CGREELEV.COLORADO BO O May 12, 1975 COLORADO Re: Interladco, Inc. , et al. , vs. Glenn K. Billings, et al. , the Court of Appeals, the State of Colorado, Civil Action No. 74-316. Dear • By the time you receive this letter you already will have received a copy of the decision of the Colorado Court of Appeals in the above entitled case whereby the Court affirmed the judgment and decision of the Honorable Donald A. Carpenter, Judge of the Weld County District Court. I am sure that after you have read the decision you will find that same is self-explanatory, although, I do not agree with the decision of either Court. Accordingly, we have filed a Motion for Extension of Time in order to give us additional time to file a Motion for a re-hearing of the case, inasmuch as we do not agree with the Court's decision as mentioned above. I do not know what the final outcome of the case will be; however, I feel that each and every Defendant in the case should be advised of the progress of same inasmuch as each Defendant is being sued individually, and in addition, as being a member either of the Planning Commission and/or a member of the Board of County Commissioners. I say this advisedly, inasmuch as Plaintiffs are seeking damages in the sum of $85, 000. 00. If you have any questions pertaining to the status of the case or as to our future chances with regard to the re-hearing and to the question of damages, please do not hesitate to get in touch with me. Box 758 Greeley, Colorado 80631 RE: Interladco, Inc vs Weld County et al Dear Mr. Buss: In follow-up to our meeting with members of the Board of County Commissioners and Planning on June 16, 1975 and the discussions regarding coverage for the above captioned and inter-related matters we have determined that there is no coverage under the policy. We have reviewed the policy in its entirety and determined the above captioned matter does not fall within the definition of an "occurrence" as intended by the policy. "Occurrence", as defined by the policy, "means an accident, including injurious exposure to conditions which results, during the policy period in bodily injury or property damage neither expected nor intended from the standpoint of the insured." To further our position we quote the definition of "bodily injury" which means bodily injury, sickness or disease sustained by any person, and, "property damage", which means injury to or destruction of tangible property.
