CORRECTED RESOLUTION
WHEREAS, a public hearing was held on September 22, 1975,
in the chambers of the Board of County Commissioners, Weld
CD County, Colorado, for the purpose of hearing the petition of
Thomas Krebs , Route 1, Box 253B, Longmont, Colorado, requesting
change of zone from "A" Agricultural District to "E" Estates
District, Planned Unit Development, of a tract of land as here-
inafter required all as appears on plat as submitted and made
a part hereof by reference, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS , the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully
informed, the Board did approve said request by resolution dated
September 24, 1975. However , the legal description in such reso-
lution was incorrectly stated.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the petition of
Thomas Krebs, Route 1, Box 253B, Longmont, Colorado, for a
change of zone from "A" Agricultural District to "A-UD" Agri-
cultural, Planned Unit Development District (Eberl Planned Unit
Development) of a tract of land as appears on plat, said area
being more particularly described as follows and corrected
from the original resolution:
A tract of land located in the Southwest Quarter of
Section 22, Township 3 North, Range 68 West of the
6th Principal Meridian, Weld County, Colorado, being
more particularly described as follows:
Beginning at a point on the West line of the said South-
west Quarter whence the West Quarter corner of said
Section 22 bears N00°43 ' 00"E, 1582 , 06 feet; thence
N90°00 ' 00"E, 1432 . 90 feet; thence S00°43 ' 00"W, 304. 0
feet; thence S90°00 ' 00"W, 1432 . 90 feet to a point on
the said West line; thence N00°43 ' 00"E along said West
line 304 . 0 feet to the point of beginning; subject to
and together with and easement for ingress and egress
and utility purposes over and across said property
being 30 . 0 feet on either side of the following des-
cribed center line, beginning at a point on the said
West line whence the said West Quarter corner bears
N00°43 ' 00"E, 1612 . 06 feet; thence N90°00 ' 00"E, 716 . 45
feet; thence S00°00 ' 00"W, 20. 0 feet to the center of
a cul de sac having a radius of 50 . 0 feet, said point
being the point of termination of said easement con-
taining 10. 0 acres ,
is hereby granted under the conditions following:
1 . That any water and sanitation facilities to be installed
shall be approved by the State Health Department.
2. All applicable subdivision regulations and zoning
regulations shall be followed and complied with in accordance
with the zoning resolutions of Weld County, Colorado.

3 . That all official unit development plans and standards
shall be followed and complied with in accordance with the of-
ficial unit development plan as submitted.
4. That said change of zone herein granted is conditional
only for a period of twelve months from date hereof on condition
that developer proceed with due diligence to begin construction
of a one-family residence building upon said subject property;
otherwise, the County may take action to rezone the property to
its present classification.
5. That a building permit for the erection of a single
family dwelling shall be obtained prior to construction thereof.
6. That the present mobile home located upon subject pro-
perty shall assume temporary status and shall be removed off the
premises when construction of the single family dwelling is com-
pleted.
