It is the opinion of the Planning Commission that the proposed modifications to the existing gas compressor station are in compliance with the provisions of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution which states : "The Planning Commission and Board of County Commissioners shall consider the following in making their determination in approving or denying a Special Use Permit: Compatability with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses, need for the proposed use, its effect upon the immediate area, its effect on future development of the area, and the health, safety, and welfare of the inhabitants of the area and the county. " This determination is based in part upon the following responses from various referral agencies which have reviewed this request and have set forth no objections to the request: 1 . The Weld County Engineering Department, memo dated May 29 , 1979 2 . The Longmont Soil Conservation District, memo dated May 31 , 1979 3 . Colorado Oil and Gas Conservation Commission, memo dated May 30, 1979 4 . Longmont Fire Protection District, letter dated June 7, 1979 5. Colorado Geological Survey, letter dated June 12, 1979 6 . Tri-Area Planning Commission, memo dated June 13, 1979 The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and approved for the Special Use Permit. 2 . No building or electrical permits for the Compressor Station facilities shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been recorded in the Weld County Clerk and Recorder ' s Office. Amoco Production Company - SUP DEVELOPMENT STANDARDS 1 . The permitted uses on the hereon described parcel shall be a compressor station and related facilities and shall be limited to those shown on this plat. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. The applicant shall be responsible for adhering to the provisions of the Colorado Air Pollution Control Commission Regulation No. 2. 4. Upon termination of the operation of the compressor station, all facilities and structures shall be removed to 30" below grade . The site shall be reclaimed to a farmable state. 5 . Access shall be limited to the two accesses off County Road 11 as shown on the Special Use Permit plans . Once an underground pipe- line is extended to the site for collection of the merchantible oil, the access at the north end of the property shall be terminated and the truck loading rack shall be removed. All access shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6 . All loading, unloading, and transfer operations shall be installed and maintained in accordance with the Department of Labor and State of Colorado Oil and Gas Conservation Commission specifications . 7. Manual shutoff valves adequately identified shall be installed for both incoming and outgoing oil and gas per the specifications of the Longmont Fire Protection District. 8. A heat shield shall be installed between the valve station and the compressor station in accordance with the specifications of the Longmont Fire Protection District. 9 . At present, a domestic water supply as well as restroom, laboratory or cleaning facilities are not needed at the site. These facilities shall be permitted under this Special Use Permit provided the necessary permits are acquired and the facilities comply with all applicable Weld County and State Health Standards and Regulations. 10 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amend- ment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . • Comments : 1 . The Weld County Health Department has certain recommendations for the operation which have been incorporated into the attached Development Standards . 2 . While the Tri-Area Planning Commission has no objections to the proposed request, the Commission feels that no further expansion should be allowed beyond this request. 3 . To date our office has received one letter from Union Rural Electric Association, a surrounding property owner within 500 feet of the property on which the request has been made. Chairman Carlson called for a motion to approve the minutes of June 19 , 1979. Bette Kountz made a motion to approve the minutes as presented. The motion was seconded by Jerry Kiefer. All present case a unanimous vote of "aye" to approve them as presented. APPLICANT: Amoco Production Company CASE NUMBER: SUP-394 : 79 : 15 SUBJECT : Modification/Addition to West Spindle Compressor Station - Amends SUP-336 LEGAL DESCRIPTION: Pt. Wk, Section 36, T2N, R68W LOCATION: 1 mile west of Frederick APPEARANCE : Lou Gaskins-Attorney; John Lang, Senior Staff Engineer DISCUSSION: Mr. Lang stated that they first obtained the Special Use Permit in 1975 for the compressor station which presently has three 1, 000 horsepower compressors . These compressors are used to take gas from oil and gas wells in the surrounding areas and compress the low pressure gas up to 430 lbs . This pressure is then pushed through a pipeline 4 miles east of the site to Spindle Plant. It is there that dry gas is yielded which is suitable for use in residential or industrial type operations . They now need one additional compressor at the site which will be located on three acres adjacent to the other three compressors. The purpose of the additional compressor is to give them the capacity that when one of the other compressors needs to be shut down to overhaul , etc. they will not have to reduce oil 1 production in the field. Tom Honn then read the staff' s recommendation, for approval with the Development Standards and the comments. There was a letter received by the staff from Union REA stating that they have no objection to this as long as the proposed change does not encroach within 20 feet of the existing underground pipeline located / east of and parallel to the west line of the section. Mr. Gaskins stated this would not encroach the property in any way nor interfere" with the right-of-way. Mrs. Kountz asked what the duration would be/f for the compressor. Mr. Lang responded at most approximately 11/2 to l years after the peak period. Ben Nix asked if noise would be a problem. \ Mr. Lang stated that the operation is basically inaudible. Mr. Hiatt stated he field checked the proposal and found it to be a very quiet operation and saw no problem with it. �' Planning Conwiissioi inutes Page 2 July 3 , 1979 MOTION: Be it therefore resolved to recommend approval based on the ' Planning Staff' s recommendation with the Development Standards to the Board of County Commissioners . SE%, Section 18 , T6N, R64W LOCATION: 51/2 miles east of Lucerne, north side of Colorado Highway 392 APPEARANCE : Joe Hellewell DISCUSSION: Mr. Barnes desires to establish a horse training facility on this property for approximately 6 to 20 horses . He has a lease with an option to buy the property at present. He has begun to build a permanent residence with a barn and other necessary training facilities yet to be constructed. Mr. Barnes ' primary occupation is raising horses . A full time trainer will be hired and a residence will also be built for him. There will be no horses boarded at the property. Tom Honn then read the Planning Staff ' s recommendation for approval along with the Development Standards and comments . Some discussion followed regarding possible flooding, but the site is too high for this to occur. MCTION: Be it therefore resolved to recommend approval with the Developmer Standards to the Board of County Commissioners based on the Planning Staff' s recommendation. Motion by Ben Nix, seconded by Bette Kountz. A vote of "aye" was cast by Chuck Carlson, Percy Hiatt, Ben Nix, Jerry Kiefex and Bette Kountz. An abstention vote was cast by Fred Otis. Motion carriE APPLICANT : Tomas Mondragon CASE NUMBER: CUP-51 : 79 : 8 SUBJECT: Storage of Firewood LEGAL DESCRIPTION: Lot 19, Indian Hills - Pt. NW4, Section 35, T5N, R66W LOCATION: 5150 44th Avenue, Greeley, Colorado APPEARANCE : Tomas Mondragon DISCUSSION: Mr. Mondragon is presently employed full time, but wants to furnish Greeley and surrounding areas with firewood for energy conservatior purposes. Approximately 300 cords of wood will stored on the northeast part of the property. Mr. Otis asked if the applicant was aware of any possible restrictive covenants for conducting a business from a person' s home in a subdivision. Mr. Mondragon stated he was not aware of any, but would check into it before proceeding with the business . Tom Honn then read the Planning Staff' s recommendation for approval along with the Development Standards and the comments . Mr. Honn also stated that in the Planning Staff' s opinion an additional item should be added to Development Standard #5 which states that the request will be in compliance with CRS 35-4-101 et. seq. 1973 as amended. This is a state statute as it regards pests. Discussion followed regarding this. There was also some discussior, regarding Development Standard #6 in regard to the property having a neat and orderly appearance. There are presently two vehicles on the property. Mr. Mondragon stated that he wants to make trailers out of them for hauling the firewood. Chairman Carlson then asked if anyone in the audience wished Planning Coiiuiiissioi mutes Page 3 July 3 , 1979 to make a couunent regarding the request. At this time Juan DeLaRosa, Mr. Mondragon' s neighbor to the east, stated that he was concerned that the property would become unsightly and junky looking, but he has no objection to Mr. Mondragon storing firewood. Mr. Nix then commented that he was concerned about the operation and what the County could do if the operation were to get out of control . Fred Otis stated he feels the definitions and Development Standards need to be more strictly drawn as regards : 1) The fence-needs more clarification where it will be located; 2) Cars should be enclosed on the property; 3) Should be a limitation on the size of the fence. A great deal of discussion followed in this regard. MOTION: Be it therefore resolved to recommend approval with the Developmer Standards and the addition to Development Standard #5 as recommended by the Planning Staff. Also that the staff include within the Development Standards a maximum area to be deteLwined of 20, 000 square feet; a 10 foot fence be placed no closer than 10 feet from the property line; and that there be a maximum height to the fence of 8 feet. Motion by Jerry Kiefer , seconded by Bette Kountz. A vote of "aye" was cast by Ben Nix, Jerry Kiefer, Bette Kountz, and Chuck Carlson. A vote of "no" was cast by Percy Hiatt and Fred Otis . CONSIDER A RECOMMENDATION TO AMEND SECTION 4. 5. , GENERAL SIGN REQUIREMENTS , WELD COUNTY ZONING RESOLUTION. DISCUSSION: Tom Honn stated that at the last Planning Commission meeting they recommended striking from the Resolution the section regarding annual renewal of signs. This amendment is to add two new sections . (See attached amendments) . The subject was then brought up as to what the definition is of a sign and what the difference is between a commercial sign and any other sign. It was the general feeling of the Planning Commission that it is not appropriate to approve something that could be a violation but cannot be enforced. MOTION: Be it therefore resolved to recouwiend approval based on the Planning Staff' s recommendation. Motion by Ben Nix, seconded by Jerry Kiefer. A vote of "aye" was cast by Ben Nix and Jerry Kiefer. A vote of "no" was cast by Percy Hiatt, Fred Otis , Chuck Carlson, and Bette Kountz . Motion carried for denial . • Planning Couunissio; mutes Page 4 July 3 , 1979 CONSIDER A RECOMMENDATION TO AMEND SECTION 6 . 6, UNIT DEVELOPMENTS , WELD COUNTY ZONING RESOLUTION DISCUSSION: Tom Honn explained that there is a problem that the current regulations have created that allows certain types of development in a given zone district in a given situation. This involves the High Density Zone District. A person can build an apartment building or condominium because it is a single unit of ownership with no actual subdivision taking place on the property. This could not be allowed if a person wants to create a townhouse because it creates a separate interest. He then explained the unit development procedure and restrictions and the suggested amendments to it. (See attached) Harry Cross stated that he agrees with Mr. Honn and that this should be amended. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff ' s recommendation to the Board of County Commissioners . Motion by Jerry Kiefer, seconded by Ben Nix. A vote of "aye" was cast by Percy Hiatt, Ben Nix, Fred Otis , Chuck Carlson, Jerry Kiefer, and Bette Kountz. Motion carried. CONSIDER A RECOMMENDATION ON PROPOSED AMENDMENTS TO THE WELD COUNTY ZONING RESOLUTION WHICH WILL CLARIFY THE DUTIES AND RESPONSIBILITIES OF THE DEPARTMENT OF PLANNING SERVICES , THE PLANNING COMMISSION, AND THE BOARD OF COUNTY COMMISSIONERS IN ACTIONS CONCERNING AMENDMENTS TO THE MAP OF THE ZONING RESOLUTION DISCUSSION: This was continued from the June 19, 1979 Planning Commission so that the Planning Staff could meet with the Board of County Couiuiissionei at a work session and resolve the concerns raised by the Planning Commission. The work session has not yet been held, therefore, the Planning Staff recommended the request be continued to the July 17 , 1979 Planning Commission meeting. MOTION: Be it therefore resolved to continue the request to the July 17 , 1979 Planning Commission meeting based on the staff ' s recommend- ation. Motion by Fred Otis , seconded by Percy Hiatt. Mr. Honn submitted, for the Boards consideration an application for Subdivision Exemption #89 , Amoco Production Company. Said Subdivision Exemption should have been applied for prior to the granting of the original Special Use Permit on April 16, 1975. For this reason Mr. Honn requested this item be considered in conjunction with the present Special Use Permit application. The Planning Department recommends that the request be approved. The Planning Commission' s favorable recommendation and related development standards for a Special Use Permit for modifications to the West Spindle Gas Compressor Station were reviewed by Mr. Honn. Mr. L. G. Gaskins , legal counsel, and Mr. John Lang, senior site inspector, for Amoco, were present and commented upon said request. There was no one present in opposition to these requests . Following discussion Commissioner Steinmark made a motion to grant the Special Use Permit, including the development standards with an amendment to development standard #5 . Commissioner Dunbar seconded the motion and it carried unanimously. Commissioner Steinmark made a motion to approve Subdivision Exemption #89 . " The locational requirements for this facility necessitates a site which cannot reasonably be furnished in a municipality. 2 . It is the opinion of the Department of Planning Services staff that the proposed modifications to the existing gas compressor station are in compliance with the provisions of Section 3. 3 (E) (2) of the Weld County Zoning Resolution which states : "The Planning Commission and Board of County Commissioners shall consider the following in making their determination in approving or denying a Special Use Permit: Compatability with the surrounding area, harmony with the character of the neighborhood and existing agri- cultural uses, need for the proposed use, its effect upon the immediate area, its effect on future development of the area, and the health, safety, and welfare of the inhabitants of the area and the county. " This determination is based in part upon the following responses from various referral agencies which have reviewed this request and have set forth no objections to the request: Amoco Production Company SUP-394 :79 : 15 PLANNING STAFF RECOMMENDATION July 3, 1979 1. The Weld County Engineering Department, memo dated May 29, 1979 2 . The Longmont Soil Conservation District, memo dated May 31, 1979 3. Colorado Oil and Gas Conservation Commission, memo dated May 30, 1979 4. Longmont Fire Protection District, letter dated June 7, 1979 5 . Colorado Geological Survey, letter dated June 12, 1979 6 . Tri-Area Planning Commission, memo dated June 13, 1979 The Department of Planning Services staff recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and approved for the Special Use Permit. 2 . No building or electrical permits for the Compressor Station facilities shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been recorded in the Weld County Clerk and Recorder ' s Office. Amoco Production Company - SUP DEVELOPMENT STANDARDS 1 . The permitted uses on the hereon described parcel shall be a compressor station and related facilities and shall be limited to those shown on this plat. 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. The applicant shall be responsible for adhering to the provisions of the Colorado Air Pollution Control Commission Regulation No. 2. 4. Upon termination of the operation of the compressor station, all facilities and structures shall be removed to 30" below grade. The site shall be reclaimed to a farmable state. 5 . Access shall be limited to the two accesses off County Road 11 as shown on the Special Use Permit plans . Once an underground pipe- line is extended to the site for collection of the merchantible oil, the access at the north end of the property shall be terminated and the truck loading rack shall be removed. All access shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 6 . All loading, unloading, and transfer operations shall be installed and maintained in accordance with the Department of Labor and State of Colorado Oil and Gas Conservation Commission specifications. 7. Manual shutoff valves adequately identified shall be installed for both incoming and outgoing oil and gas per the specifications of the Longmont Fire Protection District. 8. A heat shield shall be installed between the valve station and the compressor station in accordance with the specifications of the Longmont Fire Protection District. 9 . At present, a domestic water supply as well as restroom, laboratory or cleaning facilities are not needed at the site. These facilities shall be permitted under this Special Use Permit provided the necessary permits are acquired and the facilities comply with all applicable Weld County and State Health Standards and Regulations. 10 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amend- ment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . Comments : 1. The Weld County Health Department has certain recommendations for the operation which have been incorporated into the attached Development Standards . 2 . While the Tri-Area Planning Commission has no objections to the proposed request, the Commission feels that no further expansion should be allowed beyond this request. 3. To date our office has received one letter from Union Rural Electric Association, a surrounding property owner within 500 feet of the property on which the request has been made. Item 4 - Soil Evaluation Enclosed Item 5 Description of the Existing and Proposed Operation The West Spindle Compressor Station presently consists of three one-thousand horsepower engine-driven compressors designed II to compress low pressure natural gas collected from the area to 430 PSIG. This high pressure gas is transmitted to Spindle Plant, located four miles east of the compressor site. There, natural gas liquids are extracted from the stream to yield a dry gas suitable for residential or industrial use. The compressors are designed to operate 24 hours per day; 365 days per year . Equipment is provided to automatically shut down the compressors and isolate the station from the inlet and outlet gas streams should (1) a malfunction of equipment occur, (2) a gas leak develop in the compressor building, or (3) a fire occur in the compressor building. The compressors are visited by an operator about two hours each day. The proposed additional compressor would be installed primarily to provide replacement compression capability during scheduled and unscheduled maintenance on existing compressors. It too is a one-thousand horsepower engine- driven unit with a capacity very nearly identical to the existing compressors. During normal operations, with all four units available for compression, each would be run at a decreased speed. The availability of this compressor unit for use at this particular station is such that it is not anticipated to remain a permanent installation. As such, no permanent protective housing is planned at this time. The addition of this compressor will cause no noise impact on the surrounding property. The present plant is inaudible in the communities of Dacono, Frederick and Firestone, and the addition of one compressor will not change this situation. Very nearly the same safety equipment would be provided at this unit. The one exception would be the lack of a combustible gas mixture detector which is available in the existing compressor building. These detectors are not effective outside where unpredictable air currents could prevent any combustible gas mixtures from reaching detectors. , - 2 - Operator visitation at the installation would remain essentially the same as present. Scheduled maintenance activities would increase somewhat with the addition of one more unit to be serviced. It is anticipated that unscheduled maintenance activities (repair of equipment failures) would decrease due to a decreased load on the compressors. Item 6 - Methods of Disposal of Sewage (Waste Oil) Waste lubricating oils and liquids collected from the gas gathering pipelines are collected in a storage tank. The liquids are then trucked to Spindle Plant where they are treated to provide a product suitable for delivery to a pipeline receiving station. Item 7 - Water Requirements The addition of a compressor at West Spindle would result in a negligible increase in water requirements. Water usage at this type of installation is limited to that of a closed- system cooler on each compressor unit, plus water used for cleaning purposes. Water is supplied to the station from Spindle Plant. Item 8 - Affected Roads and Their Usage Normal traffic to the site after construction would remain essentially the same as at present. PREDICTION OF NOISE IMPACT DUE TO THE ADDITION OF ONE COMPRESSOR TO THE WEST SPINDLE COMPRESSOR STATION Introduction AMOCO Production Company is planning to add one gas compressor approximately 40 feet north of the present building on the West Spindle Compressor Station site, about one mile west of Frederick, Colorado. The impact prediction was based on measurements made at the site on April 25, 1979 and on Engineering Dynamics Report dated February 14, 1975. Noise Measurements Sound measurements were made at 8 points around the periphery on the existing West Spindle Gas Compressor Station. All three gas compressors were in operation, thus the measurements were similar to thus predicted in the above noted report. The noise from the station is primarily low frequency, below the audible range of frequencies for the most part. It has characteristics similar to normal background sound. That is, it does not contain much high frequency sound which may interfere with speech communication, nor does it contain any whistling, impulsive or screech noise. The noise generated is continuous, without abrupt changes in level, making it more unobtrusive. We conclude that the spectrum of the noise emitted has no characteristic that would make it either noticeable or objectionable, provided the level is low enough. We address the level below. Prediction of New Noise Conditions Anew compressor is to be added to the north of the present building. Since there are already three compressors on line, if the new compressor were added immediately next to them, there would be a 1 dBA increase in sound level at all points surrounding the station. This increase would be undetectable. Because it is not to be located centrally, we calculated new noise contours based on the contours we measured on April 25; both sets of contours are shown in the attached figure. The solid lines are the contours predicted to exist after the addition, the dashed lines are the existing contours. We might add here that these contours are worst case contours, i.e. , cold calm air is at ground level. Most of the time the radius is considerably less. The significance of the contours is as follows: 1. There will be only a small increase in noise impact on the surrounding property due to the addition and then only on the north side. 2. The 50 dBA contour represents the most stringent levels required by the Colorado Noise Abatement Law, i.e. , residential levels at night. Since there are no residences in this area, there is no present impact, nor will the addition cause any impact. 3. The 40 dBA contour is shown only to illustrate the extreme range of audibility of the plant. On a quiet cool night, it may be possible to hear the plant up to that distance. To the west it is about 3900 feet and to the east it is about 1900 feet. As mentioned in the original report, it may be possible for the plant to be heard in the Baum mine area, but we are not aware of any comments on hearing the plant. 4. The Colorado Noise Abatement Law requires for "light industrial zones" that the level be 65 dBA or less at night and 70 dBA or less during the day. The addition of the new compressor will raise the noise level on the north fence line from 62 dBA to 67 dBA. Since the fence is undoubtedly within the property line, it appears that the more stringent 65 dBA criterion will be met after the addition. The addition will make little change on other points of the fence line dynes-systems, inc. -3- . • Conclusions • 1. The addition of a new compressor to the West Spindle Gas Compressor Station will cause no noise impact on the surrounding property. 2. The present plant is inaudible in the communities of Dacono, Frederick, and Firestone. The addition will not change this situation. 3. There will be no additional impact in the Baum mine area in terms of audibility. The levels are such that there is and will be no basis for complaint. 4. None in the surrounding community will receive levels in excess of 55 dBA, the long range goal for noise control set by the US Environmental Protection Agency. 5. Said Parcel of Land contains 3.00 acres, more or less. The surface of the above described tract of land is sometimes referred to herein as the "leased premises." TO HAVE AND TO HOLD the above described surface estate in the leased premises unto Amoco for a term of twenty (20) years beginning on the effec- tive date set out below. In consideration of the premises, Lessee agrees to pay to Lessor, its successors and assigns, the sum of $2,500.00 per year as an annual rental, payable on the effective date and annually thereafter on or before each next succeeding anniversary date. It is agreed by and between the parties that Lessee, its successors and assigns, shall have the full and free use of the surface estate, being the leased premises, for Lessee's oil and gas operations thereon, including, but not limited to, the installation and operation of a gas compressor sta- tion and related facilities. Amoco shall pay all taxes, assessments or charges levied against or payable with regard to the leased property for and during the 20-year term hereof. Dacono warrants and agrees to defend title to the property leased under this agreement from claims of any person or persons claiming or to claim the same. Lessee agrees that it shall keep the leased premises free and clear . of any and all liens, charges or burdens which may or can become superior to the paramount title of Dacono under this Agreement. This Surface Lease Agreement shall bind the successors and assigns of the parties hereto; provided, however, that this Agreement shall in no in- stant be assigned or sublet by Lessee in whole or in part without the prior written approval of Dacono thereto, which approval shall not be unreason- ably withheld.
