RE: APPROVAL OF REPLAT OF BLOCK 1, WESTRIDGE 5TH FILING AND
AUTHORIZATION FOR CHAIRMAN TO SIGN CERTIFICATE OF VACATION
OF 66TH AVENUE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 29th day of March, 1978, a public hearing
was held before the Board of County Commissioners of Weld County,
Colorado upon the application of David Clark for a replat of Block
1 of Westridge 5th Filing, a subdivision of a portion of the South-
west Quarter of Section 16 , Township 5 North, Range 66 West of the
6th Principal Meridian, County of Weld, State of Colorado, more
particularly described as follows:
Block 1 of Westridge Fifth Filing.
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the re-
quest and the recommendations of the Weld County Planning Commission,
and having been fully informed and satisfied that the proposed re-
plat of Block 1 of Westridge 5th Filing from the previous platted
eight (8) lots into four (4) lots with proposed vacation of the 66th
Avenue cul-du-sac to be replaced by a private access easement and a
utility and drainage easement, conforms in all respects with the
requirements of the Weld County Subdivision Regulations and that the
approval of said replat would be in the best interest of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the replat of Block 1, Westridge 5th
filing, located in that portion of the Southwest Quarter of Section
16 , Township 5 North, Range 66 West of the 6th Principal Meridian,
County of Weld, State of Colorado, more particularly described as
follows: Block 1 of Westridge Fifth Filing, be and hereby is
approved subject to the following provisions which shall appear on
the replat:

1. An undivided one-quarter interest in the access easement,
Tract "C" shown hereon, shall be deeded with each separate
lot in this replat of Block 1, Westridge Fifth Filing.
2. Construction of the roadway within the access easement,
Tract "C" shown hereon, shall be the responsibility of
the fee owners of the entire block. Maintenance of the
roadway within the access easement following construction
and in perpetuity shall be the responsibility of the fee
owners of the individual lots.
3. No building permits will be issued by Weld County until the
entrance driveway within the entire access easement , Tract
"C" , shown hereon, is constructed in accordance with the
road standards for this Planned Unit Development attached
hereto and made a part hereof. The approach to the State
Department of Highways frontage road is to be asphalt
surfaced from the existing north edge of the frontage road
surface to the south end of Tract "C" . A 50 foot turning
radius shall be incorporated into the access approach.
BE IT FURTHER RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Chairman be authorized to sign the
certificate of vacation of said 66th Avenue cul-du-sac right-of-
way on said replat of Block 1, Westridge 5th Filing.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
March, A.D. , 1978 .

We have reviewed the above referenced application and find that hydrocompaction
(settling soils) and high ground water levels could adversely affect residences
or septic systems constructed in the subject area. The fine sands in the sub-
division area probably have relatively low bearing values and may compact when
wetted and/or loaded. We recommend that soils foundation investigation be con-
ducted for each residence so that the foundations can be properly designed.
High ground water levels could adversely affect residence construction and septic
system feasibility. As noted in the report prepared by Hogan and Oihausen, Inc. ,
water level measurements in July, 1974 indicated ground water levels of 6.8 and
9.0 feet. These water levels could be raised by lawn irrigation and thus could
wet basements or cause a malfunction of a standard septic system. We recommend
that basement construction be avoided unless a perimeter drain system and special
construction techniques are used. Additionally, we recommend that an evapor-
transpriation or other type of sealed system be required or that the subdivision
be "hooked-up" to a public sewer system.
Until the above items have been addressed and incorporated into the preliminary plat,
we cannot recommend approval of this application.

Re : Replat, Block 1, Westridge Fifth
The Planning Commission, at its March 14 meeting, voted to recom-
r ment denial of the Replat of Westridge Fifth requested by Mary
Erikson. As the attached Administrative Review Team minutes indicate,
the staff explained the following concerns to the Commission :
1. Replat does not comply with Subdivision Regulations which
require that each lot have access to a public street.
2 . At a time when municipal sewer and drainage facilities are
available, and the area becomes more heavily urbanized, it
should be anticipated that further subdivision of the large
Westridge parcels will occur. The proposed access ease-
' ment does not provide adequate circulation for the densities
anticipated in the S.W. Quarter of Section 16 .

The proposed replat is of an area approximately 22 acres in
size that is currently platted for development of eight lots
and a 60 foot wide cul-de-sac extending north from the Highway
34 Bypass Frontage Road a distance of approximately 1100 teet.
Because of a high water table in the area , development of eight
lots would require extensive underdrain improvements . The replat
was submitted to reduce the density to four lots ranging in size
from 21 acres to 51 acres . A study by the engineering firm Hogan
and Olhausen indicates that at the reduced density the costly under-
drain system would not be needed. With the proposed replat , the
66th Avenue cul-de- sac would be replaced by a utility drainage and
access easement .
Staff noted that the private access easement does not comply
with subdivision regulations which require that all lots have
access to public streets . In addition , staff noted that this
quarter section is being platted without sufficient regard for
circulation between subdivisions . The existing cul-de-sac is
not desireable because of its length . However , staff recom-
mends that if a replat is under consideration, 66th Avenue should
be extended westward into the residential street stub in the
Peterson Subdivision.
Staff also advised that the size of the proposed lots are such
that resubdivision at some future date may he difficult . This is
a situation similar to Alles Acres , ywhere large rural lets
become excessive in an urban setting. It would be anticipated
that the 21 acre lots proposed in the renlat would at some future
date be requested for further subdivision and problems of access

Fifth Filing and have one comment - we feel that any residents who purchase
these sites should be informed that the school buses will not drive down

The Colorado Division of Highways has reviewed the Subdivision Replat of
Block 1 of Westridge Fifth Filing from Mary Eriksson. Our comments on this
matter relate to the paving of the approach to the frontage road and application
for a Driveway Permit.
We ask that the area between the edge of the frontage road and the property
be paved. This will insure that the edge of the frontage road will not be
deteriorated by vehicles entering and leaving the subdivision. An extension
of the Typical Roadway Section shown on the plan submitted will be adequate
for this purpose. A 50-foot turning radius -should be incorporated into the
access approach.
A Driveway Permit will need to be •issued for construction of a driveway.
This permit is available through Mr. David N. Fraser, District IV Maintenance
Superintendent, P. 0. Box 850, Greeley, Colorado 80631 . Application for the
permit should include four copies of a drawing or sketch giving details of
construction as well as the distance from the section corner, State Highway,
or physical objects. Application should be made 90 days prior to construction.
We appreciate the opportunity to review this plat and would be glad to
provide further information if necessary.

The following comments are in regard to request for review of Sub—
division Replat of Block 1 of Westridge 5th Filing, Weld County,
Colorado located in portion of the S'-z Section 16, Township 5N
Range 66W.
The major part of the replat request is changing Block 1 from
eight lots to four lots . The original plat also called for a
subsurface drain system to be installed so that basemented dwellings
could he constructed. The attached report "Block 1, Westridge Fifth
Filing, Weld County, Colorado — Investigation to Determine The Effect
of Eliminating A Proposed Subsurface Drain" prepared by Hogan and
Olhausen, Inc. , Loveland, Co. , seems reasonable and specific as to
the need for a subsurface drain. Their recommendations as to precise
site investigation prior to building should be followed. Building
type, such as, slab on grade, crawl space or basement should only be
determined after thorough site investigation to determine soil engi-
neering data. In addition, it should be recommended that the soil
water table be monitored this summer to provide more current data.
Data used in the report was collected in December 1972 and summer
1974 and therefore may not reflect current conditions. On site water
table measurements will be needed to determine the proper septic system
design. The larger lot size provided by the replat should allow for
easier building site selection to avoid physical restraints.
Since a copy of the original drainage plan was not included with re-
quest, it is difficult to' evaluate whether consideration was given
to direction of flow of underground water. If the main flow is from
the south to the northwest and if that flow is not intercepted as
shown in the original plat, it is doubtful if a subsurface drain system
north of Block 1 will be effective.

1. Replat of all of Westridge 5th Filing should be considered.
Sixty-sixth (66th) Avenue could be extended to the west for
better future traffic circulation when the density in this
area increases . The alignment of 24th Street could be
reconsidered because of development pressures to the west .
If it is feasible to eliminate the sub-surface drainage system
in Block 1 by revising its lot layout to provide suitable
building sites , the same consideration should be given to
Block 2 at this time .
2 . The Engineering Department agrees with the city' s concern
regarding access to a public right-of-way. It would be
essential if 66th Avenue were to connect to 24th Street . It
has been the County' s experience when private roads
have been granted , it is only a matter of time until the
residents petition to have the County accept them.
