As a result, in accordance with the requirements of C.R.S. § 24-18-109(3)(a), I will not be participating in the Board of County Commissioner's ("the Board's") hearing for the Project's 1041 Permit and I will not be voting thereon. Additionally, I will not be speaking with any of my fellow Weld County Commissioners or Planning staff about the Project, and therefore will not be "attempting to influence the decisions of the other members of the [Board] in voting on the matter," as prohibited by C.R.S. § 24-18-109(3)(a). In my February 9, 2018, letter, I stated that the Board had received a letter, "Re: Public Service Company of Colorado — Notification of Intention to Submit Permit Application for New Electric Transmission Line and a New Electric Transmission Substation [C.R.S. §29-20-108(4)(a)] — Weld County," from Xcel Energy. A copy of the Xcel letter was enclosed with my February 9t" letter. I stated in my letter that the Xcel letter was received by the Board on the date shown on the letter: January 18, 2018. However, it has come to my attention that the Xcel letter was actually received by the Board on January 16, 2018, via email sent to us by Tom Parko, Director, Weld County Department of Planning Services. A copy of that email is enclosed. This letter is to ensure that you are informed of the correct date of receipt of the Xcel letter by the Board. The Project will require the approval of a "1041 Permit" issued by the Board of County Commissioners of Weld County ("the Board") for the Site Selection and Construction of a Major Facility of a Public Utility. I am a member of the Board. It is my understanding there is a high probability the transmission line will cross properties owned by my me and wife, Janine L. Freeman, and/or properties owned by the Mary K. Baiamonte Trust, for which I am trustee. Janine and I first became aware of the Project when we received a notice from Xcel regarding an open house scheduled for October 26, 2017, at the Administration Building for the Highland School District Re -9. A copy of the October, 2017, Xcel notice is enclosed. We attended the October 26th open house. I announced to the Xcel representatives and neighbors in attendance that I was there as a property owner and not as a Weld County Commissioner. In early January, 2018, Janine and I received from Xcel another notice of an open house, this time set for January 24, 2018, at the Eaton Recreation Center. A copy of the January, 2018, Xcel notice is enclosed. We attended that open house; however, at the meeting we spoke only with neighbors who were in attendance and not with Xcel representatives. On January 18, 2018, the Board of County Commissioners received the enclosed letter, "Re: Public Service Company of Colorado — Notification of Intention to Submit Permit Application for New Electric Transmission Line and a New Electric Transmission Substation [C.R.S. §29-20- 108(4)(a)] — Weld County," from Xcel. Although that letter is required by Colorado statute, it does not start the application process pursuant to Weld County Code Section 21-3-310 B. Instead, a person or entity intending to apply for a 1041 Permit in Weld County may start the process by scheduling a pre -application conference with Department of Planning Services ("Planning") staff. It is my understanding Xcel and Planning staff had a pre -application conference (PRE18-0008) regarding the project on January 19, 2018. Only one circuit will initially be installed and operated at 230 kV. • Husky Substation o This new substation will replace the Xcel Energy Ault 44 kV Substation, which will be decommissioned. The Husky Substation will also accommodate distribution upgrades that increase reliability. • Husky— Graham Creek 115 kV line o The new line will be approximately seven miles and be built double -circuit 230 kV capable. Only one circuit will initially be installed and operated at 115 kV. • Graham Creek Substation o This new substation will replace the Xcel Energy Eaton 44 kV Substation, which will be decommissioned. The Graham Creek Substation will be constructed to accommodate distribution upgrades and improve system reliability. • Graham Creek — Cloverly 115 kV line o This new line will be approximately eleven miles and be built double -circuit 230 kV - capable. Only one circuit will initially be installed and operated at 115 kV. Eight miles of that new transmission will be built double - circuit 230 kV capable. The remaining three miles are already constructed to be 115 kV capable. • Cloverly Substation (Upgrade) o Two transformers will be added to the Cloverly Substation as part of the termination of the new line from Graham Creek and to allow for future load interconnection requests. The Cloverly modifications will also accommodate distribution upgrades.
