RESOLUTION RE: APPROVE STIPULATION OF MINERAL INTEREST AND AUTHORIZE CHAIR TO SIGN - DPG FARMS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Stipulation of Mineral Interest between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and DPG Farms, LLC, commencing upon full execution of signatures, with further terms and conditions being as stated in said stipulation, and WHEREAS, after review, the Board deems it advisable to approve said stipulation, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Stipulation of Mineral Interest between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and DPG Farms, LLC, be, and hereby is, approved. The County condemned approximately 19 acres of the property to build the Weld County Parkway, and while the County did not obtain any mineral interests as part of that condemnation, the Court's final Rule and Order did not specifically state that. PDC would like the County to sign a stipulation indicating that the County did not obtain any mineral interests as a result of the condemnation. Bruce and I recommend you authorize the Chair to sign the attached stipulation, as it accurately reflects the County's mineral interests (0%). Exhibit "A" identifies the acreage as a "Right of Way". Therefore, the examining attorney is assuming since this is a "Right of Way", the minerals should not have transferred to Weld County. A five-day jury trial commenced on September 28, 2015, in order to determine the amount of. just compensation owed to the respondents for the property being taken. Pursuant to the Verdict entered on October 2, 2015, the value of the property actually taken is $183,795.17, and the damages to the residue are $0.00. Thus, the total just compensation owed to respondents is $183,795.17 ("Just Compensation"). 4. Petitioner shall pay the difference between the Just Compensation and the Deposit, with interest, calculated as follows: a) As the Deposit, Petitioner has already paid Respondent -Landowner $148,714. b) The Deposit is deducted from the Just Compensation amount leaving a difference of $35,081.17 ($183,795.17 — $148,719).
