From our property we can see several large piles of brush which serve as an eyesore , a fire hazard , and quarters for various pests . Our concern , in allowing a landscaping firm to take over the property, is that it could further enhance the chances of these piles multiplying and/or growing larger. Prior to any approval of this plan , we would ask that the property be brought up to code . All of the current piles of boards , vegetation and other landscaping - related materials need to be removed from the property and disposed of properly. Periodic inspections by Weld County should then be conducted to prevent repeat violations. You have a chance to see this property cleaned up and then maintained as it should be. Please do not allow this opportunity to pass without proper action . As instructed, I went to he web site shown on the card . The " httris ://accela- aca . co . weld . co . usicitizensaccessi" with or without the case number did not work. It gave an error message. I went to search for the case another way and was able to find it. Not sure others would make the effort so you may not get much response from others to the card when the site address given doesn 't work. . While a new resident in the area, it was surprising to read that the applicant appeared to be the only person in charge of sending notices for the public hearing and that no one from the county attended; just Mr_ Sekerak and one person described as a neighbor were in attendance. That's interesting by itself as Mr. Sekerak isn 't even the party identified as the applicant on the web site . It shows Steve and Carle Winter as the applicant . However, Mr. Sekerak has the most to gain by the approval of the application , this brings to question to what degree anyone from the county really knows if 50 invitations to the meeting were really sent . The minutes of the meeting (which was to be on 3-10 but says there were two - one on 3-9 and one on 3- 10) indicate only one person showed up . Which of the two nights did the person show up ? the first night shows a 23 minute time period and the actual night referenced on the invite was a ten minute meeting. With Mr. Sekerak being the only one being present and involved, and the one who stands to gain from the application approval, this is a bit like the fox guarding the hen house. Several of his application comments allude to the fact that nothing is needed since no one required it from the public hearing. (See notes on Planning Questions # 's 13 and 14; Engineering point #' s 6 and 10 for example . ) There are some other self-serving observations made by Mr. Sekerak also: • This is deemed beneficial to the city and county. But not really specified as why other than some residents or the government entities may be receiving services so that makes kt beneficial? • On point three it is noted that this rezoning allows an income stream to the Winters who own the property. Actually, they already have been getting one for three years. If the family sold the property now used for the development of Winter Farms, it is doubtful they really need any other income stream (unless those proceeds were poorly invested . ) • comments say that there is no problem with sound or sight since it is 450 feet from the nearest home . The map shows a 143 feet distance from the planned usage site to the edge of the property. However, hat is not from the closest edge; the property is irregularly shaped and the 143 feet length offered is not the closest mark. While the current closest home may be 450 feet, there are new homes being built on the north side of Boxwood that will be much closer and will look at the planned business piles of mulch, limbs, wood, etc. along with vehicles that will be almost directly behind some of the homes. It would seem appropriate to revise the application with more accurate distances and with consideration to the new home owners and not only to the current ones at the time of the application in the January to March time frame . ( On this note, it is appreciated that the county sent the postcard about this proposal to solicit comments. ) • No sewer on the property? Employees are supposed to hold their body functions until off the property or use the " emergency" port a pot? Never heard of this type of arrangement for a business that operates 8: 00 AM to 5 : 00 PM weekdays. Any other business allowed to do that? What prevents workers from urinating behind the shed ? Again , this seems like a twisted observation or conclusion by Mr. Sekerak that nothing is needed . • Same is true for noise: he feels the noise will be minimal - from chain saws, grinders, compressors and loading/unloading equipment . As a basement was dug nearby and equipment being loaded and unloaded on trucks as it is delivered and taken away, I can hear the Beeping of the trucks and equipment in my home with the doors and windows closed in a side room . This hardly seems like a studied , objective assessment was made . • The business - if the proposal is approved - may be expanded beyond what its ' current size and use is . therefore, the activity, noise, views may change. To say nothing is needed because no one mentioned it at a meeting seems unlikely. Has anyone from the city or county gone to the property as workers are arriving in the AM and leaving in the PM to see how the traffic flow, noise and other actions line up with this description by the applicant ? • No dust from piles of mulch, wood , compost or from wood -cutting, mulch and compost mixing, loading and unloading ? Seems unrealistic. Additionally, Mr. Sekerak seems to have overlooked the delivery to the property of mulch or other landscape materials that are not made naturally on the property. Those deliveries are not covered in the comments. In other places we've lived , large trucks ( dump or semi type ) do the deliveries, more noise . more dust_ • There appears to be no size or time limit to the piles of compost, limbs, mulch, wood, debris, etc. proposed or required . While perhaps not an issue yet, that may not be the case if there are no limits set in the approval process. M Generally speaking, I don 't think it is necessarily harmful for there to be a business at the Winter farm if property controlled and regulated . Yet there are no references made anywhere to what limitations or restrictions may be placed on this business. Mr. Sekerak and well as the Winter family both stand to gain from this proposal . For them to be the only parties making judgments or comments in absence of any responses from the country and city seems unusual and risky. I would respectfully ask that there be more involvement by the authorities and more observation of the operation from the various viewpoints mentioned before approving this as proposed . Also, project forward a few years to what may occur as more homes are built . the business may grow and yet the use variance will remain as is . Will that still be fine with the neighbors?
