RESOLUTION RE: APPROVE PARTIAL RELEASE AND ACCEPTANCE OF NEW COLLATERAL FOR CHANGE OF ZONE, PUDZ16-0001 - GANDER VALLEY FARMS, LTD. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated July 6, 2016, the Board approved the application of Gander Valley Farms, LTD., 8897 Gander Valley Lane, Windsor, CO 80550-2621, for a Change of Zone, PUDZ16-0001, to Rezone Lot 5 of Gander Valley PUD from Planned Unit Development with A (Agricultural) Zone District Uses to Planned Unit Development with E (Estate) Zone District Uses, along with 6.09 acres of open space, on the following described real estate, to wit: Lot 5 of Gander Valley PUD; being part of Section 4, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on May 22, 2017, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements for Gander Valley Farms, LTD., between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Gander Valley Farms, LTD., with terms and conditions being as stated in said agreement, and accepted Irrevocable Letter of Credit #90928, drawn on the Advantage Bank, 1801 59th Avenue, Greeley, CO 80634, in the amount of $260,960.30, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a site inspection and found that the improvements required, per Exhibit A of the Improvements Agreement, have been completed and found acceptable, except signage, landscaping, and a grass -lined swale, with the remaining work to be done costing $11,800.00, and the 15 percent warranty collateral amounting to $39,144.05, thereby requiring the acceptance of $50,944.05 in remaining collateral, and WHEREAS, staff from Weld County Department of Public Works and Planning Services recommend a partial release of said collateral, and acceptance of a replacement Letter of Credit for the remainder of the required collateral, and WHEREAS, upon recommendation of staff, the Board deems it advisable to release said collateral and accept replacement collateral, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Letter of Credit #90928, drawn on the Advantage Bank, 1801 59th Avenue, Greeley, CO 80634, in the amount of $260,960.30 be, and hereby is, reduced and partially released, and a replacement Irrevocable Letter of Credit #90928, drawn on the Advantage Bank, 1801 59th Avenue, Greeley, CO 80634, in the reduced amount of $50,944.05, be and hereby is accepted. 4386892 Pages: 1 of 2 03/30/2018 10:25 AM R Fee:$0.00 Carly Koppes, Clerk and Recorder, Weld County, CO VIII PirdnlirlillrgriliAll LUAU 11 III c.c: PWC£.P), CcicFH-+), c-TS(Ec'i YT), Scot+ Pre se 'dort, Or 6�se '1 /Co/ l8' 2018-0818 PL1165 PARTIAL RELEASE AND ACCEPT REDUCED REPLACEMENT COLLATERAL - GANDER VALLEY FARMS, LTD. The collateral being accepted is for warranty collateral, and items that have not been completed on the site. The items that have not been completed on the site are seeding, landscaping, and installation of the main sign. Weld County Public Works and Planning Department performed a site inspection, at the above -mentioned site, and observed the following: • With exception of the items listed above, all items on Exhibit A, of the Improvements Agreement According to Policy Regarding Collateral for Improvements Document #2017-1578, have been completed and are found to be acceptable. Frank Haug/Assistant County Attorney has reviewed the Improvements Agreement and Collateral requirements and recommends this partial release of collateral. What options exist for the Board? 1.
