RE: APPROVAL OF RECORDED EXEMPTION NO. 355 - ELSIE OSTER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 29th day of November, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 355, being the property of
Elsie Oster, described as part of Section 27 , Township 4 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :
The North Half of the North Half of the North-
west Quarter (N1/21\111 WW1/4) Section 27, Township
4 North, Range 65 West of the 6th P.M. , Weld
County, Colorado.
Said described parcel contains 40.104 acres,
more or less, and is subject to any rights-
of-way or other easements as recorded by
instruments of record or as naa existing
on said described parcel of land.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Elsie Oster be, and hereby is , exempt

RE: Recorded Exemption #355 and a Variance under Section 12 A. of
the Weld County Subdivision Regulations
Dear Commissioners:
The attached application, plat and related items are in reference to
a request from Mrs. Elsie Oster for a recorded exemption and a variance
under Section 12 A. of the Weld County Subdivision Regulations. The
property is described as the NZNZNW* Section 27, T4N, R65W of the 6th
P. M. , Weld County, Colorado . This property is located 4-1/2 miles
southeast of the Town of LaSalle. The property contains approximately
40 acres of Class II and III irigated soils. The request is to split
the property into parcels of 0. 934 acres and 39. 170 acres.
On October 16, 1978, the Board of County Commissioners approved a re-
quest from Mrs. Oster for a Lot Size Variance so that she could make
application for this recorded exemption. At the time they made the
decision on that request, the Department of Planning Services Staff
submitted a letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached materials. Noth-
ing has been received by our office that would change our recommendation
for approval of this request as outlined in the letter to the Board of
County Commissioners dated October 16, 1978.
In addition, Mrs. Oster is requesting a variance from Section 9-4 A.
(7) of the Weld County Subdivision Regulations which states that the
minimum size of any building site, tract or lot created by the recorded
exemption procedure shall not be less than one (1 ) acre, except when
smaller lot sizes are allowed in a specific zoning district .

The proposed Lot A of the recorded exemption will be only 0. 934 acres
+ in size. The Department of Planning Services Staff recommends ap-
proval of the variance request in that we feel the request is reason-
able and within the general purpose and intent of the rules, regula-
tions and standards established by the Weld County Subdivision
Regulations.
