WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that a certain tract of land, being the
property of EPH Corporation (c/o Ed Haefeli, President) and more particularly
described as follows, to-wit:
The West Half (WZ) of Section 21, Township 5 North, Range 67
West of the 6th P. M. , Weld County, Colorado, being more
particularly described as follows:
Beginning at the Southwest Corner(SWCor) of said Section 21, and
considering the South Line of the Southwest Quarter (SW4) of said
Section 21, as bearing North 90°00'00" East, with all other bear-
ings contained herein relative thereto; thence North 90°00'00"
East, along the South Line of said Southwest Quarter (SW4),
2698. 06 feet to the South Quarter Corner (S4 Cor) of said Section
21; thence North 00°03'44" East, along the East Line of the West
Half (WZ) of said Section 21, 5297. 77 feet to the North Quarter
Corner (N4 Cor) of said Section 21; thence North 89°51'42" West,
along the North Line of the Northwest Quarter (NW4) of said
Section 21, 2646. 22 feet to the Northwest Corner (NW Cor) of
said Section 21; thence South 00°33'56" West, along the West
Line of the Northwest Quarter (NW4) of said Section 21, 2689. 55
feet; thence South 00°40'44" West, along the West line of the South-
west Quarter (SW4) of said Section 21, 2614. 92 feet to the South-
west Corner (SW Cor) of said Section 21, said point being the
Point of Beginning; said described parcel of land containing
325. 019 acres, more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission,
and having been fully informed, now desires to exempt this particular
division of land pursuant to its authority under CRS 106-2-33 (d), 1963,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by EPH Corporation (c/o Ed Haefeli, President)
be exempted from the definition of the terms "subdivision" and "subdivided
land" as provided for in the new Weld County Subdivision Regulations at
Section 2-1,A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 23rd day of April, A. D. , 1975.

Dear Sirs :
The attached application, plat and other items are in reference to
a request, by EPH Corporation (% Ed Haefeli , President) for a Recorded
Exemption. The parcel in question contains approximately 325 acres and
the desire is to split approximately 40 acres from the property.
Based on the information submitted and Weld County Regulations, the
Planning staff recommends approval for the following reasons:
1 . Complies with the intent clause, Section 9-2, of the Weld County
Subdivision Regulations for Recorded Exemption insofar as the
use would be on non-productive ground and would be a compatible
use.
2. Conforms with the Weld County Comprehensive Plan inasmuch as it
promotes agricultural use and the parcel being split is partially
non-productive.
3. All requirements for submission have been met.
