Elk Creek Pipeline Use By Special Review April 2018 vi Weld County Department of Planning Services Application for Use by Special Review Permit 1.0 INTRODUCTION ONEOK, Inc. (ONEOK) is proposing to construct the Elk Creek Pipeline (Project). This Project is an approximately 900 -mile, 20 -inch -diameter natural gas liquids (NGL) pipeline. The Project will originate in Richland County, Montana and terminate at the existing ONEOK facility near Rushton, Kansas. The route parallels ONEOK's existing Bakken NGL Pipeline across eastern Montana and Wyoming and the Overland Pass Pipeline for a portion of Colorado and across Kansas. Additional soil characteristic details for soils depicted on the Vicinity Map are provided in table 4-1 Attachment 4. • A 24 inch x36 inch Plot Plan, at a1:4,000 scale is provided on a topographic basemap to indicate how water will move across the right-of-way. The plot plan depicts the following: Parce boundaries, landowners, and parcel numbers; a county road easements and existing road rights -of -way within the pipe right-of-way; Proposed structures (valve sites); ine Locations of areas with moderate or severe soil limitations (see table 4-1 in Attachment 4 for additional details; Locations of fencing around permanent aboveground facilities; Locations of proposed lighting at permanent aboveground facilities; and Locations of all hydrographic features. No landscaping, vehicle/equipment parking areas, landscaping, signage, detention ponds, floodplains, areas of geological hazards, or mineral resource areas are crossed by the Project right-of-way. Please refer to the "Temporary Access Pad to Paved Road" typical in Attachment 7 for a depiction of the gravel pad tracking control that will be installed at road crossings. 3.5 INCORPORATION DOCUMENTS Incorporation documents for ONEOK are provided as Attachment 5. 3.6 LANDOWNER AND PARCEL iINFORMA►TION A list of parcels within 150 feet of the pipeline centerline and access roads in Weld County route is provided as Attachment 6. 3.7 APPLICATION FEE A check to for the $2,500 USR Fee has been submitted with this application. April 2018 2 Weld County Department of Planning Services Application for Use by Special Review Permit 4.0 PROJECT DESCRIPTION Project description, including source, capacity, size, destination and type of facilities, support structures, lines, etc. involved per Weld County Code, Sec. 23-2-510.C.1. The Project will originate in Richland County, Montana and terminate at the existing ONEOK facility near Bushton, Kansas. It is being constructed to transport NGLs away from the high -producing areas of the Bakken, Powder River, and Denver-Julesburg regions. A project location map is included below in Figure 4-1. The pipeline will have the capacity to transport up to 240,000 barrels per day of unfractionated cti o n ated NGLs. The portion of the Project that crosses Weld County is about 43.0 miles long, from milepost (MP) 496.4 to MP 538.9. The centerline crosses into Weld County from the Wyoming/Colorado state line, near County Road 99. The centerline crosses southeast across Weld County into Logan County near the intersection of Highway 14 and Highway 71. Refer to Attachment 4 for project mapping, including an overview map, vicinity map, and plot plan detailing the proposed pipeline route, associated workspaces, aboveground facilities, and access routes to the project. Construction of the pipeline facilities will require use of both permanent and temporary right-of-way easements. During construction, temporary work areas alongside the permanent easement will be necessary for various reasons including but not limited to the following: to accommodate temporary storage of excavated trench soil; to string, weld, and install the pipeline; and to allow movement and operation of construction equipment. Extra workspaces may also be required beyond the construction work areas. Examples of where these areas may be required include: areas of rocky soils, steep slopes, and rugged terrain, staging areas, truck turnarounds, utility crossovers, and utility, road, railroad, waterbody, and wetland crossings. Only the permanent easement will be required for the operation of the pipeline. Table 4-1 identifies the milepost or milepost range of facilities planned within Weld County. No pipe yards or pump stations will be located within Weld County. ONEOK has attempted to locate these Project facilities adjacent to previously developed areas, such as roadways, wherever possible to minimize disruption to land uses and to facilitate the operation and maintenance of the pipeline. The site for Valve 506 (see Figure ECP-300-005 in Attachment 7), will contain two valves,, a power pole, light pole, and a small building. The sites for valves 519 and 538C will each contain a single valve (see Figure ECP-300-002 in Attachment 7). The site for Valve 538A will contain two (2) valves (see Figure ECP-300-007 in Attachment 7). The site for Valve 538E will contain two (2) check valves (see Figure ECP-300-009 in Attachment 7). All valve sites will be graved and the perimeters will be fenced. Valves will be located in the permanent right-of-way of the Project and located as close to roads as feasible to allow easy access to the valve site. The spacing of valves will meet or exceed that required by the U.S. Department of Transportation's (DOT), Office of Pipeline Safety regulations. In addition, magnesium anode beds and cathodic protection test stations will be installed within the fenced valve sites. Cathodic protection test stations will also be located outside the fenced valve sites spaced approximately even► 1,0►00 to 1,500 feet and at foreign utility line crossings. These will typically be sited near road crossings and be similar of size to pipeline markers. The only additional aboveground features associated with the Project in Weld County will be standard pipeline markers placed at road crossings and other locations as required by the DOT requirements. Typical details depicting the various valve site configurations, magnesium anode beds, and cathodic protection test stations proposed are provided in Attachment 7. 4.2 ACCESS ROADS Where possible, ONEOK will use existing public roads to access the pipeline right-of-way. In addition, with landowner consent, existing private roads will also be used by ONEOK to access the pipeline right-of-way. ONEOK has identified five temporary access roads to be utilized during construction and seven permanent roads to be utilized during operations of the project. Access roads will typically be 25 feet wide. ONEOK will obtain Access Permits from the Weld County Public Works Departments for both temporary access road (TAR) and permanent access road (PAR) crossings. Weld County Public Works Department has advised ONEOK that they will not issue Access Permits until the Board of county commissioners has approved the Use By Special Review Permit. 4.3 PIPELINE FACILITIES The construction and operation of the pipeline facilities will require the acquisition of permanent and temporary right-of-way easements. ONEOK will use a typical 75 -foot -wide construction right-of-way that will accommodate temporary storage of excavated trench soil; area needed to string, weld, and install the pipeline; and the operation of construction equipment. ONEOK will retain a 50 -foot wide permanent right-of-way for facility operations. A typical right-of-way detail is provided in Attachment 7. In addition to the construction right-of-way, ONEOK will use temporary extra workspaces as needed in areas of rocky soils, steep slopes, and rugged terrain; and for staging areas, truck turnarounds, utility crossovers; and utility, road, railroad, waterbody, and wetland crossings. ONEOK will locate extra workspace areas outside the boundary of the typical construction right- of-way. A total of 19 crossings, including state highways and county roads are required within Weld County. A right-of-way use permit is required from the Weld County Public Works Department when the pipeline will be bored under a county road. The Project crosses into Weld County from near the center of the northern Weld County line, and traverses in a southeast direction towards the intersection of Weld, Morgan, and Logan Counties. ONEOK currently operates the existing Bakken NGL Pipeline and owns 50 percent of the existing Overland Pass Pipeline which cross Weld County. Collocating with existing ONEOK pipelines within Weld County would increase the length of the route within the county by about April 2018 6 Weld County Department of Planning Services Application for Use by Special Review Permit 18 miles, resulting in greater environmental impact than the proposed route while providing no benefit to the Project. The Project provides an effective way to transport NGLs to market and enhances the industry's ability to recover and use NGLs produced in the Bakken, Powder River, and Denver-Julesburg regions. NGLs are used in a wide variety of industries within the United States; and a safe and efficient delivery method ensures a cost effective product to market. 5.1.1 ALTERNATIVE 'I An alternative route "MOC 152" is currently under review, and may be adopted to avoid five water lines on the landowner's property. The reroute would result in about 0.1 mile of additional centerline, and would cross one new tract. Landowners within 150 feet of this reroute have been included in the landowner list in Attachment 7, to allow them be notified and provided with any documentation sent by Weld County to surrounding property owners regarding the pending USR Permit for the Elk Creek Pipeline Project. Figure 5-1 depicts the currently proposed route, the alternative route, and a 150 foot landowner notification buffer. ONEOK will implement various mitigation measures or best management practices (BMPs) to avoid or mitigate adverse impacts associated with the Project. Below is a description of some of the typical mitigation measures/BMPs that will be implemented. 5.3.1 Waste Handling Typical waste handling measures to be implemented during construction include the following: • The contractor will be responsible for removing waste from the project area and identifying and locating proper licensed waste disposal facilities. • Waste which contains (or at any time contained) oil, grease, solvents, or other petroleum products falls within the scope of the oil and hazardous substances control, cleanup, and disposal procedures. If characterized as hazardous, this material will be segregated for handling and disposal as hazardous wastes. • The Contractor must provide portable, self-contained toilets during construction operations. Wastes from these units shall be collected for disposal at licensed and approved facilities. • Hazardous and potentially hazardous materials will be stored, handled and transported in accordance with applicable laws, regulations, rules or permits. Hazardous waste materials shall be stored in properly labeled containers. Each label shall identify the contents in the container, indicate if the material is hazardous, and include a waste code and date of accumulation. Personnel who will have a role in handling, storing or otherwise managing hazardous waste will have training in accordance with applicable regulatory requirements and the manufacturer's recommendations. Personnel will be familiar with the hazards associated with particular wastes and appropriate safety procedures. Appropriate emergency response equipment will be kept in an accessible area. Note: there are no proposed storage sites identified in Weld County. 5.3.2 Dust Control Dust suppression measures will be employed as necessary to control fugitive dust emissions where construction activities approach dwellings, farm buildings, commercial areas, and other areas occupied by people; where the pipeline parallels an existing road or highway; and where dust could compromise safety or become a public nuisance. This shall also apply to April 2018 0 Weld County Department of Planning Services Application for Use by Special Review Permit access roads where dust raised by construction vehicles may irritate or inconvenience local residents. The mitigation measures to be implemented will comply with the Colorado Air Pollution Emission Notice permit. To minimize wind erosion and fugitive dust emissions during construction, ONEOK will implement the following control measures: Disturb no more earth than required for construction to occur. Use dust abatement techniques i.e., applying water or approved nontoxic chemical dust suppressants) on unpaved or un-vegetated areas or other areas susceptible to wind erosion, including the Project right-of-way, approved work areas, and unpaved roads, at least daily in areas of active construction. Application of dust suppressants will be repeated as necessary and as determined by the Environmental Inspector or ONEOK representative. • Temporarily stockpiled soils (topsoil and spoil) will be sprayed with water or approved chemical dust suppressant to create a semi -hard protective layer to minimize wind erosion, if necessary, and as determined by the Environmental Inspector or ONEOK representative. • Project -related traffic speeds will be controlled on the construction right-of-way and within other Project facilities; where construction activities approach dwellings, farm buildings, commercial areas, and other areas occupied by people; where the pipeline parallels an existing road or highway; and on unpaved access roads. Speed limits will be decreased when excessive winds prevail and where sensitive areas such as public roads are adjacent to access roads or the construction right-of-way. • Open -bodied trucks carrying sand, soil, gravel, or other material necessary to prevent such materials from being expelled. s will be covered where • Construction entrance/exit access locations onto paved roads will be cleaned as needed, if materials are observed to be accumulating on the road surface. 5.3.3 Fire Prevention and Suppression ONEOK will establish standards and practices that will minimize the risk of fire danger and, in case of fire, provide for immediate suppression, and implement prevention measures to be taken during extreme fire hazard conditions. All prevention, detection, pre -suppression, and suppression activities will be in accordance with all federal, state, and local laws, ordinances, and regulations pertaining to fire. Typical BMPs to be implemented during construction are listed below: • Ensure that required tools and equipment are kept in serviceable condition and are immediately available for fire suppression at all times. • Conduct fire tool and equipment inspections and take corrective action upon detection or notification of any fire protection requirements or measures that are not in compliance. • Conduct regular inspections of flammable fuels and explosives storage and handling areas. April 2018 10 Weld County Department of Planning Services Application for Use by Special Review Permit • Monitor construction areas where activities may present fire safety issues. • Stop work or reduce construction activities or operations that pose a fire hazard until appropriate measures have been implemented. 5.3.4 Release Prevention and Control ONEOK will implement release prevention, containment, and countermeasures to prevent the discharge of hazardous or regulated materials during construction of the Project. No fuel storage facilities are proposed in Weld County. Typical BMPs to be implemented during construction are listed below: • Fuels shall be dispensed by Authorized Personnel during daylight hours only unless otherwise approved by the Lead Environmental Inspector. • During refueling, the Contractor will take appropriate measures to reduce the risk of a release, including not overfilling fuel tanks and placing an absorbent pad under the fuel nozzle while fueling equipment. Fuel dispensing equipment (i.e. portable gas cans, nozzles, hoses, etc.) shall be of the appropriate type.All fuel nozzles shall be equipped with functional automatic shut -offs and over -flow alarms. • Refueling within 100 feet of waterbodies, wetland boundaries, or within a municipal watershed is not allowed without approval from the Lead Environmental Inspector. • Refueling will not occur within a 150 -foot radius of all private wells and a 400 -foot radius of all municipal or community water supply wells. • The Contractor must maintain kits containing a sufficient quantity of absorbent and barrier materials to adequately contain and recover foreseeable releases. • Each construction crew shall have on hand sufficient supplies of absorbent materials, barrier material, and DOT approved containers to allow for rapid containment and recovery of any release which may occur. • Controlling releases shall be accomplished by stopping or segregating the source of the release, using the required stockpiled materials to contain the release and, if warranted, stopping operations within the affected areas. • All excavation material shall be stored and disposed of in accordance with local, State, and Federal regulations. 5.3.5 Weed Management Methods to prevent and control the spread of noxious weeds during and following construction of the Project will be implemented. The following are some of the measures that will be used for weed management: • Prevent the introduction and spread of weeds from construction equipment during construction by requiring all equipment be cleaned prior to entering the project area. April 2018 11 Weld County Department of Planning Services Application for Use by Special Review Permit • Contain weed seeds and propagules by preventing segregated topsoil from being spread to adjacent areas or along the construction right-of-way. • Control infestations that may develop during operations. 5.3.6 Stormwater ONEOK will implement the following procedures to minimize adverse effects during construction and operation of the pipeline: • BMPs will be installed to prevent erosion or sediment runoff; • Tracking pads will be utilized where heavy equipment is required to cross paved roads to prevent damage to the road surface; • ONEOK will obtain and comply with the Colorado Department Public Health and Environment Construction Stormwater Permit, as required by 6 CCR 1002-61; and • The right-of-way will be stabilized as quickly as possible following final grading. 5.4 MINIMIZATION OF IMPACTS ON IRRIGATED AGRICULTURAL LANDS Description of the method or procedures to be employed to avoid or minimize the impacts on irrigated agricultural land. The duration of impacts on irrigated agricultural lands would be temporary during construction, as agricultural activities could commence upon the completion of construction. ONEOK will coordinate with the landowners during development of construction rights -of -way across cultivated croplands and agricultural areas to mitigate the effect of the Project on these areas. Additionally, specific construction activities will be implemented in agricultural areas to minimize impacts: • Original contours and drainage patterns shall be re-established to the greatest extent practicable. • Agricultural areas that have terraces shall be surveyed to establish pre -construction contours to be utilized for restoration of the terraces after construction. • Topsoil will be segregated during trenching activities. • ONEOK will restore pre-existing vegetative cover and land uses. Seed mixes formulated in consultation with the Natural Resources Conservation Service as well as landowner - approved seed mixes will be used to revegetate the affected areas. 5.5 PUBLIC MEETINGS A town hall style meeting was held by ONEOK in in Grover, Colorado at Pawnee Junior/Senior High School on March 13, 2018 from 6:30 — 7:30 pm. Advertisement of the meeting was mailed out to a wide variety of stakeholders in early February, 2018. There were 24 attendees, including landowners, staff from U.S. Senator Cory Gardner and U.S. Representative Ken Buck's offices, a member of the Grover Town Board, and the April 2018 12 Weld County Department of Planning Services Application for Use by Special Review Permit Superintendent of the Grover School. No representatives of the media were present. The tone of the meeting was neutral and constructive in nature, discussions were informal, and many attendees spent 30 minutes to an hour visiting with ONEOK experts, asking questions, and gathering information about the Project. Key topics of discussion included agricultural trusts, conservation easements and Conservation Reserve Program lands, restoration processes, aerial patrols, staking and survey, and timing and notification. 6.0 LAND USE REQUIREMENTS 6.1 EXISTING LAND USE The land uses that will be crossed by the Project in Weld County are summarized in table 6-1. The majority of the impacted land is currently herbaceous grasslands (about 76 percent), and the next most prevalent land use type crossed is cultivated crops (about 19 percent), followed by developed, open space (about 4 percent). The remaining land use types, including barren lands, deciduous forest, developed lands, open space, wetlands, pasture, and scrub shrub lands combined comprise less than 1 percent of the lands crossed by the project. The workspace for mainline valves is located primarily within the pipeline right-of-way, and acreages are not reported separately. 6.2 COMPATIBILITY WITH SURROUNDING LAND USES The project crosses through unincorporated Weld County, primarily through herbaceous grasslands, cultivated cropland, and some developed areas (road rights -of -way) in the Agricultural Zone District. After construction, the pipeline will be buried and the temporary workspace will be restored to as near the pre -construction condition as possible. The permanent easement in most areas will be restored to its previous land use, including herbaceous grasslands and cultivated crops. The aboveground facilities will be relatively small, dispersed across the county, and are an allowable development based on current zoning code (see section 10.0). April 2018 14 Weld County Department of Planning Services Application for Use by Special Review Permit 7.0 ENVIRONMENTAL RESOURCES REVIEW 7.1 VEGETATION AND WILDLIFE Existing land uses crossed by the project are summarized in table 6-1. The majority of the Project area (approximately 80 percent) is composed of herbaceous grasslands. Natural vegetation in the high plains crossed by the Project in Weld County include short grass prairie. Commonly occurring species include blue grama (Bouteloua gracilis), buffalograss (Bouteloua dactyloides), threadleaf sedge (Artemesia filifolia), fringed sage (Artemisia frigida), Junegrass (Koeleria macrantha), and western wheatgrass (Pascopyrum smithii) (Chapman et. al, 2006). Although nearby, the Project does not cross the Pawnee National Grasslands. Common wildlife found in the grasslands of Colorado include ungulates including bison, elk, and white-tailed deer; rodents such as black -tailed prairie dogs (Cynomys ludovicianus), chipmunks, mice, muskrats, and ground squirrels; carnivores including coyotes, foxes, mink, weasels, badgers, raccoons, and skunks, and birds of prey including bald eagles, golden eagles, great horned owl, barn owl, and peregrine falcons (Love to Know, 2018). 7.2 SPECIAL -STATUS SPECIES ONEOK obtained a list of federally protected species that may occur in the project area through the U.S. Fish and Wildlife Service Information for Planning and Consultation database (2017). The Project is within the range of nine federally listed species (Table 7-1). Based on a desktop review of available data, topographic maps, and aerial imagery, the project area in Weld County does not appear to contain suitable habitat for several species, such as the Mexican spotted owl, least tern, piping plover, and pallid sturgeon. However, potentially suitable wetland and/or riparian habitat was identified in the project area for the Lite ladies' -tresses, Colorado butterfly plant, western prairie fringed orchid, and Preble's meadow jumping mouse. Suitable habitat will be verified during field surveys scheduled for the 2018 growing season. If suitable habitat is found within the Project area, ONEOK will install the pipeline using horizontal directional drilling (HDD) to avoid impacts on these species and their habitats. While the project may cross potentially suitable habitat, according to the Species Biological Report for Colorado butterfly plant there are no known populations near the Project area in Colorado, and the Project is not within the species' historic range (Reeves, 2017). According to species observation data obtained from Colorado Natural Heritage Program (CNHP), Hernandez's short -horned lizard (Phrynosoma hernandesi) has been observed within I mile of the Project and is considered a "non -game species" in Colorado (CNHP, 2017). If Hernandez's short -horned lizard is present in the Project area, it could be affected; however, ONEOK will restore the Project area following construction, so impacts would be minor and short- term. Additionally, the mountain plover (Charadrius montanus) has been observed five times within 1 mile of the Project (CNHP, 2017). The mountain plover is listed as a "non -game species" and a State Special Concern Species in Colorado, with a state conservation status rank of S2B, indicating that the breeding populations are imperiled in the state (Colorado Parks & Wildlife, 2018). Potential impacts will be avoided or minimized with the implementation of mitigation measures for this species and other migratory birds, as discussed below. Migratory birds are also federally protected under the Migratory Bird Treaty Act, which prohibits take, possession, importation, exportation, transportation, sale, or purchase of migratory birds, or the parts, nests, or eggs of these birds. Many bird species are protected under the Migratory Bird Treaty Act, and it is likely for them to occur in the Project area. ONEOK will implement measures designed to avoid impacts on migratory birds. Bald and golden eagles are protected under the Bald and Golden Eagle Protection Act, which prohibits take, possession, importation, exportation, transportation, sale, and purchase of bald and golden eagles, and their parts, nests, or eggs. Both bald and golden eagles could be found in Weld County. If a bald or golden eagle nest is observed in the Project area, ONEOK will adhere to the National Bald Eagle Management Guidelines if inactive or active nests are found near the Project area during construction. 7.3 NOXIOUS WEEDS It is ONEOK's intent to minimize the potential introduction and/or spread of state - designated noxious weeds. The Colorado Department of Agriculture developed a management April 2018 16 Weld County Department of Planning Services Application for Use by Special Review Permit plan for the following noxious weeds in Weld County as of April 1, 2017 (Colorado Department of Agriculture, 2017): • I • • Absinth wormwood Black henbane Bouncingbet Bull thistle Canada thistle Chamomiles Chinese clematis common tansy common teasel Cutleaf teasel Dalmatian toadflax • Dames rocket Diffuse knapweed • Eurasian waterm ilfoil • Hoary cress • Houndstongue • Jointed g.oatg rass • Leafy spurge • Moth mullein • Musk thistle • Oxeye daisy • Perennial pepperweed • Plumeless thistle • Russian knapweed • Russian olive • Salt cedar • Scotch thistle • Spotted knapweed • Sulfur cinquefoil • Wild caraway • Yellow nutsedge • Yellow toadflax ONEOK will implement the measures described above in section 5.3.5 to prevent the introduction or spread of designated noxious weeds. 7.4 WATERBODIES AND WETLANDS ERM identified the presence of wetlands and waterbodies within the project area using National Hydrography Dataset and National Wetlands Inventory online data sources. 74.1 Waterbodies In Weld County, 60 waterbodies will be affected by the project, including 30 intermittent streams and 30 ephemeral streams. Of the intermittent streams, 20 will be crossed by the pipeline and 7 will be crossed by access roads. Another 3 intermittent streams intersect the pipeline workspace but are not crossed by the pipeline. Of the ephemeral streams, 18 will be crossed by the pipeline and 5 will be crossed by access roads, while 7 intersect the pipeline workspace but are not crossed by the pipeline. In addition, four canal/ditches would be crossed including one by the pipeline and an access road and three along access roads. None of the canal/ditches have been recorded as cultural resources (see section 7.5). The majority of the streams and canal/ditches will be crossed using the wet trench method in accordance with applicable permits, including the U.S. Army Corps of Engineers' Nationwide Permit 12. For ephemeral streams; small, dry intermittent streams; and agricultural drainage ditches, standard upland construction procedures may be used, which involve stringing, welding, excavating the trench with backhoes, installing the pipe in the trench, and backfilling the trench with native material unless stipulated otherwise in the Project's applicable permits. Use of the HDD crossing method may be implemented at certain crossings, including but not limited to crossings where habitat for sensitive species or cultural resources have been identified. Extra workspaces will be setback 50 feet away from the water's edge where topographic or other physical conditions such as stream channel meanders allow. If safe work practices or site conditions do not allow for a 50 -foot setback, extra workspaces should be located as far from the water's edge as site -specific conditions allow. April 2018 17 Weld County Department of Planning Services Application for Use by Special Review Permit The banks of each crossing will be reshaped, mulched, and, if required, seeded to stabilize the crossing until permanent erosion control is implemented. No refueling, fuel storage, or equipment maintenance is allowed within 100 feet of a drainage ditch or intermittent stream without approval from ONEOK with additional special provisions for containment. Where dry swales cross the right-of-way, silt fence or straw bales will be installed at the edge of the right-of- way to prevent the flow of sediment off of the approved construction workspace. The 12 waterbodies crossed by access roads will be bridged if not already bridged or culverted. The bridges may include clean rock fill over culverts, timber mats supported by flumes, railcar flatbeds, flexi-float apparatuses, or other types of spans. 7.4.2 Wetlands Three palustrine emergent wetlands will be affected by the pipeline in Weld County. These wetlands are associated with or in close proximity to the North and South. Pawnee Creek crossings. One wetland is crossed by the pipeline, one wetland is crossed by the pipeline and crossed two times by an access road, and one wetland is within workspace but not crossed by the pipeline. Wetland crossings will be conducted in accordance with applicable permits. Timber mats will be used where necessary to provide temporary portable support for construction equipment and minimize soil compaction and/or soil mixing. In non -saturated conditions, topsoil will be segregated. in standing water wetlands, topsoil segregation is not typically practical; however, ONEOK will attempt to segregate as much of the organic layer as possible based on site/saturation conditions. Trench breakers will be installed as necessary to maintain the original wetland hydrology. Upon restoration, wetlands will be restored to the original contours. Where necessary to prevent erosion, disturbed wetland areas will be stabilized by seeding with a temporary cover crop. 7.5 CULTURAL. RESOURCES Alpine Archaeological Consultants, Inc. conducted a Class I cultural resources inventory file search for the project (Clauter 2017). The Class I inventory examined a corridor extending 2 miles on either side of the project centerline, for a total width of 4 miles. This review was completed in part using records and spatial data provided by the Colorado Office of Archaeology and Historic Preservation (OAHP). These records include information regarding previous archaeological inventories conducted in the area and information detailing the archaeological resources previously recorded. Included in this information are evaluations of the archaeological remains in terms of their eligibility for listing on the National Register of Historic Places (NRHP). In addition to the OAHP records, potential cultural resources were identified using historic General Land Office survey plats and land patents. The OAHP file search results identified 73 previously recorded sites or site segments within 2 miles of the proposed centerline in Weld County. No previously recorded sites are located within the current project workspace or on identified access roads. Of the 73 previously recorded sites located outside of the workspace and within 2 miles of the project in Weld County, 45 are eligible for NRHP nomination or need additional data before an NRHP determination can be made. No known cultural resources would be affected by the project. In addition, ONEOK will conduct its construction in accordance with an established Unanticipated Finds Plan for the project, which includes, but is not limited to the following measure: • On -call archaeologist would be available to consult if any potential archaeological (e.g., stone tools, fire rings, foundations, bones) are found during April 2018 18 Weld County Department of Planning Services Application for Use by Special Review Permit construction/excavation of the trench and right-of-way. Project construction would be temporarily stopped until review by the archaeologist. If needed, the State Historic Preservation Office would be consulted. 8.0 PROJECT CONSTRUCTION AND COMISSIONING SCHEDULE 8.1 CONSTRUCTION METHODS 8.1.1 Clearing The initial stage of construction involves the clearing of tall herbaceous vegetation, brush, and trees from the right-of-way. Clearing may be accomplished with mowers, chain saws, and/or other hydraulic tree and brush cutting equipment. When clearing, trees will be felled onto the right-of-way to minimize damage to off- right-of-way vegetation and resources. Unless otherwise directed by ONEOK, slash and woody debris will be disposed of by mowing, chipping, grinding, and/or hauling off site to an approved disposal facility, or the material will be stockpiled at the edge of the right-of-way and used to stabilize erodible slopes during restoration. 8.1.2 Grading Grading generally follows clearing and involves leveling and smoothing the construction right-of-way and extra workspace areas (as necessary) to create a safe, even working surface for equipment and vehicles. 8.1.3 Topsoil Segregation To prevent the mixing of topsoil with less productive subsoil during construction, topsoil will be segregated and co -mingling of soils will be avoided. The depth of topsoil to be segregated will depend on the soil conditions, and ONEOK will determine the depth of the topsoil by probing prior to construction. In areas of deep topsoil, stripping to a maximum depth of 12 inches will generally be considered adequate to minimize impacts on agricultural soils. Separation will be maintained between the topsoil and subsoil piles throughout construction to prevent mixing. In general, full right-of-way topsoil segregation is proposed; however, this may vary based on individual landowner agreements. 8.1.4 Temporary Erosion and Sediment Controls Temporary erosion control devices (ECD) will be installed after clearing and prior to grubbing and grading activities at the base of sloped approaches to streams, wetlands, and roads. Temporary ECDs will also be installed at the edge of the right-of-way as needed, and/or in other areas determined by ONEOK to slow water leaving the site and prevent siltation of waterbodies and wetlands downslope or outside of the construction right-of-way (e.g., swales and side slopes). Temporary ECDs will be placed across the entire construction right-of-way at the base of slopes greater than 5 percent where the base of the slope is less than 50 feet from drainage ways, wetlands, and/or waterbodies until the area is revegetated in accordance with the Colorado Department Public Health and Environment Construction Stormwater Permit and there is no potential scouring or sediment transport to surface waters. April 2018 19 Weld County Department of Planning Services Application for Use by Special Review Permit 8.1.5 Stringing, Bending and Welding Individual joints of pipe will be strung along the construction right-of-way. This operation involves specially designed equipment to deliver pipe from pipe storage yards to the right-of-way. Where practical, the contractor will drive stringing trucks along an alignment which corresponds closely to the pipeline centerline to minimize the potential for soil compaction in actively cultivated areas. After pipe stringing is complete, the pipe will be bent, as necessary, to conform to changes in ground contours and pipeline alignment. Individual pipe joints will be welded together and the welds will be inspected using a non-destructive testing procedure to verify the integrity of the welds, in accordance with Federal regulations. The welds will then be coated to protect them from corrosion. 8.1.6 Trenching Trenching in uplands consists of excavating the trench for the pipeline, and is typically accomplished with a backhoe excavator or a rotary wheel ditching machine. Excavated material will be sidecast (stockpiled) within the approved construction right-of-way separate from topsoil and stored such that erosion is minimized to the greatest extent practicable. During construction ONEOK will coordinate with landowners to minimize disruption of access caused by the trench. Where agreed to, the contractor will leave plugs of soil in the ditch or will construct temporary access bridges across the trench for the landowner to move livestock or equipment. Trenches will also be sloped where started and ended to allow ramps for wildlife to escape. 8.1.7 Lowering -in nce the trench has been inspected for proper depth, rocks, and/or other obstructions, the welded pipe will be lowered into the trench. In rocky soils, the pipe may be wrapped with a protective shielding to prevent damage to the pipe coating during backfilling. Trench breakers are installed in sloped areas after the pipeline has been lowered into the trench to protect against subsurface water flow along the pipe after the trench is backfilled. Trench breakers will be constructed with bags filled with rock -free subsoil or sand. ONEOK may also approve the use of foam trench breakers. 8.1.8 Backfilling Backfilling follows pipe installation and consists of replacing the material excavated from the trench. In areas where topsoil has been segregated, the subsoil will be replaced first, and then the topsoil will be spread uniformly over the area from which it was removed. 8.1.9 Cleanup and Rough/Final Grading Initial cleanup and rough grading activities may take place simultaneously. Cleanup involves removing construction debris (e.g., litter generated by construction crews, timber skids and similar woody debris, and excess rock). Rough and final grading includes restoring disturbed areas as near as practicable to preconstruction conditions, returning the topsoil where topsoil has been stripped, preparing a seedbed (where applicable) for permanent seeding, installing or repairing temporary erosion and sediment control measures, repairing/replacing fences, and installing permanent erosion and sediment controls. April 2018 20 Weld County Department of Planning Services Application for Use by Special Review Permit 8.1.10 Permanent Erosion and SedimentControls During final grading, slopes in areas other than cropland will be stabilized with erosion control structures e.g., permanent berms (diversion dikes or slope breakers) and erosion control blankets. The specific measures and spacings are dependent upon the steepness of slope. .1.11 Hydrostatic Testing Hydrostatic testing involves filling the new pipeline segments with water acquired in accordance with applicable permits, raising the internal pressure level, and holding that pressure for a specific period of time per DOT regulation (49 Code of Federal Regulations 195) to verify that there are no flaws in the pipe or welds. Pre -built sections (e.g., HDD sections) may be hydrostatically tested prior to installation. After the hydrostatic test is completed, the line will be depressurized and the test water will be discharged. Contractor will refer to the National Pollutant Discharge and Elimination System permit issued for water discharge and plan accordingly to meet the conditions of the permit. Note: Nowater appropriation sources or hydrostatic discharge sites are anticipated in Weld County. 8.1.12 Revegetation Permanent revegetation will include preparing the seedbed and seeding disturbed, non- agricultural areas. The approved construction workspaces will be seeded as soon as possible after backfilling, weather and soil conditions permitting. With the exception of wetland areas, fertilizer and pH modifying agents (e.g., lime) will be applied as specified by ONEOK, in consultation with appropriate state and federal agencies and landowners. Revegetation will occur in accordance with stormwater permits and will be considered to have reached final stabilization when all soil disturbing activities are complete, and a uniform perennial vegetative cover with a density of 70 percent of the typical or existing background vegetative cover for the area has been established on disturbed unpaved areas and areas not covered by permanent structures. 8.2 WORKFORCE REQUIREMENTS List the number of full time and/or part time employees proposed to work at this site. During construction, ONEOK anticipates up to 150 people at peak construction workforce and ONEOK inspectors could be present within the project area. The project will be constructed in phases with various crews spread out through the project area. See construction sequence detail in Attachment C. 8.3 HOURS AND DAYS OF OPE . TION During construction, the typical workweek is I 1 hours per days6 days per week, although extended working hours regularly occur. Construction is expected to commence the third quarter of 2018 and be completed early 2019. Once constructed, the pipeline would be in operation 24 hours a day, 7 days per week, 365 days per year. Routine maintenance and inspection activities would normally occur between 6:00 AM and 5:00 PM, but maintenance and inspection activities could occur at other times if personnel are responding to an emergency. Daily visits to the pipeline right -of -war are not anticipated. April 2018 21 Weld County Department of Planning Services Application for Use by Special Review Permit 8.4 ACCESS, HAUL ROUTES, AND TRAFFIC During construction, various construction equipment including graders, disking, stringing trucks, welding trucks, etc., would be required along the right-of-way for construction, installation, and reclamation activities. These vehicles would only be needed for the brief construction period and are not expected within the right-of-way once the pipeline becomes operational. During pipeline operation, only occasional foot traffic and traffic from pickup trucks within the right-of-way for routine maintenance and inspection would be required. Any additional traffic resulting from construction of the pipeline will be minor and temporary. The project will not contribute to significant alterations in traffic patterns within Weld County, and Weld County indicated during the pre -application meeting that a traffic study will not be required for this application. A Typical Traffic Control Plan is provided in Attachment 7. Access to the site would come from pre -negotiated private roads and from the county road system where the right-of-way crosses. ONEOK will consult with the Weld County Department of Public Works and individual landowners concerning access to the right-of-way. A typical is provided in Attachment 7 that illustrates how an existing, paved, county road will be temporarily crossed by construction equipment. Once the pipeline is operational, additional traffic will be limited to an occasional vehicle used for regular inspection and maintenance. No long-term alteration of traffic patterns within Weld County is anticipated. During construction travel along the routes would vary depending on the pipeline section being installed. ONEOK estimates the highest volumes of traffic will occur between 8:00 AM and 6:00 PM. Access to the right-of-way during construction would vary depending on the pipeline section being installed. The proposed pipeline would be generally be accessed via the approved right-of-way or pre -negotiated private roads along pipeline centerline. To date, seven permanent access roads and five temporary construction access roads have been identified and are shown on the project map. During operation, access to the pipeline would vary depending on the inspection and maintenance routes. 8.5 CONSTRUCTION SCHEDULE Construction activities in Weld County are currently planned to commence in Q3 2018 a n d is scheduled to be in-service by early 2019. 8.6 ENVIRONMENTAL HEALTH QUESTIONS 8.6.1 DRINKING WATER Drinking water will either be bottled or dispensed from a 5 gallon jug at the construction site, and will be required only temporarily during construction and restoration activities. The project will not involve the use of drinking water wells. Any existing public or private wells will be avoided and wellhead protection measures (e.g., refueling setbacks) will be implemented as described in section 5.3.4. Long-term supply of drinking water is not required for operation or maintenance activities. April 2018 22 Weld County Department of Planning Services Application for Use by Special Review Permit 8.6.2 PORTABLE TOILETS The use of portable toilets will only be required during construction and restoration activities. The contractor will provide portable, self-contained toilets, and the wastes from these units will be collected for disposal at licensed and approved facilities. Generally, portable toilets will be located near active construction sites; and will be transported along the project route to follow the construction crews. 8.7 FIRE AND EMERGENCY RESPONSE PROCEDURES ONEOK has developed emergency procedures in case of a reported failure or accident involving the proposed pipeline. An excerpt from ONEOK's Natural Gas Liquids Operations and Maintenance Manual is provided as Attachment 10. The document includes details on accident/incident reporting, notification classification, and emergency response plans. Section 2.2 of the manual provides the procedures to personnel who must handle an emergency situation, including but not limited to: • Fire or explosion occurring near or directly involving a pipeline facility; • Accidental release of hazardous vapors and liquids from a pipeline; • Operational failure causing a hazardous condition, such as a tank overflowing, relief valve failure, etc.; • Natural disasters affecting pipeline facilities, such as tornadoes, hurricanes, earthquakes, floods, etc.; and • Acts of sabotage. Additionally, section 2.3 of the manual is ONEOK's Emergency Action Plan, which contains multiple procedures which must be followed in the event of an emergency. Contact information for local fire and police officials will be obtained prior to construction, and can be provided to Weld County upon request. The transportation of NGLs by pipeline involves possible incremental risk due to the potential for accidental release of NGLs. If released into the environment, NGLs volatilize to gas and quickly evaporate, and pose a range of potential impacts to the environment and to human populations. NGLs shipped via pipelines generally have vapors that are heavier than air and that will collect in low or enclosed areas. These vapors will displace oxygen and create an oxygen - deficient atmosphere in those areas. Hydrocarbon vapors are flammable or combustible, although different hydrocarbon liquids have different flash points (the temperatures at which sufficient flammable vapors are emitted) and flammable ranges (the range of vapor concentration in the air expressed as a percentage by volume). This potential for flammability is a serious threat. The environmental impact of NGL release includes the potential for fire and the resulting short-term ecological impacts. The pipeline and aboveground facilities associated with the Project will be designed, constructed, operated, and maintained in accordance with the US DOT Minimum Federal Safety standards in 49 Code of Federal Regulations (Part 195). The regulations are intended to provide adequate protection for the public and to prevent natural gas facility accidents and failures. Pad 195 specifies material selection and qualification, minimum design requirements, and protection from internal, external, and atmospheric corrosion. Measures ONEOK will take to facilitate the safe operation of the pipeline include: Hydrostatic testing verify the pipeline's integrity prior to operations; • Corrosion protection by using high -integrity fusion bond epoxy coating and cathodic protection; • Internal inspection of the pipe using "smart pigs" designed to detect irregularities on the internal and external surfaces of the pipe; supervisory control and data acquisition system to continuously monitor the pipeline and the pressure of its contents; and • Participation in state "one call" programs. 81.2 FIRE AND EMERGENCY RESPONSE Fire protection will be provided by two fire districts, the Pawnee Fire Protection District, and the New Raymer/Stoneham Fire Protection District. ONEOK has reached out to both Districts and will continue discussions as the Project progresses to facilitate understanding of the Project. 8.8 DECOMMISSIONING PLAN Decommissioning of the pipeline is not anticipated after it has become operational. However, if permanent decommissioning of any or the entirety of the pipeline would be required, it would be emptied of any product, cleaned, permanently disconnected from the system, filled with nitrogen, and abandoned in place. Decommissioning activities would be conducted in April 2018 24 Weld County Department of Planning Services Application for Use by Special Review Permit accordance with local, state and federal regulations, industry practice, and per the existing landowner agreements. 9.0 CONFORMANCE TO WELD COUNTY CODE 9.1 CHAPTER 22 OF THE COMPREHENSIVE PLAN Per Chapter 22 of the Code, oil and gas facilities are allowed as a use by right in the A (Agricultural) zone district, in which the majority of the properties along the proposed pipeline routes are zoned. In addition, Weld County Code Section 23-2-200 et seq. permits construction of oil and gas support and service facilities in agricultural zoned districts. Section 22-5- 90 of the Weld County Code Comprehensive Plan states: "The most efficient and environmentally friendly way to transport... is by pipeline, rather than by truck. Transportation of the product by pipeline has less impact on County roads. Less truck traffic also benefits air quality in the area". Weld County Code Section 22-5-100 further states: "Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated". The proposed pipelines meet the objectives outline in the Weld County Code Comprehensive Plan without rezoning or changing the use of the land. The pipelines will be buried beneath the ground's surface and therefore the effect on any active agriculture will be temporary and isolated to the construction phase of the project. Following construction, the surface along the pipeline right-of-way will be restored to its prior condition, and agricultural activities may resume. 9.2 CHAPTER 23 OF THE COMPREHENSIVE PLAN (ZONING) Weld County Code Section 23-2-200 et seq. permits construction of oil and gas support and service facilities in agricultural zoned districts. Weld County Code Section 23-2-440 et seq. requires that NGLs pipelines be reviewed and approved under Special Review Permit. As such, the applicant is obligated to fulfill the requirements specified in Section 23-2-521 et seq. PHMSA identifies two types of notification, depending on the severity of the accident/incident: 1. Immediate notice and/or 2. Page 5 of 69 Manual Subject: Natural Gas Liquids Operations and Maintenance Manual Document No.: PRC1400.000 Section 2 Date Revised: 10/05/17 Rev. 14 Owner: Vice President Natural Gas Liquids Immediate Notice 195.52 Release Calculations 195.52 (c) Immediate notice is required for an accident/incident that: • Causes a death or a personal injury requiring hospitalization. • Results in either a fire or explosion, not intentionally set by the operator. • Causes estimated property damage, including cost of cleanup and recovery, value of lost product, and damage to the operator's or others' property, or both, exceeding $50,000. • Results in pollution of any surface water (stream, lake, etc.) or other similar body of water that violates applicable water quality standards, causes a discoloration of the surface water or upon adjoining shorelines, or deposits a sludge or emulsion beneath the water surface or upon adjoining shorelines. • In the judgment of the operator, is a significant event, even though it does not meet the other criteria listed. Immediate notice should be made at the earliest practical moment following the discovery of a hazardous liquid release, but no later than one (1) hour from the time ONEOK confirms discovery of the release. A reportable release confirms that an applicable accident has occurred. ONEOK must revise or confirm its initial telephonic notice within 48 hours of the initial telephonic report, to the extent practicable, reporting any revisions to the estimate of product released, number of fatalities and/or injuries or any/all other significant facts known by ONEOK that are relevant to the cause of the accident or extent of the damages. If there are no changes or revisions to the initial report, ONEOK must confirm the estimates in the initial report. The NGL manager or designee shall prepare and file an immediate notice to the NRC ((800) 424-8802, or electronically at http://www.nrc.uscq.mil) of certain events and additional report if significant new information becomes available. ONEOK shall have a written procedure for calculating an initial estimate of the amount of product released in an accident. Note: If the pipeline is under state jurisdiction, refer to the appropriate state requirements. The report should include: • Date and time of report; • Name and address of Company; • Name and phone number of person filing the report; • Name and phone number of the person with whom you speak; • The location of the release; • The time and date of the release; • Number of fatalities and personal injuries (if any); and • Size of release (if known). The ONEOK NGL manager or designee shall provide a reasonable initial estimate of the volume of product released in the event of an incident. 1. In the event of a major release; line break, rupture, punctures etc., the total volume between the two isolation valves shall be reported. 2. In the event of a minor release; pinhole leak, valve stem leak, vapor release etc., the preferred method to determine the release volume is the ONEOK NGL Event Calculation Tool. ONEOK NGL may choose to use other tools should use of the ONEOK NGL Event Calculation Tool be impractical. 3. An accident report is required for all reportable accidents on PHMSA jurisdictional pipelines. Accident reports shall be filed as soon as practical, but no later than 30 days after discovery. Reports must be submitted electronically at: httx://opsweb.Dhmsa.dot.cov Reports (except safety -related conditions reports and offshore pipeline condition reports) must be submitted electronically at: http://opsweb.phmsa.dot.gov Safety -related condition reports must be submitted concurrently to the applicable state agency for an intrastate pipeline or when the state agency acts as an agent for PHMSA with respect to interstate pipelines. Should a release occur, see the appropriate state's requirements listed below: 1. Release on pipeline regulated by Oklahoma Corporation Commission; a. Telephonic notice shall be made at the earliest practicable moment following determination of the release (within one (1) hour) to the commission's office by calling (405) 521-2258. 2. Release that occurs on Pipeline regulated by the Texas Railroad Commission; a. Telephonic notice shall be made at the earliest practicable moment following discovery (within two (2) hours) to the commission's emergency line at (512) 463-6788. 3. For releases in the following states, which do not operate a Part 195 pipeline safety program, notification will be made to the federal DOT: • New Mexico, Kansas, Colorado, Wyoming, Montana, North Dakota, Missouri, Nebraska, Iowa, Indiana and Illinois. When changes are received or additions are made in the information reported on the original report (DOT Form 7000-1), supplemental reporting is required within 30 days. Each operator of a hazardous liquid pipeline or pipeline facility must obtain from PHMSA an Operator Identification Number (DPID). An OPID is assigned to an operator for the pipeline or pipeline system for which the operator has primary responsibility. To obtain an OPID or a change to an OPID, an operator must complete an OPID Assignment Request - DOT Form PHMSA F 100.1 - through the National Registry of Pipeline and LNG Operators in accordance with 49 CFR 195.58. ONEOK NGL Pipeline OPID is: 32109 Each operator of a hazardous liquid pipeline facility must provide the following geospatial data to PHMSA for that facility: 1. Geospatial data, attributes, metadata and transmittal letter appropriate for use in the National Pipeline Mapping System. Acceptable formats and additional information are specified in the NPMS Operator Standards manual available at www.npms.phmsa.dot.gov or by contacting the PHMSA Geographic Information Systems Manager at (202) 366-4595. 2. The name of and address for the operator. 3. The name and contact information of a pipeline company employee, to be displayed on a public Web site, who will serve as a contact for questions from the general public about the operator's NPMS data. This information must be submitted each year, on or before June 15, representing assets as of December 31 of the previous year. O NEOK NGL Pipeline must notify PHMSA electronically through the National Registry of Pipeline and LNG Operators at htto://oDsweb.phmsa.dot.pov of certain events. O NEOK NGL Pipeline must notify PHMSA of any of the following events no later than 60 days before the event occurs: • Construction or any planned rehabilitation, replacement, modification, upgrade, up rate, or update of a facility, other than a section of line pipe, that costs $10 million or more. If 60 -day notice is not feasible because of an emergency, an operator must notify PHMSA as soon as practicable. • Construction of ten (10) or more miles of a new or replacement of hazardous liquid pipeline or construction of a new pipeline facility. • Reversal of product flow direction when the reversal is expected to last more than 30 days. • Notification is not required for pipeline systems already designed for bi-directional flow. • A pipeline converted for service under 49 CFR 195.5, or a change in commodity as reported on the annual report as required by 49 CFR 195.49. State Notifications: Oklahoma ONEOK shall notify the Oklahoma Corporation Commission (0CC) prior to the construction of a new pipeline, or a relocation or replacement of a pipeline greater than one (1) mile, subject to the jurisdiction of the OCC, by completing and filing Form 5001 with the 0CC seven (7) calendar days prior to commencement of construction. In the event of an emergency, telephonic notice of emergency construction, followed by the mailing of Form 5001 within five (5) work days from the date of the telephonic notice, is required. Texas ONEOK shall notify the Railroad Commission of Texas (RRC) prior to the construction of any pipeline greater than one (1) mile in length. Notice to the RRC is required thirty (30) days prior to the commencement of construction. Such notice shall be given by utilizing Form PS -48. ONEOK NGL Pipeline must notify PHMSA of any of the following events not later than 60 days after the event occurs: • A change in the primary entity responsible (i.e., the entity with an assigned OPID) for managing or administering a safety program required by this part covering pipeline facilities operated under multiple OPI Ds. • A change in the name of the operator. • A change in the entity (e.g., company, municipality) responsible for operating an existing pipeline, pipeline segment, or pipeline facility. • The acquisition or divestiture of 50 or more miles of pipeline or pipeline system subject to this part. • The acquisition or divestiture of an existing pipeline facility subject to this part. O NEOK NGL Pipeline must use the OPID issued by PHMSA for all reporting requirements covered under this subchapter and for submissions to the National Pipeline Mapping System. An operator may decide not to test under this paragraph but such a decision must be based on specific information that the covered employee's performance had no role in the cause(s) or severity of the accident. (2) If, for any reason, a test required by this section is not administered within the 32 hours following the accident, the operator must prepare and maintain a written statement documenting the reasons why the test was not promptly administered. If a test required by paragraph (b)(1) of this section is not administered within 32 hours following the accident, the operator must cease attempts to administer a drug test and must state in the record the reasons for not administering the test. A post -accident alcohol test shall be conducted on each employee as soon as possible but no later than eight (8) hours after the accident. If the test is not completed within two (2) hours the Company will prepare and maintain a written statement documenting the reason the test was not conducted. If the test is not completed within eight (8) hours the Company shall cease attempts to do so. The Company will take all reasonable steps to obtain a breath test from an employee after an accident, but any injury should be treated first. Nothing in this section shall be construed to require the delay of necessary medical attention for injured people following an accident, to prohibit a covered employee from leaving the scene of an accident for the period necessary to obtain assistance in responding to the accident, or to obtain necessary emergency medical care. The affected employee will not be allowed to proceed alone to the testing site. A covered employee who is subject to post -accident testing who fails to remain readily available for such testing, including notifying the Company or Company's representative of their location if they leave the scene of the accident prior to submission to such test, may be deemed by the Company to have refused to submit to testing. The NGL manager or the NGL manager's designee shall, as soon as practical, but within five working days (not including Saturdays, Sundays, or federal holidays) after the day of discovery, determine if the condition is reportable using the DOT Safety -Related Condition Reportability Guidelines noted below: If a condition is judged reportable, the NGL manager or the NGL manager's designee, as soon as practical, but no later than five (5) working days (not including Saturdays, Sundays, or federal holidays) of the discovery of the condition shall: • Complete the Safety -Related Condition Report. • When applicable, attach a recommended Plan of Action. • Electronically mail or fax such reports to DOT and the appropriate state agency. Definitions of some safety -related conditions are listed in #1 below. Instances where safety -related conditions do not require reporting are listed in #2 below. 1. Definitions of Safety -Related Conditions a. General corrosion that has reduced the wall thickness to less than that required for the maximum operating pressure, and localized corrosion pitting to a degree where leakage might result. This determination will be made by a corrosion specialist or NGL engineer. b. Unintended movement or abnormal loading of a pipeline by environmental causes, such as an earthquake, landslide, hurricane, or flood that impairs its serviceability. c. Any material defect or physical damage that impairs the serviceability of a pipeline. d. Any malfunction or operating error that causes the pressure of a pipeline to rise above 110% of its maximum operating pressure. e. A leak in a pipeline that constitutes an emergency. f. Any safety -related condition that could lead to an imminent hazard and causes (either directly or indirectly by remedial action of the operator), for purposes other than abandonment, a 20% or more reduction in operating pressure or shutdown of operation of a pipeline. A verified in -line inspection report indication requiring a pressure reduction. g. Note: An in -line inspection report, without verification, does not constitute a safety -related condition. 2. Safety -related Conditions that do not require a report a. A safety -related condition that exists on a pipeline more than 220 yards from any building intended for human occupancy or outdoor place of assembly. Adequate Information Test for Reportability a. Discovery of a potentially reportable condition occurs when an NGL representative has adequate information from which to conclude the probable existence of a reportable condition. 4. Training a. Personnel performing operation and maintenance activities shall be instructed to recognize potential safety -related conditions. (Refer to Section 6.0 - Employee Training for information about employee instruction.) The purpose of this procedure is to provide organization and instruction to personnel who must handle an emergency situation. This procedure covers all emergency situations in a general manner. An emergency may exist if the following conditions occur: • Fire or explosion occurring near or directly involving a pipeline facility. • Accidental release of hazardous vapors and liquids from a pipeline. • Operational failure causing a hazardous condition, such as a tank overflowing, relief valve failure, etc. • Natural disasters affecting pipeline facilities, such as tornadoes, hurricanes, earthquakes, floods, etc. • Acts of sabotage. Applicability Code References Documentation Reporting an Emergency Situation Applies to all Company personnel 49 CFR 195.402(c)(4),(5), 195.402(e), 195.446 Section 2.3 - Emergency Plan An emergency situation may be reported by several methods. Some of these methods are: • As a result of routine aerial patrol. • Report from Company personnel. • Report from the public or public officials. • Report from receiving or delivery facility operators. • Report from a saboteur or prankster. • Report from the Pipeline Control Center. Under certain circumstances persons in the employ of the operator may be required to receive information concerning an emergency event. For this reason, employees shall be trained to take certain information. This training shall occur during emergency response training. At the time information concerning an emergency event is received, the caller shall be advised to take the necessary precautions to ensure their safety. Emergency reports are submitted to the 24 -hour Pipeline Control Center telephone numbers listed below: • NGL Legacy/FERC (800) 666-9041 • ONEOK Rockies/FERC/Bakken (855) 348-7258 • NGL North System (888) 844-5658 • ONEOK Permian NGL Operating Company (844) 288-7240 The Pipeline Control Center is manned 24 hours a day 7 days a week. The controller receiving the report is authorized to shut down the pipeline, and immediately contact the area's primary or secondary qualified individual, if applicable. If a leak report is received at the office or home of an area employee, the employee who receives the call shall take the information as completely as possible and relay the information to the controller on duty or to the area's qualified individual. Employees should use ONEOK Online as a resource to locate contact information for Company personnel. There are two event classes for a reported emergency: 1. Possible event 2. Confirmed event Possible Event • Reported by someone other than a Company employee and cannot be immediately confirmed according to the information known at the time. • Indicated by a pressure or flow rate indication, but not confirmed by another source. Confirmed Event • Reported by someone other than a Company employee, but confirmed by another source, such as a pressure reading, flow indication, or another person. • Indicated by a pressure or flow rate indication and is confirmed by another source. Immediately upon receiving notification of a leak or emergency event, the controller on duty, or another Company employee, shall notify their immediate supervisor or the primary or secondary qualified individual for that area. If the controller on duty receives a leak alarm from the Pipeline Leak Detection System and the cause of the alarm is unknown and/or the volume balance in the shorter periods are consistently positive or increasing, the controller shall notify the leak detection engineer immediately. The ONEOK Pipeline Control Room Management Plan contains procedures to identify actions the controller on duty shall take during a pipeline emergency. A Company employee shall classify the potential leak as either possible or confirmed. Emergency calls shall be kept brief in order to begin confirmation or take emergency action. If confirmation is required, the controller on duty shall follow the steps below: 1. Check for other reports of a similar nature in a similar location. 2. Check the Pipeline Control Center monitors for signs, such as: • Pressure drops or abnormalities. • Pressure or flow rate readings lower or higher than normal. • An alarm from the leak detection system. • Activation of fire detector alarm. • Activation of a gas alarm (HVLs ONLY). • Status of motor -operated valves. • The unexpected shutdown of a pump. • Any unexplained abnormality coinciding with a reported event. 3. Upon determination of a confirmed emergency, employees shall refer to Section 2.3 in this manual. The primary or secondary qualified individual or appointee shall notify the appropriate agencies and establish communications with local responders. This notification shall be documented on the notification forms provided. At a minimum, the following information should be given: • Name of the pipeline; • Time of discharge; • Name of the material involved; • Location of the discharge; • Reason for discharge; • Estimated volume of discharge; • Weather conditions; and • Emergency action steps taken. Agency notifications shall be completed as described in Section 2.1. State notification requirements vary from state -to -state, but must be addressed as soon as possible. Local authorities shall be notified as soon as possible after a release that could pose a threat to the public. O NEOK has determined that all pipeline facilities outside of fenced property controlled by O NEOK require immediate response to prevent hazards to the public in the event of a pipeline failure or malfunction that could result in a release. An emergency response notification checklist must be maintained to document the times and sequences of events during the notification process. If the emergency notification is received from a source other than Company personnel, the emergency must be confirmed. 3. After the emergency is confirmed, the information obtained must be communicated to the appropriate area supervisor or designee and/or manager or designee. 1. The person reporting a potential emergency shall identify the type and location of the emergency and may announce an immediate evacuation. 2. If the situation calls for an immediate evacuation, Company personnel should ensure the following actions take place: • Evacuate everyone to an upwind or crosswind location; • Do not attempt to start any vehicles in the vicinity of the leak or spill; • Do not drive into or near a vapor cloud; and • Eliminate all ignition sources. 3. Once a safe location has been reached, immediately contact the Pipeline Control Center to begin the process of contacting supervisory personnel and any applicable emergency response agencies. After receiving notification of the emergency, the emergency supervisor will establish an emergency response team. The emergency response team is responsible for: • Dispatching the appropriate personnel to the emergency. • Notifying the business manager or designee and/or area supervisor or designee. • Assigning an employee to establish a central communications center. • Assigning an employee to gather and dispatch appropriate work equipment. • If conditions indicate the need, contacting law enforcement and/or public agencies for the following types of public protection: o Evacuating residences. o Halting traffic on roads and railroads in the affected area(s). o Any other actions deemed necessary. When feasible the Incident Command structure should be utilized. The first employee on the scene shall act as Incident Commander until relieved by the assigned Incident Commander or his/her designee. Upon arrival at the emergency location, the Incident Commander shall coordinate with the incident command members to: 1. Assess the extent of hazardous liquid and/or the coverage of the vapor cloud using: • Sight; • Explosive meter; and/or • Gas detection instruments, if applicable. 2. Assess the need for personal and/or public protection. 3. Establish and maintain a line of communication between the emergency location and the designated central communications center using • Cellular phone; • Mobile phone; and/or • Land phone. 4. Advise and coordinate with pipeline management which facility to shut down or which block valves to close in order to stop the flow of product and minimize the release and/or other hazards by: • Field personnel and/or • Use of an emergency shutdown device. 5. Coordinate with pipeline management the contact of law enforcement agencies (PSAP, Sheriff, Fire, LEPC, etc.), if the product release involves any public residence, highway, railroad, business, or public place. 6. Coordinate with business management the notification of other companies having facilities in the immediate area that may be endangered. 8. Continue as Incident Commander until relieved by the assigned Incident Commander or his or her designee. Any individual trained in first aid should respond in order to comfort and render first aid to injured parties in a safe manner. Employees should utilize first aid and medical equipment in accordance with training. PPE hazard assessment will be determined at the time of the incident. Current emergency equipment consists of first aid kits and fire extinguishers. Additional equipment will be furnished by emergency responders at the scene of an incident. The employees stationed at the central communications center shall assist with coordination of the necessary workforce and material, as advised by the Incident Commander. Public relations will be conducted under the direction of the area manager or the incident commander until the public information officer is assigned, if one is needed. ONEOK personnel should be courteous at all times, as they are Company representatives with whom the public has contact. ONEOK representatives MUST NOT do any guessing or speculating. Rather, ONEOK representatives must state only the established facts. For their personal protection, the general public, press and other photographers are not allowed on Company property. A decontamination plan should be developed on a case by case basis and set up before any personnel or equipment may enter the "hot zone" (area where the potential for exposure to hazardous substances exist). All personnel involved in the response and entering the hot zone shall be properly trained, equipped, and certified to meet the requirements of emergency response. The decontamination plan should: • Determine the number and layout of decontamination stations. • Determine the decontamination equipment needed. • Determine the appropriate decontamination methods. • Establish procedures to prevent contamination of clean area. • Establish methods and procedures to minimize worker contact with contaminants during removal of personal protective clothing and equipment. • Establish methods of disposing of clothing and equipment that are not completely decontaminated. The decontamination plan should be revised whenever the type of personal protective clothing or equipment changes, the site conditions change, or the site hazards are reassessed based on new information. NGL is the most likely material that would require decontamination. Decontamination would typically include removal and containerization of the contaminated material for disposal. If contaminated materials are decontaminated on site, washing with soap and water is the recommended method. After responding to the emergency notification, the assigned Incident Commander will proceed to the emergency site and assume the Emergency Supervisor or designate role. After arriving at the site, the Incident Commander shall: • Determine if the area is secured and isolated from product release. • Assess the need for personal and/or public protection. • Determine the safest and quickest means of repairing the failed equipment. • Determine the required work equipment and personnel needed. • Notify the required NGL personnel and/or DOT -approved contractor(s). • Determine if stopple equipment is required. • Determine what materials are required. • Coordinate repairs with the Area Manager. After isolating the failed equipment and determining that the emergency site is safe, the necessary repairs shall be performed according the ONEOK recommended work practices and standards. After completing repairs, the Incident Commander or his or her designee shall coordinate the start-up of the pipeline with the plant operator. Field personnel should continue to observe the repaired equipment until the system returns to normal operating conditions. The emergency site shall be returned to as near normal condition as possible. Clean up shall be performed in accordance with applicable ON EOK recommended practices and standards. Alcohol Testing Requirements & Procedure 1. Drug and alcohol testing must be administered to each employee whose performance either contributed to the accident/incident or cannot be completely discounted as a contributing factor to the accident/incident. 2. Drug testing (urine specimen) must be done as soon as possible, but no later than 32 hours after an accident/incident. 3. A post -accident alcohol test shall be conducted on each employee as soon as possible but no later than eight (8) hours after the accident. If the alcohol test is not completed within two (2) hours, the Company shall prepare and maintain a written statement documenting the reason the test was not conducted. Page 18 of 69 Manual Subject: Natural Gas Liquids Operations and Maintenance Manual Document No.: FRC1400.000 Section 2 Date Revised: 10/05/17 Rev. 14 Owner: Vice President Natural Gas Liquids Incident Reporting Training Complete the following necessary forms and reports within 48 hours after returning to normal operating conditions and submit them to the ONEOK office: • Notification logs (logger); • Employee notes, logs, and pictures; • Measurement and pressure information; and • A determination if FCC actions contributed to the incident and if so, whether fatigue played a part. Within 60 days after an accident or incident, the Area Manager (or his or her designee) shall conduct a review of the incident and the response. This review shall address the following areas documented on the approved Cause Map: • Detection and notification; • Initial safety procedures and damage mitigation; • Incident scene action; • Performance of personnel and response procedures; • Cause of incident; and • Follow-up action. The Area Manager (or his or her designee) shall include in the investigation those select Company personnel involved in the incident. It may be necessary to question not only the Company personnel, but also persons from outside agencies and contracted help involved in the incident. The Area Manager (or his or her designee) should attempt to collect all documentation associated with the incident including a signed record of initial notifications and certified copies of written follow-up reports. All of the official incident records should be kept on file at the ONEOK office. Employees, supervisors, and managers who participate or are expected to participate in emergency response for releases of hazardous substances shall receive training which meets the requirements of 29 CFR 1910.120(q)(6) before they are permitted to engage in an actual emergency response. The level and subject matter of training shall be based on the duties and function to be performed by each responder in accordance with CFR 1910.120(q}(6)(I0 through (v). Such functions may include: • First Responder Awareness Level • First Responder Operations Level • Hazardous Materials Technician • Hazardous Materials Specialist • On -Scene Incident Commander Each responder shall either receive annual refresher training of sufficient content and duration to maintain competency for function or shall annually demonstrate such competency. A statement shall be made of the training or competency, and if a statement of competency is made, a record of the methodology used to demonstrate competency shall be maintained. A written certificate of training completion or competency shall be given to each responder. (Information on the route is included in the pre -application material) Background Information: Oneok is proposing to construct a 20 -inch natural gas liquids pipeline approximately 900 miles in length. The pipeline will originate in Richmond County, Montana and terminate at the Oneok facility in Bushton, Kansas. Approximately 33 miles of the pipeline will be in Weld County. Construction of the pipeline will require use of both temporary and permanent right-of-way easements. There are other pipelines that they may be crossing and would have Encroachment Agreements with the companies. Any county roads and streams will be directional drilled under the crossings. They hope to start construction in July 2018 with completion of project in 2019. Waste handling: Waste materials shall be handled, stored, and disposed in a manner that controls blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. Please answer the following if applicable; indicate if there will be washing of vehicles or equipment, fuel storage, maintenance of vehicles or equipment, floor drains in shop, air emissions permit. Onsite dust: Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. Sewage disposal information: Include in application how sewage disposal will be accommodated. If using a septic system provide a copy of the septic permit. Potable water information: Include in application how potable water will be provided. Provide a will serve letter or water bill from the water district or provide a copy of well permit. We strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure the approved accesses are compatible with your layout. For new accesses and/or change of use of an existing access, the fee and photos are required (photo looking left and right along roadway from the access point and looking in to and out of the access point). Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria offer access design guidance, which can be accessed at: https://vvww.weldgov.com/departments/public works/engineerinq/. Appendix 12-A of the county code can also be referenced. Existing access points with change of use or new access points may or may not be granted. Questions pertaining to access permits or access design shall be directed to the Public Works Department. Application Fee: temporary $75, single residential $75, small commercial $75, industrial $150, field $0, large commercial $150, subdivision $150. For shared accesses, Public Works strongly recommends the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Per Chapter 12, Appendix 12A.4.1 of the Weld County Code, an access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. As part of the development review process, all new commercial or residential developments will be required to submit a TIS that is prepared, stamped, and signed by a professional engineer licensed in the State of Colorado, unless the TIS is waived by Public Works. Traffic Narrative: 1. Describe how many roundtrips/day are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and 1 trip out of site) 2. Describe the expected travel routes or haul routes for site traffic. 3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) 4. Describe the time of day that you expect the highest traffic volumes. Public Works will review the narrative and advise the applicant if more information or an engineered traffic study is required. Public Works may require an Improvements Agreement for one or all the following reasons: • Off -Site Public Improvements • Road Maintenance Agreement • Construction Maintenance Agreement • Access Improvements Agreement • On -Site Improvements for Subdivisions/PUDs An Improvements Agreement is required for sites with required offsite improvements per Chapter 12, Article 5, Section 12-5-60. Collateral is required to ensure the improvements are completed, and maintained. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. Weld County has recently adopted a new stormwater drainage code located under Chapter 23, Article 12 Storm Drainage Criteria. This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas generally require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site. Detention Pond Requirements: 1. Drainage Narrative requirements with exception from detention pond. The Drainage Narrative must describe at a minimum: i. Which exception is being applied for and include supporting documentation ii. Where the water originates if it flows onto the property from an offsite source iii. Where it flows to as it leaves the property iv. The direction of flow across the property v. If there have been previous drainage problems with the property DRAINAGE CODE REQUIREMENTS (informational only): Section 23-12-30. Drainage Policy. F. Exceptions. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property and shall be limited to the following: No stormwater detention will be required for sites that meet any of the following conditions. If more than 1 acre is to be disturbed for construction of non pipeline or non -gravel pit items such as structures, parking lots, laydown yards etc..., a Weld County Grading Permit will be required prior to the start of construction. Grading Permit applications are accepted after the planning process is complete (map recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns.
