Harmony Rd., Suite 300 Fort Collins, CO 80528 (970) 232-3312 October 23, 2017 Mark Weisbrook 1902 Road 2 S, Bushnell, NE 69128 Dear Mark, I understand that you have been in contact with members of the Pawnee Waste team with regard to the fence relocation and compensation owed to you under our agreement, dated August 24, 2016. We moved your fence to the west of our entrance, and as prescribed in our agreement, the amount owed to you, based on 2.61 acres, equals $13,050. The fence to the east of our entrance was located on property owned by Pawnee Waste. This fence had to be moved in order to enable us to construct the drainage control ditch required by the Colorado Department of Public Health and Environment and Weld County. Enclosed please find a map from our surveyors, AVI, which confirms that your fence was on our property, and remains on our property just south of the section line. As noted in your phone call with Mark Sherock, we have replaced more fence than originally anticipated because we were not aware to what extent your fence was on Pawnee's property. We agreed to increase the amount of compensation to $15,000. Because you did not agree with our offer, Mark offered to send you a check in the original amount as agreed to, which you also declined. We will not offer greater compensation to you than $15,000. If you choose to take this amount, please advise me in writing within 15 days. If you do not agree to this amount, we will send you a check in the original amount owed and agreed to of $13,050.
