Explain, in detail, the proposed use of the property. Ken and Jamie Starman own and operate Front Range Septic as a home occupation on Lot A RECX14-0078. The home occupation allowed the use of underground storage tanks. These tanks were never installed. Being underground, the tanks would have been impractical to use and expensive to install. The Starmans have found that they need to expand their operation to allow for functional outside storage and future increase of trucks to continue serving the needs of Weld County's expanding growth. Front Range Septic operates two 25' tandem axel, twin screw, vacuum trucks from the site. These trucks are used to service local septic systems and restaurant grease traps. Currently, there are only two local options for Front Range Septic to dispose of septic sludge and restaurant grease. The first is McDonald Farms Enterprises, Inc. at 7440 E 1-25 Frontage Road near Frederick. McDonald Farms Enterprises, Inc. is an approved vendor. They are licensed, bonded and meet all county and state regulations. The other option is the City of Fort Collins at 3036 Environmental Way. The trucks will dispose of their load directly at these facilities when the service location is in the vicinity. It is not economically feasible to dispose of every load directly to the facilities; therefore the Starman's are requesting the addition of up to four tankers or tanks for the storage and transport of domestic septic sludge and restaurant grease. The tankers/tanks will be owned and operated by a separate appropriately permitted business. Initially, they will be owned and operated by McDonald Farms Enterprises, Inc. When full, septic sludge and restaurant grease will be transferred from the vacuum trucks into the tankers/tanks. McDonald Farm Enterprises will remove the tankers/tanks as needed. In addition to the outside storage of tankers/tanks, the Starmans would like to request the option to increase the vacuum trucks in the future up to 6 total and add an office with a maximum size of 96 square feet. They currently don't have plans to increase the amount of vacuum trucks, but would like the option to increase them as the growth of the business continues. Septic sludge and restaurant grease are not hazardous materials. They are not known to cause airborne viruses nor is a spill likely to cause groundwater contamination. None of the septic sludge will be applied to farm ground. An emergency response plan has been included to address the remote possibility of a spill from one of the tanks. Smell from the septic sludge is limited to the time it takes to attach the hose to the tank and pump the sludge from the vacuum trucks. The smell disperses quickly. No sign is being requested and no additional lighting is being proposed. There are three existing security lights. Two at the front of the home and one on the shed. All are down cast. There is a spotlight at the flagpole. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. Section 22-2-20.G.A.Goal 7, County land use regulations should protect the individual property owner's right to request a land use change. 1.A.Policy 7.1. County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. 2.A.Policy 7.2. Conversion of agricultural land to non -urban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development, and should attempt to be compatible with the region. Section 22-2-20.B.A.Goal 2. Continue the commitment to viable agriculture in Weld County through mitigated protection of established (and potentially expanding) agricultural uses from other proposed new uses that would hinder the operations of the agricultural enterprises. 1.A.Policy 2.2. Allow commercial and industrial uses, which are directly related to or dependent upon agriculture, to locate within agricultural areas when the impact to surrounding properties is minimal or mitigated and where adequate services and infrastructure are currently available or reasonably obtainable. These commercial and industrial uses should be encouraged to locate in areas that minimize the removal of agricultural land from production. The agricultural district is almost exclusively serviced by septic systems. Homes and businesses are dependent upon septic services such as Front Range Septic. Visual impacts have been mitigated through screening of the tanks. Any smell associated with the business is limited to the minimal time it takes to transfer the septic sludge into the tanks. This smell disperses quickly. Business related traffic to and from the site is minimal and will adhere to the approved traffic route when possible. Noise from the trucks is negligible and should have little impact on the surrounding property owners. Further, no agricultural land has been taken out of production at this site. Section 22-2-20.H.A.Goal 8. Ensure that adequate services and facilities are currently available or reasonably obtainable to accommodate the requested new land use change for more intensive development. Homes and businesses are constructed in the agricultural district with the assumption that adequate services will be available. Almost all of these homes and businesses rely on septic systems that require a pumping service. Few services exist that are needed more by the agricultural community as a whole 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Section 23-3-40.S of the Weld County Code states that any use permitted as a Use by Right, an accessory use, or a Use by Special Review in the commercial or industrial zone districts, provided that the property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions shall be allowed with the approval of a Use by Special Review Permit. Section 23-3-310.6.1. states that any use of a storage nature may be conducted in the I-1 Zone District. Section 23-3-310.B.2. allows for areas to park passenger vehicles within the I-1 Zone District. Section 23-3-310.8.13. allows for the transloading of commodities and materials within the 1-1 Zone District. Section 23-3-320.3. allows for parking vehicles or equipment, so long as such parking areas are screened from the adjacent public rights -of -way and on adjacent properties zoned R-1, R-2, R-3, R-4, R-5, C-1, C-2, C-4 or I-1 in the 1-2 Zone District. 4. Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. Residences are in close proximity to the north, east and north east. The Starman's own the vacant agricultural property directly to the southwest. The pumper trucks will be parked within the shed when not in service. The storage tanks/tankers will be located behind a five foot berm that surrounds the irrigation pond to the east. Rows of Cottonwood and Austrian Pine trees are directly to the north of the tanks. Also to the north is a third row of trees comprised of Austrian Pines and Hackberry bushes that lie on the adjacent Starman property. The storage tanks are further screened by the shed, home and additional Austrian Pine trees along the County Road 53 right - of way. This submittal includes odor plans, specified traffic routes, dust abatement plans, emergency response plans, landscaping and screening plans and emergency spill plans. All of these are intended to ensure that the site is compatible with the surrounding land uses and the business does not negatively impact the surrounding property owners. This submittal includes letters of support from six surrounding property owners. 5. What are the hours and days of operation? 7 am to 7 pm Monday thru Friday except in the case of emergency. 6. List the number of full time and/or part time employees proposed to work at this site. Not including the property owners Front Range Septic is asking to employ up to six employees in the future. Front Range Septic will not employ the drivers of the contracted vendor trucks picking up material from the outside storage tanks. 7. If shift work is proposed include the number of employees per shift. Not applicable. 8. List the number of people who will use this site. Include contractors, truck drivers, customers, volunteers, etc. The site is used by the residents, Ken and Jamie Starman, up to six employees who operate the vacuum trucks. There will also be approximately two McDonald Farm Enterprises employees visiting the site per day The site will also be used by agricultural employees. 9. If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. Not applicable. 10. Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) The lot is roughly 6,500 sf buildings, 77,356 sf gravel and 112,550 sf landscaping/grass 11. How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? Six screened employee parking spaces have been designated on the plat. An ADA parking space will be included if required. 12. Explain the existing and proposed landscaping for the site. The landscaping surrounding the homes is typical grass, trees and shrubs. Rows of Cottonwood and Austrian Pine trees are directly to the north of the tank storage area. Just north of these trees there is a third row comprised of Austrian Pines and Hackberry bushes that lie on the adjacent Starman property. There are eighteen Austrian Pine trees and one Blue Spruce along County Road 53 right -of way. 13. Describe the type of fence proposed for the site (e.g. 6 foot chain link with earth tone slats) No fencing is proposed. 14. Describe the proposed screening for all parking and outdoor storage areas. The four tanker trucks/tanks will be screened by three rows of trees on the north side, a five foot berm, and the shed on the east side. The home, eighteen Austrian Pine trees and one Blue Spruce screen the tanks from County Road 53 right-of-way. No screening is proposed to the west and southwest of the tanks since the adjacent 212 acre property is owned by the Starmans. There are over 2000 feet between the tanks and the nearest home to the south/southwest. 15. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. The four tankers/tanks would be removed from the property. 16. Who will provide fire protection to the site? Galeton Fire Protection District, 17. List all proposed on -site and off -site improvements associated with the use (e.g. landscaping, fencing, buildings, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. An office no larger than 96 square feet may be added at a later date. All landscaping has been completed. Engineering questions: 1. Describe how many roundtrips/day are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and 1 trip out of site) An average of four round trips per day is expected from the tanker loads of 6,000 gallons each. The six vacuum truck would be an additional six round trips per day. Business related passenger vehicles would add approximately six round trips per day. Employees are asked to limit their speed and use of jake brakes to minimize the negative impact on the surrounding property owners. Mr. Starman and neighbor Scott Walters have been adding Magnesium Chloride to County Road 53 for 700 feet in front of their homes. Approximately 6 inches of road base top dressed with 1/2 to% inch rock has been applied to the interior roadways and tank parking area. Dust should not be a factor. However, should surrounding property owners complain about on -site dust and the complaint is verified by Weld County staff, appropriate steps will be taken to minimize dust. Dust reduction may be controlled by reducing the speed of vehicles on the site at minimum or applying magnesium chloride if necessary. 2. Describe the expected travel routes for site traffic. Most traffic will come from the south along County Road 53 from Highway 392. The remaining traffic from the north does not have a consistent route. The tanker trucks supplied by McDonald Farm Enterprises, Inc. are asked to come along County Road 53 from Highway 392. 3. Describe the travel distribution along the routes. 90% of the truck traffic comes from the south along County Road 53 from Highway 392. Tanker drivers are asked to use this route at all times. The remaining 10% of the traffic from the north does not have a consistent route. 4. Describe the time of day that you expect the highest traffic volumes from above. Early morning and late afternoon 5. Describe where the access to the site is planned. The existing access onto County Road 53 will be used. The access has a 43 foot wide culvert that makes it adequate for the tanker trucks. 6. Drainage Design. A. Which exception is being applied for and include supporting documentation. The applicants are requesting an exception using F.1.a.13. which allows for a onetime exception for a new 1,000 sq. ft. building or equivalent imperviousness when the parcel is greater than 1 gross acre and less than, or equal to, 5 gross acres in size. B. Where the water originates if it flows onto the property from an off -site source Water is prevented from running onto the property on the east side by the County Road 53 right-of-way. Water from the north is partly prevented from entering the property by the berm surrounding the irrigation pond on the adjacent Starman property. Water could flow from the north from the adjacent property across the west 374 feet of the lot. This water would then flow south to the adjacent Starman agricultural property. C. Where it flows to as it leaves the property Water from the property will flow southwest to the adjacent 212 acre Starman agricultural property. D. The direction of flow across the property The site slopes to the southwest. E. If there have been previous drainage problems with the property There have been no previous drainage problems on the site. Environmental Health questions 1. What is the drinking water source on the property? The existing single family residences is serviced by North Weld County Water District. A water bill has been included with this submittal. Bottled water located in the shed is available to employees. 2. What type of sewage disposal system is on the property? The existing home is serviced by a septic system. A copy of permit SP -9800104 is attached to this submittal. A port -a -let will be provided for the employees. 3. If storage or warehousing is proposed, what type of items will be stored? Domestic septic sludge and restaurant grease will be stored in the four tanker trucks/tanks. 4. Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on this site. Miscellaneous trash is picked up weekly by Northern Colorado Disposal. Domestic septic sludge and restaurant grease will be removed from the property by McDonald Farm Enterprises daily or when tanks are full. Approximately 2 gallons of windshield washer fluid is stored within the shed. Tire repair and replacement is completed at an off -site repair shop who will be responsible for disposal of tires. Oil changes are completed by an off -site mechanic who will be responsible for disposal of used oil. 5. If there will be fuel storage on site indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. Three fuel tanks that are below the EPA required containment size of 1 320 gallons are stored on the site. There are two 250 gallon tanks that hold diesel for farm use. There is one 500 gallon tank that holds diesel for Front Range Septic use. 6. If there will be washing of vehicles or equipment on site indicate how the wash water will be contained. No vehicles or equipment are washed on -site. 7. If there will be floor drains indicate how the fluids will be contained. None. 8. Indicate if there will be any air emissions. (e.g. painting, oil storage, etc.) Not applicable. 9. I am attaching a letter from 2014 when I wrote my feelings concerning his previous request of a zoning permit. My feelings have not changed since then. I have still not noticed any odors coming from his place and his trucks have not caused any type of problems that I am aware of. I don't see any difference from them than from any other trucks passing my place. In fact, they drive slower and create less dust! lie continues to be a good neighbor and checks in on me periodically. Again, t have no concerns about allowing him the zone permit. I live about % miles north of Ken Starman. I have never noticed any odor coming from his business. I have seen his truck(s) go by occasionally but have noticed nothing out of line with the drivers. There has been no noise, such as horns, or jake brakes. If you wave at them, they'll wave back. As far as I can tell from what I know, when it came to Ken's attention that he was out of zoning compliance, he started the process to come into compliance. My experience with Ken has been good. He has been a good neighbor. He knows I live alone and will often do voluntary acts of kindness, such as snow removal so I can get my car out of the garage and onto the road. i also know that if I need help, he will come. An instance of this was when I was working on my automatic waterer and the float blew off and I had water spraying out everywhere. I called and he came up immediately and got the water stopped and the float working properly. When I have visited with him, he always seems concerned about the neighbors and community.
