Dear Weld County Commissioners,
My firm represents the Town of Frederick ("Town"). The Town is in the process of
petitioning the Weld County District Court for inclusion into the Municipal Subdistrict, Northern
Colorado Water Conservancy District. This letter is being mailed to you via registered mail
pursuant to section 37-45-136(3)(e). C.R.S. Enclosed with this letter is a copy of the Notice of
Hearing the Town will publish in the Greeley Tribune for three consecutive weeks, and a
courtsey copy of the Weld County District Court's Order setting a hearing on the Town's
petition for August 22, 2018, at 8:30 A.M.

NOTICE OF HEARING ON PETITION FOR INCLUSION OF LANDS INTO THE
MUNICIPAL SUBDISTRICT, NORTHERN COLORADO WATER CONSERVANCY
DISTRICT, FILED BY THE TOWN OF FREDERICK
Notice is hereby given that pursuant to section 37-45-136(3)(e), C.R.S., a hearing will be
held to consider a Petition for Inclusion of all lands located in the Town of Frederick into the
boundaries of the Municipal Subdistrict, Northern Colorado Water Conservancy District
("Subdistrict") pursuant to the Water Conservancy Act, C.R.S. §§ 37-45-101 et seq.
The hearing on the Petition will be held at the Weld County Courthouse, 901 9th Avenue,
Greeley, Colorado at 8:30 A.M. on August 22, 2018.
Pursuant to section 37-45-136(3)(g), C.R.S., not less than thirty days prior to the time
fixed by order of the court for the hearing on said petition, and not thereafter, a petition as
described in section 37-45-136(3)(g), C.R.S., may be filed in the office of the clerk of the court
where this proceeding for inclusion is pending, protesting the inclusion of said area. In addition,
pursuant to section 37-45-136(3)(k) and (1), C.R.S., any owner of real property in the area
proposed for inclusion, and not having individually signed a petition for inclusion, may file an
objection to inclusion on or before ten days prior to the date set for the cause to be heard.
The Town of Frederick filed a map of the lands proposed to be included in the Subdistrict
with its Petition, and those lands are generally described as follows: All lands within the
municipal boundaries of the Town of Frederick, which includes some or all of the land located in
the following Townships, Ranges, and Sections:
Township 2 North, Range 68 West of the 6th P.M: Some or all of sections 9, 10, 13, 14, 15, 16,
20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36.
Township 2 North, Range 67 West of the 6th P.M.: Some or all of sections 19, 29, 30, 31, 32,
and 33.
Township 1 North, Range 68 West of the 6th P.M.: Some or all of sections 3 and 5.
Township 1 North, Range 67 West of the 6th P.M.: Some or all of section 5.

ORDER RE: BOND, HEARING DATE, AND PUBLICATION
THIS MATTER came before the Court on June 13 , 2018, on the Petition for
Inclusion of Lands into the Municipal Subdistrict, Northern Colorado Water Conservancy
District ("Subdistrict") filed by the Town of Frederick. The Court, having reviewed the Petition,
hereby Orders that:
1. The Town of Frederick post a bond in the amount of $ 2,500.00
2. A hearing shall be held on the petition at the Weld County Courthouse, Greeley,
Colorado, at 8:30 a.m., on August 22 , 2018.
3. The Clerk of the Court shall cause notice by publication to be made of the pendency of
the petition and the time and place of the hearing using the form provided by, and at the expense
of, the Town of Frederick. Such publication shall be published once a week for three consecutive
weeks in Weld County, as required section 37-45-103(9), C.R.S.
4. The Clerk of the Court shall send a copy of the notice of publication by registered mail to
the Weld County Board of County Commissioners.
