RESOLUTION
RE: VACATION, ABANDONMENT AND CLOSING OF ALLEYS IN BLOCKS
12 and 13 IN THE UNINCORPORATED TOWN OF BRIGGSDALE,
WELD COUNTY, COLORADO
WHEREAS, a petition has been presented to the Board of
County Commissioners, Weld County, Colorado, by the present
owners of said real estate, requesting that the alleys in
Block 12 and the alleys in Block 13, in the unincorporated
Town of Briggsdale, Weld County, Colorado, be abandoned and
vacated, said alleys being located adjacent to property
nearly wholly owned by the aforementioned petitioners, and
said alleys being more particularly described as follows,
to-wit:
That portion of east-west alley lying
between Fourth Avenue andrFifth Avenyee
in Block 12 in the unincorporated Town
of Briggsdale, Weld County, Colorado;
and
That portion of east-west alley lying
between Fourth Avenue and Fifth Avenue
in Block 13 in the unincorporated Town
of Briggsdale, Weld County, Colorado;
WHEREAS, The Board, after investigation of all of the
facts and circumstances surrounding the petitions, that after
personal investigation of the hereinabove described alleys
sought to be vacated, has determined that the necessity of
the public no longer requires those portions of alleys; and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interest of the public,
and Weld County, to approve said petitions.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the aforementioned
alleys in Block 12 and the aforementioned alleys in Block 13,
all in the unincorporated Town of Briggsdale, Weld County,
Colorado, be and they are hereby declared abandoned, vacated,
and closed, in accordance with the submitted petitions.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
July, A.D. , 1976.

between WELD COUNTY, a municipal corporation and a political
..n subdivision of the State of Colorado, by the BOARD OF COUNTY
CO COMMISSIONERS, for the respective interests of the COUNTY OF
in WELD, and the STATE OF COLORADO, of the first part, and THE
C" PRESENT OWNERS, of the second part;

WITNESSETH, that the said party of the first part, and
• in consideration of the sum of other valuable considerations
and ten dollars, to said party of the first part in hand and
paid by the said parties of the second part, the receipt
o whereof is hereby confessed and acknowledged, has remised,
c; released, sold, conveyed and QUIT CLAIMED, and by these
o presents does remise, release, sell, convey and QUIT CLAIM
unto the said parties of the second part, all the right,

title, interest, claim and demand which the said party of the
first part has in and to the following described real estate

singular the appurtenances and privileges thereunto belonging
or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the
first part, either in law or equity, to the only proper use,
benefit, and behoof of the said parties of the second part,
their heirs and assigns forever.
SIGNED AND DELIVERED, this 14th day of July, A.D. ,
1976, by WELD COUNTY, a municipal corporation and a political
subdivision of the STATE OF COLORADO by the BOARD OF COUNTY
COMMISSIONERS, for its respective interests.

Dear Mr. Billings:
the Board of Education of School District RE-10J,
Briggsdale, Colorado, would like permission to close the
alleys in Blocks 12 and 13 in the town of Briggsdale.
These two block are owned by the school district. The
alleys are used as part of our playground, and neither
provide access to any other part of the town.
The legal description of Briggsdale is as follows:
the N.W. corner of SE4/64 Sec. 28, T 8N, R 62 W. These
two blocks contain lots one through twevAy each.
Your permission to close these alleys would be
appreciated.
