HomeMy WebLinkAbout20182094.tiffHEARING CERTIFICATION DOCKET NO. 2018-60 RE A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0024, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY 1,700 FEET LONG (16 -INCH NATURAL GAS PIPELINE), A LESS THAN 30 -FOOT IN HEIGHT COMMUNICATION TOWER AND METER SITE APPURTENANCES IN THE A (AGRICULTURAL) ZONE DISTRICT - DYANNA GODFREY, NANCY KNAUF AND ELDON KNAUF, C/O DISCOVERY DJ SERVICES, LLC A public hearing was conducted on July 11, 2018, at 10 00 a m , with the following present Commissioner Steve Moreno, Chair- EXCUSED Commissioner Barbara Kirkmeyer, Pro -Tern Commissioner Sean P Conway- EXCUSED Commissioner Julie A Cozad Commissioner Mike Freeman Also present Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Frank Haug Planning Services Department representative, Kim Ogle Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light Thhee following business was transacted I hereby certify that pursuant to a notice dated May 30, 2018, and duly published June 4, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request of Dyanna Godfrey, Nancy Knauf and Eldon Knauf, c/o Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0024, for a greater than 12 -inch high pressure natural gas pipeline approximately 1,700 feet long (16 -inch natural gas pipeline), a less than 30 -foot in height Communication Tower and Meter Site appurtenances in the A (Agricultural) Zone District Frank Haug, Assistant County Attorney, made this a matter of record Chair Pro-Tem Kirkmeyer instructed the applicant and reviewed for the public, with two (2) of the five (5) Commissioners being excused, the vote must be unanimous for the case to be approved today The applicant acknowledged the advisement and the hearing proceeded Kim Ogle, Department of Planning Services, presented a brief summary of the proposal to construct and operate a natural gas pipeline that will connect the Fort Lupton gas plants to the Kinder Morgan interconnect pipeline He explained the pipeline will be constructed within an 80 -foot temporary easement and disturb 3 12 acres, and once the pipeline has been installed, it will be reclaimed to the permanent easement, with surface equipment to include a receiver, gas meter and flow control valve He stated the meter station site will be 2 5 acres, as noted in Subdivision Exemption, SUBX18-0006, and will include the meter station and associated e.= Pc. Noe) , emu.) r.R►ie._ !JO 2018-2094 PL2559 HEARING CERTIFICATION - DYANNA GODFREY, NANCY KNAUF AND ELDON KNAUF, C/O DISCOVERY DJ SERVICES, LLC (USR18-0024) PAGE 2 encumbrances Mr Ogle indicated the pipeline is located within the three (3) mile referral area of the Town of Lochbuie, and the Cities of Brighton and Fort Lupton and he reviewed the referral responses from these municipalities He described surrounding land uses and stated History Colorado or Colorado Parks and Wildlife (CPAW) expressed no concerns Mr Ogle explained transportation of natural gas by pipeline is safer, and he reviewed emergency notification procedures, maintenance and inspections He stated an Emergency Action and Safely Plan with the Office of Emergency Management and the local Fire District is required prior to operation and the entire length of the proposed pipeline will be designed as instructed by the Department of Transportation Mr Ogle indicated thirteen (13) referral agencies have reviewed the application, with three (3) responses that have been considered in the staff recommendation, and no letters were received from surrounding property owners Mr Ogle displayed the site map with the pipeline route and entered the favorable recommendation of the Planning Commission into the record as written ---! Hayley Balzano, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements located in relation to relevant County roads She stated the applicant needs to work with Public Works to ensure the access points meet spacing requirements Ms Balzano reviewed the roadway crossings, average daily traffic counts to include truck percentages and stated post -construction there would be a maximum of one (1) passenger vehicle daily round trip and intermittent truck round trips to the meter site She indicated that tracking control may be needed at access points during construction Ms Balzano mentioned that Public Works is requiring a Road Maintenance agreement during construction She stated the metering site will require a final Drainage Report and the pipeline is excepted from drainage requirements Ms Balzano stated a Weld County Grading Permit will be required if disturbing more than an acre In response to Commissioner Cozad, Mr Balzano explained the access points must meet spacing, including those that are temporary, as well as the permanent access for the metering site fa Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating portable toilets can be used along the construction route, and the typical dust and waste items have been provided She explained the equipment at the meter site may require an Air Permit Ms Light stated Developmental Standards (DS) #13-22 address Environmental Health items Matt Norton represented the applicant and began with a PowerPoint presentation (Exhibit D) He provided an overview of the company and explained the expanding operations in Colorado Mr Norton discussed the strong track record of safety, the importance of having a safety -focused culture, compliance records, and financial funding He explained the proposed Prairie Dog, 16 - inch gas pipeline and meter site, showing the delivery points creating an option to go to a second carrier to send produced gas throughout other parts of the offload site He showed a map of the pipeline location in relation to their other facilities, pipelines, and the meter site and stated the 1,700 feet of pipeline will be built to Department of Transportation (DOT) standards Mr Norton reviewed safety measures incorporated into the design that are tested, inspected and monitored 24/7 by a control room He stated they utilize the "one -call" system and promote a culture of safety He reviewed their policies for environmental stewardship and the commitment to return their sites to a better condition than before Lastly, he reported on the importance of community 2018-2094 PL2559 HEARING CERTIFICATION - DYANNA GODFREY, NANCY KNAUF AND ELDON KNAUF, C/O DISCOVERY DJ SERVICES, LLC (USR18-0024) PAGE 3 involvement No public testimony was offered concerning this matter Commissioner Cozad proposed modifying Section 23-2-490 H in the findings to clarify the drainage report is required for the metering site only In response to Commissioner Cozad, the applicant clarified that all easements and the Access Permit have been obtained for the metering site 12 In response to Commissioner Cozad, Mr Ogle explained the applicant declined the invitation to annex into Fort Lupton Commissioner Cozad suggested deleting Condition of Approval (COA) #1 E, regarding annexation Chair Pro -Tern Kirkmeyer recommended deleting COA #1 F 15, regarding labeling parking and traffic circulation due to minimal traffic In response to Chair Pro - Tern Kirkmeyer, Mr Norton stated there will be an entrance gate for the meter site The Board agreed to all the changes In response to Chair Pro Tern Kirkmeyer, Mr Norton, indicated he and the applicants have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended IM Commissioner Cozad moved to approve the request of Dyanna Godfrey, Nancy Knauf and Eldon Knauf, do Discovery DJ Services, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0024, for a greater than 12 -inch high pressure natural gas pipeline approximately 1,700 feet long (16 -inch natural gas pipeline), a less than 30 -foot in height Communication Tower and Meter Site appurtenances in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record The motion was seconded by Commissioner Freeman, and it carried unanimously There being no further discussion, the hearing was completed at 10 24 a m 2018-2094 PL2559 HEARING CERTIFICATION - DYANNA GODFREY, NANCY KNAUF AND ELDON KNAUF, C/O DISCOVERY DJ SERVICES, LLC (USR18-0024) PAGE 4 This Certification was approved on the 16th day of July, 2018.
