RESOLUTION RE: APPROVE SPECIAL EVENTS PERMIT AND AUTHORIZE CHAIR TO SIGN - THE WILD ANIMAL SANCTUARY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, The Wild Animal Sanctuary, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Special Events Permit for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, subject to the rules and regulations found in Article 47, Title 12, C.R.S., and WHEREAS, said applicant has paid the sum of ONE HUNDRED DOLLARS ($100.00) to Weld County, Colorado, pursuant to the laws providing therefore in payment for a County Retail Permit for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, subject to the rules and regulations found in Article 47, Title 12, C.R.S., for events scheduled on May 5, and 19, 2018, June 2, and 16, 2018, August 25, 2018, September 22, 2018, October 6, 2018, and November 10, 2018, outside the corporate limits of any town or city in the County of Weld at the location described as follows: The Wild Animal Sanctuary, 1946 County Road 53, Keenesburg, Colorado 80643; being further described as Lot B of Recorded Exemption, RE -2344; being part of the N1/2NW1/4 of Section 28, Township 1 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has also paid the sum of TWENTY-FIVE DOLLARS ($25.00) to the Colorado Department of Revenue and has exhibited a State Special Events Permit for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, subject to the rules and regulations found in Article 47, Title 12, C.R.S. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld County, Colorado, having examined said application and the other qualifications of the applicant, does hereby grant Special Events Permit Number 2018-11 to said applicant to sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location; and the Board does hereby authorize and direct the issuance of said permit by the Chair of the Board of County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which permit shall be effective for events scheduled on May 5, and 19, 2018, June 2, and 16, 2018, August 25, 2018, September 22, 2018, October 6, 2018, and November 10, 2018, providing that said place where the permitee is authorized to sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the rules and regulations relating thereto, per Article 47, Title 12, C.R.S., heretofore passed by the Board of County Commissioners of Weld County, Colorado, and any violations thereof shall be cause for revocation of the permit. Non-profit Wildlife Sanctuary benefiting captive wildlife both domestic and international. Mission: To prevent and alleviate cruelty to animals which are abandoned or were subject to deprivation or neglect, by providing care and boarding. To rescue and provide life-long homes for large, exotic and endangered captive wild animals and to educate the public about the causes of and solutions to the world's captive wildlife crisis. The Wild Animal Sanctuary is all about saving the victims of this captive wildlife crisis. We crisscross the U.S., Canada, Mexico, Central and South America, Spain and the rest of the world rescuing captive exotic and endangered large carnivores that have been abused, abandoned, exploited or illegally kept. Established in 1980, The Wild Animal Sanctuary is a state and federally licensed zoological facility and a 501(c)(3) nonprofit organization. Our educational facility is located outside of Keenesburg, Colorado, 30 miles northeast of Denver, on 789 acres of rural, rolling grasslands, sheltering more than 460 large carnivores! Our Refuge facility is a 9,004 acre property located in southern Colorado near the town of Springfield, CO. This facility is not open to the public and hosts rescued animals in amazingly -natural habitats ranging upwards in size of 100 -1,000 acres in size. TWAS is the largest and oldest sanctuary of its kind in the World. Our goal is to give them a life of dignity and respect and to make their life as it would be if they could choose. Sanctuary staff and volunteers have been trained in crowd control and in monitoring the conduct and intoxication level of attendees. Two-way radios are used to communicate amongst staff and volunteers to allow timely intervention as needed. I am currently awaiting new signed letters from both Fire Protection Districts pledging the same support for this year's events as previous years. So we approved what was submitted, sounded fine, but then received an application from a food after the fact and determined that more food vendors would be showing up. So provided no one else is going to join in, then the temporary assembly permit process is fine, but if later they add additional people then we need to ensure we have a process to cover those vendors (as they may need to obtain licensing through us). So if you think amendments to assembly permit is right way, were good with that, or if you think by the board approving the event, if they add some additional food vendors that we could cover in our process, then we can take the ball and run with it. We knew about the permanently licensed mobile units, but may not have understood the "temporary vendors" since we thought everyone had to have the full license. We also understood the need for documentation in order to track illnesses, which is why we directed them to you — as well as knowing our event permit would also create a record of the event. I guess the gap came with us not knowing each event had to list the vendors on our annual application — which is different than a normal submission for each event that most people would do separately throughout the year. I realize if we were applying for a single event and did so relatively close to the date it was taking place, we would be able to have a current list of vendors, and could submit them. However, since we apply once per year and cover an entire year's worth of events, it's impossible for us to know who the vendors would be that early in the year. Other than the few large events we book ahead of time with UNC, we sometimes may not know who is available. Some of our events may be able to host a few small vendors like the shaved ice people, and once in a while the larger events that have UNC could also have a couple small side vendors, so it can get confusing at times. Regardless, if they are permanently licensed... or temporary... it sounds like you want us to know at the time we do our annual application which vendors will be at each event. If that is the case, we will have a difficult time submitting reliable information with some of them, since their schedules change often. We always thought it was OK to just send them to you and then ensure they had the permits in place before allowing them to actually come to an event. Would it be possible to submit the specific list of vendors maybe a week before each event, with the stipulation only those that have contacted you and have been verified can then actually attend? A good example is the upcoming Earth Day celebration, where we have our own licensed caf� and ice cream shop on site... but we get random calls for small operator/vendors that want to attend. We always tell them they have to be licensed through the state or county, and need to confirm their status with you before we would ever agree to let them come. Even then, we would check with them days before the event to make sure they had proper documentation. Every vendor that sells food to the public must have a Colorado Retail Food Establishment License. Mobile units (food trucks, etc) that are licensed by any county other than Denver have a "permanent" license for that calendar year and may operate anywhere in the state (City and County of Denver is the only one where licenses are non -reciprocal across county lines). Temporary event vendors are the ones that set up a booth or table and tent set up, and may have a mobile unit or trailer that is not licensed "permanently". These temporary event vendors must obtain a temporary event license, and need to be listed on special event/temporary assembly applications by the coordinator of the event. For example, this vendor did not indicate that they have a mobile license, so they are applying for a temporary event license, which needs to be matched to the event they are attending. All food vendors, regardless of license type or status, need to be documented for special event attendance, mainly for the purpose of tracing back illnesses or complaints and verifying licensure, typically this is covered in a coordinator application, but in your case the temporary assembly permit supersedes that application and satisfies all requirements. We have two outside food vendors coming to our Wild Earth Day Event: Sweet Penelope's BBQ and Bob's Last Stand, Sweet Penelope's is already licensed in Weld County (see license attachment). Bob's Last Stand has applied for their temporary event license which was approved today by Cassandra (see email attachment for proof of licensure). As discussed in the attached email chain, it is impossible for us to know at the time of the annual temporary assembly application which vendors will be registering for any given event. We always include UNC Catering as they are used every year for event catering services. One-off food vendors, such as those listed above, are vetted through our vendor registration process when they initially contact us about vending at an event. As part of this process we inform them of licensing requirements and request verification of their retail food license or temporary event license approval in best efforts to be compliant with all Weld County regulations (see attached vendor registration template form). However, moving forward we are in need of a defined, best -practice process for communicating and handling these additional vendors. Cassandra mentioned she has been working with you to try and define this best practice approach moving forward, so I just want to reiterate to please keep us in the loop of these discussions. Our preference would be to verify the vendor has the proper licensing/approvals during the registration process, and then to forward a list of registered vendors to the appropriate department. If approved, a Special Events Permit allows you to have alcohol at your events, and a Temporary Assembly Permit allows you to have 350 people or more assemble on the premises. Last year your staff completed the application process twice — once for regular season events, and again for the Tiny House Festival. If you are aware that you will be hosting the Tiny House Festival again this year, you are welcome to include it in your main application to avoid the extra paperwork and fees.
