Request Board Approval of the Department's subscription renewal with LexisNexis Risk Solutions FI, Inc. for access to the Accurint system. The Department is requesting approval to renew two subscriptions to the Accurint system. This system is used by the Department to locate individuals whose whereabouts and/or identification are not readily available and to conduct thorough background checks. The first subscription will providelt7 users with access to standard features, for a month] flat rate of $488.48. The second subscription will provide 3 of the 37 users with additional access to contact card reports, for an additional monthly flat rate of $315.33. The users decreased from 40 last year, to 37 this year, and users can continue to be added or removed by the Department, as needed. The subscriptions will be for 12 months, with the initial term beginning November 1, 2018, automatically renewable thereafter for additional 12 -month period, with an automatic fee increase of 3% for the next renewal period. The subscriptions were initially entered into in 2014, see Tyler #2014-0483 and 2014-0543. [ do not recommend a Work Session. The LN Services herein shall be provided by LexisNexis Risk Solutions FL Inc. ("LN"). Customer acknowledges that the services provided under this Schedule A are non-FCRA services and are not "consumer reports" within the meaning of the FCRA and Customer agrees not to use such reports in any manner that would cause them to be characterized as "consumer reports" 1. SCHEDULE A TERM The term of this Schedule A will be 12 months beginning November 1, 2018 (the "Initial Term"). Following the Initial Term, this Schedule A shall automatically renew for additional periods of twelve (12) months (each one, a "Renewal Term"), unless written notice of termination is provided to either party at least sixty (60) days prior to the expiration of the Initial Term or any Renewal Term. If an account is activated after the first day of a calendar month, charges will not be pro -rated. 2. FEES: 2.1 Minimum Payment: Customer shall pay to LN each month a flat rate commitment in the amount of $488.48 (the "Flat Rate Commitment"). The Flat Rate Commitment shall include any fees to be paid by Customer for its access and use of any of the LN Services listed herein. 2.2 User ID's: During the Initial Term or any Renewal Term, Customer shall be granted thirty-seven (37) Accurint for Government User IDs. 2.3 Transactional Fees: The attached Price Schedule lists the currently available searches and reports ("Features"), as well as their respective prices ("Transactional Fees"). If during any given month Customer's combined actual use of the LN services listed herein ("Actual Use") exceeds $976.96 (the "Cap"), "), LN reserves the right to renegotiate in good faith the amounts payable under this Schedule A. The Flat Rate Commitment includes unlimited access to all Features, excluding those Features identified herein as Excluded Features. 2.4 Premium Feature Included: Customer shall have access to the following Accurint for Government premium feature as part of the Flat Rate Commitment: Real Time Phone Search 2.5 Features Not Included: The following Features ("Excluded Features") are not included in the Flat Rate Commitment and shall in all cases be charged separately according to the pricing specified in the attached Price Schedule. EXPIRATION Unless otherwise accepted by LN, the terms herein are valid if the Schedule A is signed by the Customer and received by LN on or before November 12, 2018. 4. CONFIDENTIAL INFORMATION This Schedule A contains the confidential pricing information of LN. Customer acknowledges that the disclosure of such pricing information could cause competitive harm to LN, and as such, Customer agrees to maintain this Schedule A in trust and confidence and take reasonable precautions against disclosure to any third party to the extent permitted by local and state law.
