RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 51 - DON ANDERSON, INC.

WHEREAS, the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
to WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Don Anderson, Inc. for
an exemption from the definition of subdivision and
'-t "subdivided land" in Section 30-28-101 (10) , CRS 1973, as

o amended, and Section 2-1 of the Weld County Subdivision Regulations,
and
WHEREAS, the Board of County Commissioners finds that Don
Anderson, Inc. is the owner of Part of the West Half of the
NWQ of Section 2 , Township 6 North, Range 66 West of the 6th
P.M. in Weld County, Colorado. Said Board finds that it would
be in the best interest of the public to exempt the lease
of the following described real estate out of the above described
parcel of land as said lease does not come within the intent and
purposes of the Weld County Subdivision Regulations, and
WHEREAS, the parcel of land being leased is described
as follows, to-wit:
Part of the West Half (Wz) of the Northwest Quarter (NWQ) of
Section 2, Taanship 6 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described
as follays:
Beginning at the Northwest Corner (NW Cor) of said Section 2,
and considering the West line of said Section 2 as bearing
South 00°00'00" West, with all other bearings contained herein
being relative thereto;
Thence South 00°00'00" West, along said West line, 641.13 feet
to the True Point of Beginning;
Thence South 85°54'30" East, 540.00 feet;
Thence South 00°00'00" West, 242.00 feet;
Thence North 85°54'30" West, 540.00 feet;
Thence North 00°00'00" East, 242.00 feet to the True
Point of Beginning
Said described parcel of land contains 2.992 acres, more or
less, including a strip of ground 30 feet in width along the
West line of said described parcel of land, reserved for County
Road ROW purposes and is subject to any rights-of-way or other
easements as recorded by instruments of record or as now
existing on said described parcel of land.

WHEREAS, the Board of County Commissioners finds that
exempting the aforementioned lease of land does not conflict
with the intent of the Weld County Comprehensive Plan, and
will not have an adverse impact on the existing use of the
land, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the leasing of the
above-described parcel of land be, and hereby is, declared to be
exempt from the definition of "subdivision" and "subdivided land"
as set forth in Section 30-28-101 (10) , CRS 1973, as amended, and
in Section 2-1 of the Weld County Subdivision Regulations, and
further declares that said parcel shall not be considered a
separate lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
November, A,D. , 1977.

Dear Mr. hcgilliams,
In compliance with our earlier telephone conversation, I
am requesting a subdivision exemption in regard to our special
use permit.
Don Anderson, Inc. applied for the special use permit for
the construction of a hog operation on their land. Phe hog
operation is called the Eaton Pork Company and it has leased the _ r
land mentioned in the permit application from Don Anderson, Inc. 4
The lease is a normal one year renewable contract.
As I explained in our phone conversation, I am part owner in
both Don Anderson, Inc. and the Eaton Pork Company. In consideration
of this information, I am requesting a subdivision exemption
from your office. If you have any additional questions, please
