Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Clerk to the Board, Esther Gesick Deputy Clerk to the Board, Chloe Rempel Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Evan Pinkham Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 28, 2018, and duly published March 5, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Union Farms Development, LLC, for a Change of Zone, COZ18-0001, from the PUD (Planned Unit Development) Zone District to the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Pro -Tern Kirkmeyer advised the applicant that in the case of a tie vote, Commissioner Moreno will listen to the record and make the determining vote. IR Angela Snyder, Department of Planning Services, presented a brief summary of the proposal and stated the site is located south of State Highway 66, and east of County Road (CR) 3, and contains a residence and associated outbuildings. Seventeen (17) referrals were sent out, and no objections were raised, although twelve (12) agencies responded with comments that have been address in the Conditions of Approval. She further stated the site is within the three (3) mile referral area of the City of Longmont and Towns of Mead and Firestone, which indicated no concerns. Ms. Snyder reviewed the zoning and land uses in the surrounding area. She explained this case is the result of neighborhood concerns regarding PUDZ17-0004, which was approved by the Board on September 9, 2017, for a residential subdivision. Following the hearing, the applicant met with the surrounding property owners and, as a result of their concerns, the plat was never recorded. She stated the applicant agreed to change the zoning back to Agricultural, adjust the property boundary to sell the Baldwins eight (8) acres, and use the Recorded and Subdivision Exemption processes to split the remaining 11 acres into two sellable lots. Ms. Snyder displayed images of the site and surrounding area and entered the favorable recommendation of the Planning Commission into the record as written. In response to Chair Pro-Tem Kirkmeyer, Ms. Snyder confirmed the eight (8) acres for the Baldwins is being accomplished with a lot line adjustment, it will not create a new lot, and the Union Farms PUD was originally approved for twelve (12) lots. Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements. He stated the site is accessed from State Highway 66, the applicant will need to show the access on the plat, and staff has no concerns with the request. ▪ Hayley Balzano, Public Works Engineer representative, presented the drainage and grading requirements and stated the application will have no impact to the drainage on the site. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating the site will be served by the Longs Peak Water District, and an unpermitted septic system. She reported a Statement of Existing was completed in 2016 and the septic system was working fine; however, the property owner will need to apply for a permit for any new work, and staff has no concerns with the application. Andrew Batson, represented the applicant, and stated this proposal will benefit all parties involved. Monica Baldwin, surrounding property owner, thanked the staff for all of their hard work and the applicant for working with the neighbors to come to a new solution. In response to Commissioner Conway, she confirmed her support for the application. • Responding to Chair Pro-Tem Kirkmeyer, Mr. Batson stated he has reviewed, and agrees to abide by, the Conditions of Approval. Commissioner Cozad moved to approve the request of Union Farms Development, LLC, for a Change of Zone, COZ18-0001, from the PUD (Planned Unit Development) Zone District to the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
