RESOLUTION
RE : SUBDIVISION EXEMPTION NO. 49 - CHARLES TODD - EXEMPTION OF
LAND FROM THE DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED
LAND" .
WHEREAS , the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
CD WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Charles Todd, for an
exemption of land from the definition of "subdivision" and
"subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended,
and Section 2-1 of the Weld County Subdivision Regulations , and
WHEREAS, the Board of County Commissioners finds that
Charles Todd is the owner of the WZ and the Eh of the NEa of
Section 20 , Township 4 North, Range 64 West of the 6th P.M. ,
Weld County, Colorado. Said tract of land being in two separate
80 acre parcels . Each 80 acre parcel has an existing set of
improvements. The applicant, Charles Todd, desires to combine the
two parcels into one, except for the second set of improvements
on a 3. 541 acre tract of land which will result in a single lot
bearing the following legal description, to-wit:
All that part of the Northeast Quarter (v,1/4) of said
Section 20, Township 4 North, Range 64 West of
the 6th P.M. , Weld County, Colorado, being more
particularly described as follows:
Beginning at the Northeast Corner (NE Cor) of said
Section 20 and considering the North Line of the
Northeast Quarter (NE-14) of said Section 20, as
bearing South 89°28'43" West, with all other bear-
ings contained herein relative thereto;
South 89°28'43" along said North Line, 975.70
feet to the True Point of Beginning continuing
South 89°28'43" West 346.19 feet thence South
0°8'27" East 756.45 feet, thence North 31°36'36"
East 639.73 feet, thence North 2°48'49" West 185
feet to the True Point of Beginning.
Said described parcel of land contains 3.541 acres,
more or less, including a strip of ground 30 feet in width along
the North Line of said described parcel of land reserved for
County Road ROW purposes, and is subject to any rights-of-way
or other easements as recorded by instruments of record or as
now existing on said described parcel of land.
WHEREAS, the Board of County Commissioners finds that
combining the two parcels owned by the applicant, Charles Todd,
does not conflict with the intent of the Weld County Comprehensive

Plan, and will not have an adverse impact on the existing use of
the land, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the 3. 541 acre tract
of land owned by the applicant, as described above, be, and hereby
is, declared to be exempt from the definition of "subdivision"
and "subdivided land" as set forth in Section 30-28-101 (10) ,
CRS 1973, as amended, and in Section 2-1 of the Weld County Sub-
division Regulations, and further finds that said 3 . 541 acre tract
shall be considered a single lot.
BE IT FURTHER RESOLVED by the Board that the remaining tract
of land owned by the applicant, Charles Todd, being described as
the Wi and the E' of the NEa of Section 20 , Township 4 North,
Range 64 West of the 6th P.M. , Weld County, Colorado, except that
portion containing a 3. 541 acre tract which is described above,
be, and hereby is, declared to be exempt from the definition of
"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld
County Subdivision Regulations, and further finds that said
parcel is also considered as a single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
September, A.D. , 1977.

regulations adopted September 1972 which defines the term

Comments :
Mr. Todd owns two separate 80 acre parcels in the NW* of
Section 20, T4N, R64W. Each 80 acre parcel has an existing
set .of improvements. Mr. Todd desires to combine the two
parcels into one except for the second set of improvements
on 3. 541 acres of which he has no need.

STATEMENT IN SUPPORT OF APPLICATION FOR
SUBDIVISION EXEMPTION
I am applying for a subdivision exemption on my land so that
I may join two 80 acre parcels into one quarter-section , namely
the N.E. # of Section 20, T4N, R64W and in so doing be able to
sever and eliminate an existing and second set of improvements
currently situated on a plot of 3. 541 acres which I no longer
need and which is described as follows:

particularly described as follows:
