RE: APPROVAL OF RECORDED EXEMPTION NO. 286 - THE EAST GREELEY
LAND COMPANY.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 31st day of October, 1977 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of TheEast Greeley Land
Company , located on Part of the W1 of Section 10 , Township 5
North, Range 66 West of the 6th P .M. , Weld County, Colorado,
and more particularly described as follows , to-wit:
The N4* of the NWQ of Section 10, Township 5 North, Range
66 West of the 6th P.M. , Weld County, Colorado; EXCEPT that part
thereof described in deed to Dept. of Highways, State of Colo. ,
recorded in Book 1450, Pg. 162, & EXCEPT that part thereof de-
scribed and containing 6.026 acres in deed to the City of Greeley,
recorded in Book 1634, Pg. 258. The SWa of the NW4 of Section 10,
Township 5 North, Range 66 West of the 6th P.M. , Weld County,
Colo. ; EXCEPT that part thereof described as containing 8.974
acres in deed to The City of Greeley, recorded in Book 1634,
Pg. 255. The SWa of Section 10, Township 5 North, Range 66
West of the 6th P.M. , Weld County, Colorado, including that
portion thereof platted as Four-M Scientific Sub. , 1st Filing,
a subdivision of Weld County, Colo. recorded in Book 610, Reception
No. 1532411, ; EXCEPT that part thereof described in deed to Greeley
Area Industrial and Business Development Foundation, Inc. ,
recorded under Reception No. 1517094, Book 595; and EXCEPT that
part thereof described in Deed to Aims Junior College District

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.

missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by The East Greeley Land Company,

(10) (d) .
The above and foregoing Resolution was, on motion duly made

RE: Recorded Exemption #286
Dear Commissioners :
The attached application, plat , and related materials are in reference to a
request by The East Greeley Land Company represented by Ernest B. Scott for
a recorded exemption. The parcel of land is described as Pt. of the W,4 of
Section 10, T5N, R66W of the 6th P.M. , Weld County, Colorado. Said property
is located at the northeast corner of the junction of 59th Avenue and 20th
Street and west of Aims Community College. The subject property contains
147. 7 acres of Class II , III , and IV irrigated soils and Class IV and VI
dryland soils. The request is to split the property into parcels of 5. 0
acres and 142. 7 acres. The 5 acre parcel is desired to he severed from the
remainder of the unimproved ground for the purpose of creating a separate
lot for the Greeley Family Sports Center development which received approval
from the Board of County Commissioners on July 13, 1977.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons :
1. The City of Greeley Planning Commission has indicated they have no objec-
tions to the approval of this recorded exemption request.
2. The request for the Greeley Family Sports Center development of the
separate 5 acre parcel agrees with the Weld County Comprehensive Plan
and the City of Greeley Comprehensive Plan.
3. The request complies with the provisions of Section 9-4(a) of the Weld
County Subdivision Regulations .

PARTNERSHIP AGREEMENT
_ OF
EAST GREELEY LAND CO.
THIS PARTNERSHIP AGREEMENT is made and entered into be-
tween the undersigned parties this 3c 6/ day of 'July, 1969.
The parties to this Agreement, in consideration of the mutual
covenants and agreements herein contained, do hereby agree as
follows :
1. There is formed a general partnership consisting of
the undersigned as partners.
2. The name of the partnership is : EAST GREELEY LAND CO. ,
a Partnership.
3. The location of the principal place of business of the
partnership shall be 1212 8th Avenue, Greeley, Colorado.
4. The business of the partnership shall be to hold legal
or registered title to the following described property:
Southwest Quarter and the West Half of the Northwest
Quarter, Section 10, except three parcels of land
previously conveyed to Greeley Area Industrial and
Business, City of Greeley and Aims Junior College
District, all in Township 5 North, Range 66 West of
the 6th P.M. and the West 290 + or - feet of the
Southeast Quarter, Section 3 and the Southwest Quarter
of Section 3, except approximately 22 acres described
as the parcel of land bounded on the south by U. S.
Highway 34, the west line of the Colorado Interstate
Gas easement, on the east and the north by the present
improvements;
and to encumber, lease, convey and deal with such property, as
nominee of East Greeley Land Joint Venture, as directed by the
East Greeley Land Joint Venture or its Agent.
S. The partnership shall begin on the date hereof and
is to continue until final disposition of the property or until
terminated by mutual agreement of the partners . In the event of
the death, incapacity or withdrawal of any partner, the remaining ,
partners shall ipso facto, without any further act, immediately
become a new partnership under the same partnership name, suc-
ceeding to all of the rights and property of the former existing
partnership and all the terms and provisions of this Agreement
thereupon will apply to and govern such new partnership. In any
case, all legal title to the partnership property and assets shall
ipso facto and without further act, vest in the remaining partners .
An amendment to this Agreement, signed by the partners who purport
to be a majority of the remaining partners, shall be conclusive,
and no person or entity need inquire as to their authority to act.
6. The partnership shall not have any capital.
7. The right to sign the firm name to assignments, deeds,
leases, conveyances, checks, savings withdrawals, affidavits,
agreements, interest orders, income tax returns, receipts, re-
leases, and all other documents which may be convenient or neces-
sary to the conduct of the partnership business, is vested in and
may be exercised by any member of the partnership acting alone.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement this day of July, 1969.

Dear Dick:
At the present time there appears to be adequate water and sewer utilities
in the vicinity of 59th Avenue and 20th Street to serve the parcels shown
on the attached map. The water utilities consist of a 12" line in 20th
Street and a 20" line which runs north through Section 10 approximately
1/8 of a mile east of 59th Avenue. The sewer utilities consist of a
Highland Hills sewer which runs north of 20th Street in the vicinity of
the water line which drops into a sewage lift station about 1/8 of a mile
north of 20th Street.

I haVe scheduled a meeting with the Board of County Commissioners for
October 31 , 1977 , at approximately 9 : 30 a.m. Said meeting will take place
in the County Commissioners Hearing Room, first floor, Weld County Centennial
Center, 915 10th Street , Greeley, Colroado. It is recommended that you
and/or a representative be there to answer any questions the Board might have
with respect to your application.
Additionally, it is the policy of Weld County to refer an application of
this nature to any municipality lying within three miles of the property in ;
question for their review and comment . Accordingly, our office will send a
copy of the materials to the City of Greeley for their comment . According
to our records, the City of Greeley Planning Commission will review and
comment upon this request at their meeting on October 25, 1977. Please
contact the City of Greeley Planning Department for further information
