1. Explain, in detail, the proposed used of the property.
The property owners are requesting a Use by Special Review (USR) to park up to 5
Semi Trailers and 2 Dump Trucks. Semi -Trailers are currently parked on the
property. This application seeks to address the current violations, case no.ZCV18-
00052.
The Semi -Trailers will be used to haul hay, machinery, lumber, etc. They will be
hauled to different states.
There are currently 7 full-time employees, 2 of them, are family members who reside
on site in the residence. 3 current full-time employees are Semi -Trailer drivers for
West Coast Transports. They will be on site only on weekends, Friday — Monday.
The other 4 current full-time employees are employees for Protective Seal Coating,
who will be on site to pick up equipment, and vehicles for their daily commute.

2. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 22 of the Comprehensive Plan.
3. Explain how the proposal is consistent with the Weld County Code, Chapter 23
(Zoning) and the zone district in which it is located.
4. Describe what types of land uses surround the site. Explain how the proposed
use is consistent and compatible with surrounding land uses.
The surrounding area has multiple uses including production, agriculture, dairy farms,
commercial compos facilities, multiply business that require the transportation of the
following materials, lumber, hay, gravel, machinery etc.
5. What are the hours and days of operation? (e.g. Monday thru Friday 8:00a.m. to
5:00p.m)
West Coast Transports Hours of Operation — Trucks leave every Monday, between
the hours of 6:00a.m. — 9:00a.m. And they return Friday or Saturday anywhere from
7:00a.rn. — 7:00p.m. Also, during these hours of operation, maintenance is done to the
Semi -Trailers, only when required.
Protective Seal Coating Hours of Operation — Monday thru Saturday 7:00a.m. —
7:00p.m. Weather Permitted (Snow, Rain, high winds etc.) Also, during these hours
of operation, maintenance is done to the Dump trucks, only when required.

There are exiting landscaping area around the existing residence.

There is a 6 foot chain link fence around the 4 acres.
14. Describe the proposed screening for all parking and outdoor storage areas.
Parking is internal and the proposed screening is provided by the existing trees that
are in the property.
The site is not located in a floodplain.
15. Explain any proposed reclamation procedures when termination of the Use by
Special Review activity occurs.
If parking ceases to occur on site, the property will continue to be used as a single-
family residential site.

Frederick -Firestone Fire Department.
17. List all proposed on -site and off -site improvements associated with the use (e.g.

As of now, no off -site improvements are proposed. On -site improvements are
existing; it includes a single family residence and associated out buildings, improved
asphalt surface, landscaping and fencing. No additional improvements are being
proposed at this time.

either North or South.

The highest traffic volumes will be during the morning hours between 6:00a.m. -

The existing access to the facility is off WCR 13 approximately 3/4 of a mile north of
highway 119/Firestone Blvd/CR 24.

6. Drainage Design: Detention pond summarized in a drainage report is required
unless the project falls under an exception to storm water detention
requirements per code section 23-21-30 F. 1.

If utilizing a drinking water well include either the permit or well permit
application that was submitted to the State -Division of Water Resources. If
utilizing a public water tap include a letter from the Water District, a tap or
meter number, or a copy of the water bill.
No drinking water, just bottled water and soda pop for employees, aside from the
residence.
2. What type of sewage disposal system is on the property?
Portable toilet is already on premises. It has been on the premises for over a year. The
owner of the portable will clean and manage it.
3. If storage of warehousing is proposed, what type of items will be stored?
Up to 5 Semi trailers and trailers, 2 Dump trucks, and a storage trailer. Also, storage
of machinery, hay, food, lumber, truck parts, in storage trailer or on premises.
4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or
petroleum will occur on this site.
We have a dumpster from Waste Management.
5. If there will be fuel storage on site indicate the gallons and the secondary
containment. State the number of tanks and gallons per tank.

use on the adjacent properties. Neither the direct, nor reflected, light form any light
source will create a traffic hazard to operators of vehicles on public or private streets.
No colored light will be used which may be confused with, or construed as, traffic
control devices.
The owner of the property or operator will be responsible for controlling weeds on the
property/site. Trash will be collected in a covered, confined dumpster and removed at
least weekly by Waste Management.

There is an existing single-family residence, garage, a large shop/shed, parking cover
space for personal family owner vehicles. No additional structures are proposed at
this time.

The existing structures will be used by the residents and are not directly associated
with the trucking or asphalt business.

Section 22-2-10 G. A.Policy 7.2. Conversion of agricultural land to nonurban residential,
commercial and industrial uses should be accommodated when the subject site is in an area that
can support such development, and should attempt to be compatible with the region.
There will be two businesses Truck parking and storage and also seal coating. Trucks haul seed,
hay, feed for animals and topsoil are hauled to and from Colorado.

(Zoning) and the zone district in which it is located.
23-3-40.S. Any use permitted as a Use by Right, an ACCESSORY USE, or a Use by Special
Review in the COMMERCIAL or industrial zone districts, provided that the property is not a Lot in
an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of
any regulations controlling subdivisions. PUD development proposals shall not be permitted to use
the special review permit process to develop.

1. This does not appear to be a compatible use with existing single-family residential (Mountain Shadows

Good morning Bethany. The Town will only need to issue an access permit for this property if the County is going to
approve the land use change. When Firestone annexes a road we take it "as is", including accepting any of the existing
access to the roadway. But our access code requires that if the land use changes a new access permit must be applied
for. When the Town annexed this road that property was a farm homestead (Don Hepp). The proposed land use is
more of a commercial/industrial land use so that is what would trigger the need for an access permit. We have no
problem issuing an access permit for this use as it currently functions but I did not want to start down that path if the
County was not going to approve the land use change. Can you tell me if staff is going be recommending approval of
their application? And when is this application anticipated to be acted on by the BOCC? Our Planning Department had
some comments about the compatibility of this new use given that we have a residential subdivision that buts
them. And over the years there has been fill added to this property that has contributed to a drainage problem on the
adjacent Hopp property.
Hector, I have attached the access permit application for you to fill out (I included a sample as well). There is no
application fee and it is pretty basic information. The land owner is supposed to sign the application and also the permit
once we issue it but if your parents are not physically able we can accept yours on their behalf. When you return the
application please include a copy of the current DRAFT of the USR you have submitted to the County. Once you have
completed the application please submit a hard copy to Lisa Bartley at the Town's Building and Permits department
located in the Adams Bank building at the address below.

Hector Soto and his wife, Rosie Soto are acting on behalf of her father, Rafael Aguirre towards submittal of a
`complete' Use by Special Review (USR) application. Mr. Soto has indicated (though his wife) that he has left
several messages for a "Dave" and an "Amber", but has not been able to have a discussion. This property is
currently in violation for operating a business without first having the required land use permits and as such
they are on a time -line for submittal of an application. Part of their submittal is showing approved access. The
points of access for their driveways is in incorporated Firestone. In an effort to assist in facilitating discussions
