall submit a revised plat, titled "Partial Vacation of Use by Special Review Permit, USR-1103", conforming to Section 23-2-260.D of the Weld County Code. Owner: James A. & Pamela J. Erthal Date: January 11, 2016 The Department of Planning Services has received the attached letter on November 29, 2016 from Mr. and Mrs. Erthal requesting a partial vacation of USR-1103. This partial vacation is being requested to remove the current Use by Special Review from a newly created parcel of land that was created in conjunction with this proposal. Mr. and Mrs. Erthal were conditionally approved by the Weld County Department of Planning Services for a two (2) Lot Recorded Exemption RECX16-0162 on November 22, 2016. This Recorded Exemption is being done to split off a 4.54 acre parcel of land which will be known moving forward as Lot A of Recorded Exemption RECX16-0162 and is being removed from the larger 40 acre Lot B that will still be associated with the original USR-1103 area. If the partial vacation is approved, the applicant is required to submit a revised USR map per Section 23-2-280 of the Weld County Code and a preliminary map has been included in this request. The Department of Planning Services is recommending approval of this partial vacation. Background Information: Legal Description: Lot B of Recorded Exemption RE -1723; being part of the NE4 of Section 7, T7N, R67W of the 6th P.M., Weld County CO. Location: South of and adjacent to County Road 84 and west of and adjacent to County Road 15. November 22, 2016: Conditionally approved by the Weld County Planning Department a Two (2) Lot Recorded Exemption RECX16-0162. March 12. 1996: A site specific development plan and Use by Special Review (USR-1103) map was approved and recorded for a cabinet shop on Lot B of RE -1723.
