HomeMy WebLinkAbout750385.tiff RESOLUTION RE: AGREEMENT BETWEEN WELD COUNTY AND THE TRI-TOWN AREA ( COMPRISING THE TOWNS OF DACONO, FREDERICK, FIRESTONE AND THE UNINCORPORATED TOWN OF EVANSTON,) PROVIDING PLANNING SERVICES TO THE TRI-TOWN AREA. WHEREAS, Weld County has planning services available to assist cities and towns within the County, and WHEREAS, the TRI-TOWN AREA comprised of the Towns of Dacono, Frederick, Firestone and the unincorporated Town of Evanston, all in Weld County, Colorado, wish to avail themselves of such planning services, and WHEREAS, the County of Weld and the Tri-Town Area comprised of the Towns of Dacono, Frederick, Firestone and the unincorporated Town of Evanston, all in Weld County, Colorado, are desirous of entering into a contract whereby the County will provide planning services to said Tri-Town Area, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, believes it to be in the best interests of the County to enter into such an agreement on the basis recited therein. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the agreement between Weld County, Colorado, and the TRI-TOWN AREA (comprising the Towns of Dacono, Frederick, Firestone and the unincorporated Town of Evanston,) all in Weld County, Colorado, copy of which is attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be, and it hereby is, authorized to execute the agreement as submitted and to make the same effective as indicated in the agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the3rd day of September, A.D. , 1975, nunc pro tune as of June 25 , , 1975. D. , 1975, by and between WELD COUNTY, COLORADO, hereinafter referred to as the "COUNTY" and the towns of DA CONO, FREDRICK and FIRESTONE, and the unincorporated town of EVANSTON, all in WELD COUNTY, COLORADO, hereinafter referred to as the "TRI-TOWN AREA ", WITNESSETH: WHEREAS, Weld County, Colorado, has undertaken a program of conducting planning studies pursuant to its comprehensive plan for the future development of said COUNTY; and WHEREAS, Weld County has planning services available to assist cities and towns within the COUNTY; and WHEREAS, the TRI-TOWN AREA in Southwest Weld County, Colo- rado, has indicated the need to obtain professional planning assistance from the COUNTY; and WHEREAS, the COUNTY through its Planning Commission has expressed its willingness to provide consulting planning services to the TRI-TOWN AREA . NOW, THEREFORE, in consideration of the ,foregoing and of the mutual covenants and agreements hereinafter set forth, the parties hereto legally intending to be bound herby, do covenant and agree for themselves and their respective successors and assigns as follows: 1. The COUNTY agrees to provide planning services to the TRI- TOWN AREA, using the staff and time of the Weld County Planning Depart- ment. 2. The COUNTY agrees to provide a planner to assist the TRI-TOWN AREA in surveying and analyzing local needs for public or community facilities. The COUNTY agrees that the planner will meet with the TRI-TOWN AREA (including the TRI-TOWN AREA regional planning committee) and/or town officials as may be required in the conduct of this work. 3. The COUNTY further agrees that COUNTY planner will pro- vide consulting assistance to the TRI-TOWN AREA in improving ad- ministration and application of existing zoning requirements within the TRI-TOWN AREA. Specifically, the COUNTY planner will review existing zoning regulations and help establish an informal set of per- formance guide lines that will clarify their intent and aid in their under- standing and administration. 4. It is mutually agreed that the COUNTY planner shall spend reasonable time as necessary on the following items: (a) Zoning review, including field checks of proposed sites, and written reports of findings and recommendations. (b) Subdivision review with respect to lot size, street widths, street locations and items generally relating to zoning requirements. (c) Reviewing and rewriting outdated regulations and procedures. (d) Drafting zoning changes on official TRI-TOWN AREA map. (e) Attendance at each monthly TRI-TOWN AREA meeting and/or each monthly meeting of the TRI-TOWN AREA regional planning committee as may be designated; attendance at other meetings and meeting places are to be mutually agreed upon on an ad hoc basis. 5. The TRI-TOWN AREA agrees to pay to the COUNTY for the hereinabove stipulated and described services the sum of $5.00 per hour not to exceed $450.00 per year for the period hereinafter set forth. 6. It is mutually agreed that facilities and materials used shall be —2- paid for on an actual cost basis. 7. It is mutually agreed that any substantial changes in the scope of services of COUNTY planner to be performed hereunder, including any increase or decrease in the cost for such services, shall be incor- porated in written amendments to this agreement. 8. It is further mutually agreed that this contract shall be for a period of 12 months, from .iuly , 1975, to July , 1976, and for nn additional periods thereafter unless sooner terminated upon thirty (30) days written notice by either party to the other. TOWN_ OF FIRESTONE, COLORADO Chairman of the Weld County ayor Planning Commission TOWN OF FREDRICK, COLORADO BY Ail A ,Fyl ayor TOWN OF DACONO, COLORADO BYtra(/ Mayor EVANSTON, WELD COUNTY, COLORADO -3- JOINT RESOLUTION WHEREAS, the Towns of Dacono, Frederick and Firestone respec- tively, including the unincorporated area known as Evanston, all located in southwest Weld County, Colorado, hereinafter referred to as the Tri-Town Area, have long been concerned with entering into a joint and mutual effort providing for planning services (including adoption of a comprehensive plan) in and around said Tri Town Area, and WHEREAS, the Tri-Town Area has heretofore studied the need for such planning services and a comprehensive plan in and around said Tri- Town Area, and WHEREAS, the Tri-Town Area recognizes that the need for such planning services and comprehensive plan will require public participation in said area, and WHEREAS, the Tri-Town Area is willing to support whatever plan- ning services are necessary to the degree in which public efforts and funds of all of the Tri-Town Area shall become available and justified, and WHEREAS, it will be in the best interests of the Tri-Town Area to participate in such a joint and mutual endeavor. NOW, THEREFORE, BE IT RESOLVF.n, that there is hereby created the Tri-Town Area Regional Planning Committee. The duties of said Com- mittee shall be to act as an advisory body to the participating towns of Dacono, Firestone and Frederick, and the unincorporated area of Evanston, all in Weld County, Colorado. Pursuant to the best principals therefor, said Tri- -Town Area Regional Planning Committee shall provide for the organization and administration of the Committee to advise the participating bodies as to the location and intensity of land uses in the Tri-Town Area, and to recommend proper zoning to insure controlled and orderly development of land and land uses in conformity with the comprehensive plan of the County and the Tri- TownArea. BE IT FURTHER RESOLVED that said Tri-Town Area Regional Plan- ning Committee shall consist of eight (8) members, and the term of said members shall be overlapping. The terms shall start as of the time of the first appointments and all appointees shall serve on a calendar year basis. From the first appointees, the said Committee shall determine whom of its first members shall serve two (2) years, and whom shall serve four (4) years. After the first eight (8) members are appointed, -all appointments • shall be for a term of four (4) years. The eight (8) members of the Committee shall be comprised as follows: 1. Two (2) members shall be from the Town of Dacono. One (1) of such members shall be an elected official serving during his term of office; the other member may be a lay person. 2. Two (2) members shall be from the Town of Frederick. One (1) of such members shall be an elected official serving during his term of office; the other member may be a lay person. 3. Two (2) members shall be from the Town of Firestone. One (1) of such members shall be an elected official serving during his term of office; the other member may be a lay person. -4. Two (2) members shall be from the unincorporated area of Evanston Addition, Weld County, Colorado. They shall be elected by a written ballot from names submitted by interested residents. Fifteen (15) days before an election, a notice shall be placed in a local newspaper asking for applications to be -submitted to the Com- mittee. The names receiving the highest number of votes shall serve as representatives for that area. Inasmuch as Evanston Addition being without Counsel or other governing body, consideration for removal from office for cause must be presented by a written petition by the majority of the citizens of that area. 5. Vacancies occurring on the Tri-Town Area Regional Planning Committee from time to time shall be filled in the same manner as -2- is provided for in the original designation. BE IT FURTHER RESOLVED, -that members of said Committee may be removed from office only for cause. BE IT FURTHER RESOLVED, -that the Committee -shall report on or before the first day of each and every month in de-tail to the Tri-Town Area members, and more frequently or atsu-chtimes a-s it shall be directed from time to time. BE TT FURTHER RESOLVED, that said Committee shall l y August 1st of each year submit a proposed annual budget-for the following calendar year to the Tri-Town Area -members, which budget may be approved, modified ar rejected, _participation shall be upon a mutually agreed basis between the Tri-Town Area members. -Said Committee shall have no power to expend funds other than those budgeted and approved by the-Tri-Town Area members except with the expressed permission of the Tri-Town Area members, and such shall be the case regardless of the source from which funds shall have been received. BL IT FURTHER RESOLVED, -that consistent herewith, said Committee, with the approval of the Tri-Town Area members, shall prepare By-Laws for its own government and for selection of its own officers.
