RE: APPROVAL OF RECORDED EXEMPTION NO. 316 - WALTER HAFFNER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 10th day of April, 1978 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 316 , being the property of
Walter Haffner, described as the Wz of the NE4 of Section 25,
Township 1 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
The West one-half of the Northeast one-quart-Pr, Except
the North 35.00 feet thereof, of Section 25, 7bwnship
1 North, Range 65 West of th 6th P.M. , Weld County,
Colorado.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Walter Haffner, be and hereby is, exempt

land" pursuant to its authority under Section 30-28-101 (10) (d) ,

RE: Recorded Exemption #316
Dear Commissioners :
The attached application, plat , and related items are in reference to
a request by Walter Haffner for a recorded exemption. The property on
which the recorded exemption has been requested is described as the
9z of the NE4 of Section 25, T1N, R65W of the 6th p.m. , Weld County ,
Colorado. This property is located 1? miles east and 21 miles south of
Hudson. The property in question contains approximately 80 acres of
non-irrigated land with Class IV and Class VI non-irrigated soils . The
request is to split the property into parcels of two acres and 78 acres.
On March 13 , 1978, the Board of County Commissioners approved a request
by Walter Haffner for a lot size variance so that he could make application
for this recorded exemption . At the time they made the decision on that
request , the Department of Planning Services staff submitted a letter of
recommendation to the Board. A copy of that letter of recommendation is
included in the attached packet . Nothing has been received by our office
which would change our recommendation of approval for this request as
outlined in a letter to the Board of County Commissioners dated March 10,
1978. This request complies with the provisions of Section 9-4(A) of
the Weld County Subdivision Regulations .

this property at the present time . The request is to obtain a
variance from the minimum lot size requirement , Section 9-4 A - (6) ,
so that they may make application to apply for a recorded exemption .
Section 9-4 A . (6 ) of the Weld County Subdivision Regulations states :
"That the original tract or parcel of land to be divided under
this section meets the minimum lot size requirement estab-
lished by the Weld County Zoning Resolution ; variance from
this requirement heing allowed only upon good cause heing
shown to the Board of County Commissioners or where said
tract or parcel of land lies within the Comprehensive Plan
area of an existing incorporated town of Weld County (Revised •
4-17-74 ) . "
If this loa sir.n variance is 1rranted , Waiter and Edward Haffner wi l l
proceed with their application for a recorded exemption to divide
the property into two parcels . One parcel is proposed to contain
approximately 2 acres which will be used as a residential site for
".1r. Edward Haffner, Walter llaffner ' s son . The second parcel of
approximate Iv 78 acres will continue to he used for agricultu"a1
purposes . As indicated in a letter from the Haffner, , the family
is involved in farming a total of 400 acres in this area .
