Ii nm � nt Map EXHIBIT ,t transect 5 November 2 . 2018 Mr • Mr. Kim Ogle Weld County Planning Department 1555 N 17th Avenue Greeley , CO 80631 RE : Acknowledgement and Response to Weld County Planning Commission Comments regarding Clean Water Act Section 404 Permitting for the Pierce Project Weld County Case No. USR18-0080 Dear Mr. Ogle: On behalf of NWC Development (NWC) . Transect appreciates Weld County Planning Commission's consideration of the USR application for the Pierce Project in Weld County. Colorado. The purpose of this letter is to acknowledge the Planning Commission 's comments regarding lakes and ponds made at the hearing on October 16. 2018 and to provide additional information about NWC's avoidance and minimization practices and permitting responsibilities regarding waters of the U . S . The U . S . Army Corps of Engineers (USACE) is the regulatory agency that authorizes impacts to waterways and wetlands that are jurisdictional under Section 404 of the Clean Water Act (CWA) . Permitting or pre-construction authorization for impacts to waters of the U . S. may be required for a proposed project. depending on the amount of impact to waters of the U . S. and on the federal . state . and local regulatory requirements. A field assessment for waters of the U . S . in the permit area was conducted by a qualified biologist from June 4 to 7 . 2018 within a 150-foot buffer (300 feet total) around the project centerline. Waters of the U . S . assessed included rivers. streams. lakes, ponds, and wetlands. The jurisdictional boundary of potential waters of the U . S . was determined in accordance with the USACE definition of ordinary high water mark ( OHWM ) and other USACE standard elements of tributary field expression . Wetlands were delineated using the accepted methodologies from the 1987 USACE Wetland Delineation Manual . Temporary and permanent impacts to all identified waters of the U . S. that may occur as a result of the proposed project are authorized under USACE Nationwide Permit 12 for Utility Lines. Nationwide Permit 12 provides for the construction . maintenance . repair. and removal of utility lines and associated facilities in waters of the U . S . . provided that the activity does not result in the loss of greater than 0. 50 acre of waters of the U .S for each single and complete project location . For utility line activities that cross a single waterbody more than one time at separate and distant locations, or multiple waterbodies at separate and distant locations, each crossing is considered a single and complete project for the purposes of Nationwide Permit 12 . As no single and complete pipeline crossing impacts more than 0 . 50 acre of waters of the U . S . . Nationwide Permit 12 is appropriate for the project. Additionally, no single and complete water crossing triggers any of the preconstruction notification requirements listed in Nationwide Permit 12 or Colorado regional conditions, so preconstruction notification to the USACE is not warranted . Construction will adhere to all general and regional permit conditions. Transect LLC • 745 E. Mulberry St, Ste 205. San Antonio, TX 78212 • www.transect corn Regarding the cattail wetland at the intersection of County Road 72 and County Road 25. an assessment of the potential jurisdictional status of this feature was conducted as part of the waters of the U . S . survey for the project. The nearest linear waterway to the wetland is Roulard Lateral . which is a non-relatively permanent ( non-RPW) concrete-lined irrigation canal. The wetland is approximately 1 , 300 feet west of Roulard Lateral . and two waters are loosely physically connected by a faint roadside irrigation ditch . Wetlands that are adjacent to a non-RPW are only considered jurisdictional if: 1 . the non-RPW (here . Roulard Lateral ) flows directly or indirectly into a traditionally navigable water; 2 . the wetland has to be truly adjacent to the non-RPW; AND , 3. there is a "significant nexus" (i.e. physical, chemical , or biological connection) between the wetland and the non-RPW and between the non-RPW and a downstream traditionally navigable water. Based on review of aerial imagery and topographic maps, the indirect or direct flow connection between Roulard Lateral and a downstream traditionally navigable water (Cache la Poudre River) is suspect because no obvious downstream physical connection was detected . Water in Roulard Lateral flows from Eaton Ditch south/downslope for approximately 4 . 5 miles before terminating in agricultural fields. The adjacency of the wetland to Roulard Lateral is also questionable. The two features are approximately 1 . 300 feet apart. and while distance cannot be a determining factor in adjacency. the chemical and biological connection between the two features is likely insubstantial as there appears to be very low to no flow between the two features, and the lateral possess very low- quality biologic habitat. The cattail wetland is likely considered non-jurisdictional by the USACE . However. in an abundance of caution , NWC plans to bore underneath the wetland in order to avoid any dredge or fill (impacts) . In the absence of dredge or fill within the wetland . the wetland is outside of USACE jurisdiction . regardless of its final jurisdictional status. In accordance with Clean Water Act Section 402 and Section 404 . appropriate erosion and sediment controls will be implemented in order to properly stabilize the construction site and prevent erosion and siltation into wetlands and other waters intersected and within the vicinity of the project. Protect the health , welfare , safety of the inhabitants of Weld County 6 . Consistent with the best interest of the people of Weld County 7. No unreasonable interference with significant wildlife habitat, including endangered species, unique natural resource , known historic landmark or archaeological site within the affected area . S .
