A public hearing was conducted on May 30, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 24, 2018, and duly published April 27,
2018, in the Greeley Tribune, a public hearing was conducted to consider the request of HighPoint
Resources Corporation, for a Site Specific Development Plan and Major Amended Use by Special
Review Permit, 1MJUSR18-15-0078, for Mineral Resource Development, including Oil and Gas
Support and Service (storage of tanks, vessels, pipe racks, other oil and gas production
equipment and more than two (2) cargo containers as accessory structures) to also include a
Natural Gas Compressor Station (with up to four (4) natural gas -powered compressors, storage
buildings, tanks, production equipment, meters, fencing and outdoor lighting) in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
Chair Moreno reviewed, for the applicant and the public, the procedures to follow should this
case result in a tie vote due to four Commissioners being present and Commissioner Cozad
excused.
El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
described the site location in relation to relevant County roads and as a site created by the
Recorded Exemption process. He stated the site is not located in the three (3) mile referral area

of any municipality and staff received no correspondence regarding the application. He described
the adjacent lands, nearest residences, and the surrounding USRs to include NGL's Brinewater
Facility, which is adjacent. Mr. Ogle stated the applicant's desire to expand operations in Weld
County to include adding compressors and interconnecting pipelines. He reviewed the current
application for the construction of a new compressor station and clarified the storage yard
associated with this compressor station is adjacent. He stated staff sent out nine (9) referrals and
received four (4) responses with comments that have been considered in the staff
recommendation. Mr. Ogle displayed images of the site and surrounding views and entered the
favorable recommendation of the Planning Commission into the record as written. In response to
Commissioner Kirkmeyer, Mr. Ogle stated there is no screening due to the rural location.
Evan Pinkham, Department of Public Works representative, provided a brief overview of the
transportation plans, drainage and grading requirements. He stated an Access Permit was issued
last year, AP#17-00668, which stipulated to utilize the new access on County Road (CR) 52 and
to close and reclaim any other access points. He provided the average daily traffic counts and
truck percentages and reviewed the traffic narrative stating, during construction, there will be
approximately 20 work truck or delivery truck daily round trips, 20 semi -truck and trailer daily
round trips, and 20 gravel truck daily round trips and after construction is completed, there will be
two (2) passenger vehicle daily round trips. He requested tracking control and an Improvements
Agreement for road maintenance be required during construction. Regarding drainage, he stated
a final detention pond design and drainage report need to be submitted and a Grading Permit will
be required if disturbing more than an acre. In response to Commissioner Conway, Mr. Pinkham
clarified options for tracking control from gravel to gravel. In response to Commissioner Freeman,
Mr. Pinkham stated the Improvements Agreement is only required for the construction phase.
• Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions stating bottled water and portable toilets are acceptable. She stated an Air Permit will
be required and the noise level was changed at Planning Commission from Residential to Light
Industrial because the nearest residence is over a mile away. Ms. Light reported Development
Standards (DS) #9-24 as typical Environmental Health items.
• Doug Dennison, applicant, stated he does not have anything to add to the presentation and
is available for questions.

• In response to Chair Moreno, Mr. Dennison clarified that he is not proposing any landscaping
or screening and requested the Board review Condition of Approval (COA) #1.C.4 and DS #7.
The Board agreed to delete these items. In response to Commissioner Conway, Mr. Dennison
agreed to the Improvements Agreement during construction. The Board added the stipulation of
"during construction" to COA #1.A. Commissioner Kirkmeyer corrected the reference to the
Colorado Revised Statutes and the Board agreed to the amendments to DS #9, 10, and 14.
Commissioner Kirkmeyer suggested the deletion of "light" on DS #14 amending the noise limit to
the Industrial Zone. The Board agreed.

In response to Chair Moreno, Mr. Dennison indicated he has reviewed, and agrees to abide
by, the Conditions of Approval and Development Standards, as amended.
Commissioner Freeman moved to approve the request of HighPoint Resource Corporation,
for a Site Specific Development Plan and Major Amended Use by Special Review Permit,
1 MJUSRI8-15-0078, for Mineral Resource Development, including Oil and Gas Support and
Service (storage of tanks, vessels, pipe racks, other oil and gas production equipment and more
than two (2) cargo containers as accessory structures) to also include a Natural Gas Compressor
Station (with up to four (4) natural gas -powered compressors, storage buildings, tanks, production
equipment, meters, fencing and outdoor lighting) in the A (Agricultural) Zone District, based on
the recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Conway, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:23 a.m.
This Certification was approved on the 4th day of June, 2018.
