HEARING CERTIFICATION DOCKET NO. 2018-03 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0057, FOR AN OIL AND GAS SUPPORT AND SERVICE FACILITY (COMPRESSOR STATION FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - EQUUS FARMS, INC., C/O BILL BARRETT CORPORATION A public hearing was conducted on January 17, 2017, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro -Tern Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: • hereby certify that pursuant to a notice dated December 13, 2017, and duly published December 18, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Equus Farms, Inc., c/o Bill Barrett Corporation, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0057, for an Oil and Gas Support and Service Facility (compressor station facility) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated there will be three (3) natural gas compressors installed along with a control room building and meters. He clarified each compressor will be located in a building and other structures include a heater treater, vapor recovery units, and slug catchers and this intended use is located on a previously disturbed area for a well pad and will be fenced to keep out livestock. Mr. Gathman stated it is largely unmanned and he described the surrounding properties, nearest residence and reported the site is not located in a three (3) mile referral area of any municipality. He stated staff received a total of eight (8) referral responses. He reviewed the site layout and access location. Mr. Gathman displayed images and entered the favorable recommendation of the Planning Commission into the record as written. • Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements and stated the access permit has been acquired through the State, which meets the requirements of the Department of Public Works. Pt. ccc,gm(n), P.cHB), ?H(gr-), cracTs) 031of/ I g 2018-0174 PL2515 HEARING CERTIFICATION - EQUUS FARMS, INC., 0/O BILL BARRETT CORPORATION (USR17-0057) PAGE 2 el Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements, and reported the applicant submitted a drainage narrative stating the intended site meets the exception for #1.A.10 regarding non -urbanizing areas which is relevant when the amount of total stormwater runoff is less than, or equal to, ten (10) cubic feet per second (cfs). She reviewed the typical Conditions of Approval and Development Standards related to engineering. El Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated due to the site being primarily unmanned, bottled water and portable toilets are acceptable. He reported Development Standards (DS) #7-22 address Environmental Health items. El Doug Dennison, Bill Barrett Corporation, applicant, stated he is available for questions. • No public testimony was offered concerning this matter. El In response to Chair Moreno, Mr. Dennison indicated they have reviewed the Conditions of Approval and Development Standards and have no concerns. la Mr. Gathman added a minor change to the legal description to reflect the Subdivision Exemption, SUBX17-0024. • In response to Chair Moreno, Mr. Dennison indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as presented. • Commissioner Kirkmeyer moved to approve the request of Equus Farms, Inc., c/o Bill Barrett Corporation, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0057, for an Oil and Gas Support and Service Facility (compressor station facility) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Cozad, and it carried unanimously.
