HEARING CERTIFICATION DOCKET NO. 2018-132 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0090, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES INCLUDING OIL AND GAS SUPPORT AND SERVICE (16 GAS COMPRESSORS AND RELATED EQUIPMENT) A PERMANENT LAYDOWN AND STORAGE YARD, AND UP TO FIVE (5) CONSTRUCTION OFFICE TRAILERS AND FIVE (5) CONEX CONTAINERS FOR USE DURING THE CONSTRUCTION OF THE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - COALBANK INVESTMENT PARTNERS, LLC, C/O RIMROCK ENERGY PARTNERS, LLC A public hearing was conducted on December 12, 2018, at 10:00 a.m., with the following present: Commissioner Steve Moreno, Chair Commissioner Barbara Kirkmeyer, Pro-Tern Commissioner Sean P. Conway Commissioner Julie A. Cozad Commissioner Mike Freeman - RECUSED Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Frank Haug Planning Services Department representative, Kim Ogle Public Works Engineer representative, Mike McRoberts Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated October 26, 2018, and duly published October 31, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Coalbank Investment Partners, LLC, c/o RimRock Energy Partners, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0090, for Mineral Resource Development Facilities including Oil and Gas Support and Service (16 gas compressors and related equipment) a permanent laydown and storage yard, and up to five (5) construction office trailers and five (5) conex containers for use during the construction of the facility in the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of record. Commissioner Freeman stated for the record, he has no financial interest in the proposed property, nor any financial interests with Coalbank Investment Partners, LLC, or RimRock Energy Partners, LLC; however, he indicated there was recently an approved pipeline that goes through his property and to the proposed facility. Therefore, he recused himself to ensure there is no appearance of impropriety or any conflict of interest. 0 Chair Moreno reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four(4) Commissioners being present and Commissioner Freeman recused. PWCUYIm), £Hc,F) 2018-3904 oa/ ts/ 19 PL2612 HEARING CERTIFICATION - COALBANK INVESTMENT PARTNERS, LLC, C/O RIMROCK ENERGY PARTNERS, LLC (USR18-0090) PAGE 2 Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated the approximate 120-acre parcel created by Record Exemption, RECX17-0012, is located east of and adjacent to County Road (CR) 27, and south of and adjacent to CR 84. He indicated the site is located within the three (3) mile referral area of the Towns of Severance and Ault. Mr. Ogle mentioned there are eight (8) property owners on 17 parcels located within 500 feet of the proposed facility, indicated Planning Staff spoke with one (1) surrounding property owner (SPO) regarding this case and stated no other correspondence was received. He described surrounding USRs, and stated the applicants are in the process of expanding operations in Weld County, which will include one (1) gas processing plant, compressors, and pipelines, however; this application only addressed the Severance compressor station. Mr. Ogle stated the unmanned facility will be located on the southeast quadrant on an approximately 15-acre fenced area, within the 120-acre parcel. He explained the facility will compress raw, low-pressure, natural gas that will be transported to a downstream facility for further processing. He further described the facility's uses and stated condensate liquids will be pumped off the site through a pressurized pipeline for further processing and sale. He stated the applicant held a community meeting July 24, 2018, at the Ault Fire station, invitations were sent to all property owners within 1,000 feet of the parcel area, and two (2) individuals attended the meeting who expressed concern regarding the access being in a low spot through the Coalbank floodplain. To mitigate the concerns, the applicant explained they will apply for Flood Hazard Development Permit through Weld County for a new proposed access point. Mr. Ogle stated the applicant has met with the ditch companies about the project, addressed their immediate concerns. He described the proposed lighting on the site, and indicated a Landscaping/Screening Plan and Visual Mitigation Plan was submitted for review and approval. Mr. Ogle stated 20 referral agencies have reviewed the application and four(4) offered comments, some with specific conditions that were addressed through the staff recommendation. He presented images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. In response to Commissioner Conway regarding the Screening Plan, Mr. Ogle clarified it was completed in consultation with the SPOs. Mike McRoberts, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, and stated access for the site will be on County Road (CR) 27. He indicated there were no traffic counts available in the vicinity of the project; however, in accordance with the applicant's traffic narrative, Mr. McRoberts was able to provide the number of vehicle trips per day during and after construction. He stated tracking control and a Road Maintenance Agreement are required during construction, and a Final Drainage Report and Certification of Compliance stamped and signed by a professional engineer in the State of Colorado is required prior to recording the USR map. He also mentioned a Weld County Grading Permit will be required if more than one (1) acre is disturbed during construction. Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated there will be no permanent employees on the site once construction is complete. Mr. Frissell stated Development Standards (DS) #16-31 address Environmental Health items. Anne Best Johnson, Tetra Tech, represented the applicant and explained Coalbank Investments is a subsidiary of RimRock. She provided the history of RimRock in Weld County and mentioned various office locations to include an office in Pierce, Colorado. She briefly discussed the site location strategy and presented the natural gas supply chain. She referenced a map shown on the presentation (Exhibit D), which displayed the pipeline approved by Weld County, the compressor station approved by Pierce and the proposed compressor station. Ms. Best Johnson stated RimRock understands the importance of collaboration, and mentioned a community meeting was held on July 24, 2018. She indicated noise studies were completed prior to submitting the application and mitigation measures were taken to ensure the facility would meet the Residential noise standards. She reviewed visual studies completed during the application and referral process and indicated a Landscape Mitigation Plan has been approved by staff. Ms. Best Johnson stated the internal access road was designed to be consistent with Weld County's Department of Public Works and the standards from the Flood Hazard Development Permits. She reiterated there are USRs in the vicinity and introduced other Tetra Tech staff present. • Craig Whitnack, Director of Engineering for RimRock Energy Partners, LLC, described the construction of the facility and displayed drawings of the facility at full buildout. He showed the maintenance and operation staff access route from CR 27, and reiterated the facility will be unmanned. He clarified there will be one (1) to three (3) maintenance stops daily on average and described the functions of the compressor station. Mr. Whitnack stated there will be no storage of condensate at the facility. Ms. Best Johnson explained the haul route from CR 27 to the south and then west or east on Highway 14. She indicated the site is constrained by a floodplain which she displayed on her presentation. She explained the placement of trees for visual mitigation, and provided visual simulations of the site and adjacent views. • Andrew Truitt, Senior Engineer, Behrens and Associates, Inc., provided a summary of the compressor station and explained an overview of the noise mitigation efforts. He summarized the sound data gathered from four (4) measurement locations, he displayed the Ambient Sound Measurement Results and indicated the results were less than the residential noise standard. Mr. Truitt mentioned Phase One (1) and Phase Two (2) of the facility buildout will remain less than the residential noise standard and displayed contour maps to display the noise modeling results. He provided various noise mitigation scenarios and explained how distance was used to mitigate noise from the surrounding areas, which lead to the facility shifting and adding additional equipment to meet the noise standards. • Mr. Whitnack stated RimRock has engineered and designed the facility to be safe and a good neighbor. He reviewed the facility safety precautions, and indicated they had met with the Office of Emergency Management and the Ault/Pierce Fire Protection District. He briefly described the financial impact of the facility, the overall investment in Weld County, including the pipeline and Pierce processing plant, and provided examples of RimRock involvment in the Weld County community. el Ms. Best Johnson stated Planning staff and the Planning Commission recommended approval of the case and displayed the criteria the application must meet. She reviewed the Road Maintenance Agreement, Final Drainage Report, Certificate of Compliance and Lighting Plan that were submitted after the Planning Commission hearing. In response to Commissioner Conway, Ms. Best Johnson stated the Lighting Plan is in accordance with the Dark Sky Policy. • In response to Commissioner Conway, Bill Garcia, Attorney with Coan, Payton and Payne, LLC, explained correspondence between him and Dennis Harmon, General Manager of Water Supply and Storage Company (Exhibit E), to which Mr. Harmon indicated he had received the information with no further comments. In response to Commissioner Conway, Mr. Ogle clarified no phone calls or letters had been received by planning staff from Mr. Harmon. After further discussion, Mr. Garcia clarified to his knowledge there are no outstanding issues with the Water Supply and Storage Company. El No public testimony was offered concerning this matter. • In response to Chair Moreno, Ms. Best Johnson indicated the applicants have reviewed the Conditions of Approval and Development Standards, as presented and she thanked staff. In response to Commissioner Kirkmeyer, Mr. Ogle confirmed a Landscaping and Screening Plan has been submitted. Ms. Best Johnson clarified the Landscaping and Screening Plan was submitted and approved prior to Planning Commission and, therefore, is not included in the Conditions of Approval (COA). Commissioner Kirkmeyer suggested adding in a condition to include the landscaping and screening plan as a new COA#1.D and requested clarification on a Development Standard (DS) that includes an Emergency Action Plan. In response to Commissioner Kirkmeyer, Mr. Ogle stated the DS would need to be added and Commissioner Kirkmeyer suggested it be a new DS #6. She further recommended a new DS #7 regarding the Lighting Plan, suggested adding "During the construction period"to DS #8, and recommended deleting DS #9, to which the Board agreed. The motion was seconded by Commissioner Cozad, and it carried unanimously.
