Miner having filed his affidavit showing that in 1895 . one Mary J. Wright became the purchaser of tax sale certificate number 75, sales of . 1895 for lots 15 and 16 and part of lot 14 , Block 62 , Greeleyi and that said a cert if icate No . 785 was delivered to and was owned by W. A. Miner , but that said ti certificate has since been lost and after diligent search cannot be found; that said tax sale is a cloud upon the title of said real estate and he asks that the Board, by proper order entered of record, authorize the County Treasurer .of Weld I County to issue his certificate of redemption from said sale . , - A ' . T • • In Compliance with an . Act ' of the Eighth General Assembly , en-- titled, "An act to require the affairs of the several Counties of this State to be conducted from the revenues derived from the taxation and to ;prevent the expenses of any County from exceeding its revenues " the Board on motion unanimously passed and adopted the following : -- ANNUAL APPROPRIATIOJ RESOLUTION. BE IT RESOLVED by the Board of County Commissioners , of Weld County , Colorado , that there shall be appropriated from the revenues of said County to defray the necessary expenses and liabilities of said county for, the next fiscal year the following sums , to-wit : -- For Ordinary County purposes - - - ,150 , 700 .66 For Support of Schools - - - - - 43 ,457 .8 For Support of Poor - - - - - 6 ) 691 . 58 For Road Purposes - - - - - - 36 , 14 . 9O l,'or Hospital Building - - - - - - . 4 ,34: . 78 - ForUnforseenContingencies & Casualities - 8 , 691. 56 For County House Building - - - 7 242 . 98 159,395. 56 , IN THE MATTER OF .ROAD FUND TO BE PAID TO -MUNICIPAL CORPORATIONS . - — s l s In compliance with the provisions of Section 3 , Chapter 103 , Session Laws of 1895, it was on motion ordered that there shall be paid to the proper authorities of the several incorporated cities and towns within tre County of Weld, 10 per centum of 'all taxes collected for road purposes from the tax rolls of 1902 , upon all taxable property located within the corporate limits of said cities and towns . IN THE MATTER OF TAXES OF THE U . P . R . R. C OIvIPANY. The following resolution was on motion unanimously passed and adopted, viz : -- WHEREAS) The Union Pacific Railroad Company has requested and petitioned this Board to settle and adjust its taxes upon its railroad property for 1901, upon a valu- ation of 1 , 683 , 091, the same being an increase of 65 per cent over• the `value t ion of said property in 1900, and to pay taxes thereon, computed on the rate of 1901, in the sum of ;26 283 . 74 , and to rebate and hold for naught all port .. on of its assessed valu- ation and taxes in excess thereof, upon the grounds that the same is erroneous , ex- cessive and invalid, and WHEREAS, the State Board of Equalization has assessed said property for 1902 , at a valuation less than said amount , and it appears to the Board that said assessment of 1901 is erroneous and excessive , and its validity is doubtful, and any attempt to collect taxes in excess of said sum would lead to long and expensive litigation, and that it is best to compromise and adjust said matter . NOW THEREFORE, It is ordered, that all taxes upon said property for 1901, in ex- cess of said y 26 , 263 . 74 , be rebated, and that the Treasurer of Weld County is directed to credit said rebate upon said taxes as they appear upon his books , and receipt to said Company for the balance after crediting said rebate , and annex to his receipt for said 262283 . 74 a copy of this resolution. 5 €ftl Proceedings of the Board of County Commissioners day Term, I . .._ . i THE OUT WEST PRINTING AND STATIONERY CO., COLORADO SPRINGS, COLO. 24954. Company has , requested and petitioned this Board to settle and adjust its taxes upon its railroad property for 1901, upon a valuation of $].,87 , 722 , the same being an increase of 65 per cent -over the valu- ation of said property in 1900 , and to pay taxes thereon, computed on the rate of 1901, in the sum of $17 , 178 .35, and to rebate and hold-for naught all portions of its assessed valuation and taxes in excess thereof , upon the grounds that the sarniu is erroneous , excessive and invalid, 'and WHEREAS , the State Board of Equalization has assessed said property for 1902 , at a valuation less than said amount and it appears to the Board that said assess- ment of 1901 is erroneous and excessive , and its validity is doubtful, and any at- tempt to collect taxes in excess of said sum would lead to long and expensive 1i , 1- gation, and that it is the best to compromise and adjust said matter . NOW THEREFORE, It is ordered, that all taxes upon said property for 1901, in excess of said $�7 , 17d .35, be rebated, and that the Treasurer of -Weld County is di- rected to credit said rebate upon said taxes as they appear upon his books , and re- ceipt to said company for the balance after crediting said rebate , and annex to his receipt for said X17 , 178 .35 a copy of this resolution. Elliott came before the board and requested that the County Commissioners appropriate $200 for the care of Abraham Bickford who is in destitute circumstances and in urgent need of medical attention on account of a .cancer on the side of his face , and as he is now and has been for the= past month in St . AnthO ' s Hospital under the care of Dr . Sherman Thompson Brown. ( a special t) he. requested. that he still be left under his care, and after carefully considering the same and. listening to oral argument it was on motion ordered that the County will pay $5.. a week for care in the Hospital from December 222 1902 to January 22 , 1903 and also pay s, . id Dr . Swanson viewers appointed May 13 , 1902, to view a line of road asked to be vacated and aban- cloned, ;to wit : --Commencing at the North West corner of the Northeast Quarter of the Southwest quarter of section 35 in Township 52 North, Range 67 West of the 6th P.M. and running from -thence southeasterly for a distance of about 1500 . feet feet whence the same 0 r runs in a southwesterly direction on -a curve to the Southwest -corner of said Southwest quarter of said section 35 aforesaid. That said road was on July 15, 189 declared a public highway and designated as Road No . 283 . That there already exists a public . highway upon the North end and the west side of the west of Said southwest quarter which was laid out January 222 1883 and designated ,as Road No . 142 and which road will fully serve and answer the purposes as well as the road sought to be abandoned. Was presented to the Board when the following action was taken and entered of record, to-wit:. Parish and several others was presented to the Board praying, for the appointment of E. G. Blake to the office of Justice of the Peace in and for Justice Precinct No . 3 , and after carefully investigating the same it was found that J. L. Nubergall who was appointee' to said office November 19, 1902 had declined to act, therefore it was on motion ordered that the prayer of the petitioners be granted and the said E. G. Blake be and he is hereby appointed Justice of the Peace within and for Justice Precinct No . 3 upon his filing a satisfactory Bond as required by law. !. !
