My husband just finished telling me about his trip home from the King Soopers on Firestone Blvd in Firestone. CO. He
was pulling out of the parking lot onto Firestone Blvd. but, stopped when he saw how fast a dump truck was coming at
him....eastbound on Firestone Blvd. The dump truck was pulling a trailer with a skid steer on it. The license plate on the
dump was not visible, but the license plate on the trailer (which was not legally wired for a light) was 628-ROX. My
husband then pulled out onto Firestone Blvd and decided to try and catch up to the dump truck 50+ MPH in a 45 zone!
The dump turned south onto CR 15 and his speed increased to 55+ and was swerving. The dump did stop at the stop
sign to CR 20, turned left and proceeded east to Apache Rd, then sped down the block to the address of 9231 Apache
Rd.
We live at 7501 CR 20, Casa Grande Estates. We have heard from other neighbors about the unsafe driving by the dump
trucks being used at the Apache Rd address. Now, we have our own proof why we are adamantly against this business
going into our neighborhood!
We are also adamantly against the second house they built being allowed to stay, which we explained at the meeting on
April 3rd.

PROTECTIVE COVENANTS
On the following described property situated in the County of Weld and State of Colorado, to wit:
That part of Secticn 17, Township 2 North, flange 67 West of the Gib I'.i;l., known as Casagrande Estates Sub-
division.
KNOW ALL MEN BY THESE PRESENTS, THAT THE MILLER "640," A LIMITED PARTNERSHIP, legal owner of
Lots 5, G, 7, Block 1; Lots 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, Block 24; Lots 1, 2, 3,
Block 3; Lots 1, 2, 3, 4, 5, 6, Block 4 and Tracts A, B, C, and D, Casagrande Estates Subdivision; Courtsquaare Investment
Co., a Colorado corporation, owner of Lots 1, 2, 3, Block 1 and Lots 1 and 2, Block 2, Casagrande Estates Subdivision; and
Garaltl D. Kinzie and Vicki I. Kinzie, owners of Lot S, flock 1, Casagrande Estates hereby declare, represent, agree, restrict and
covenant that the use, enjoyment and ownership of the above -described real property shall be and is hereby restricted, limited,
conditioned and protected by the imposition of the following restrictions and limitations, to -wit:
1. LAND USE: No part of' the above described real property shall be occupied or used by any owner thereof for any
use other than residential purposes.
2. BUILDING TYPE: No building shall he erected, altered, placed or permitted to remain on any lot other than one
single family dwelling not to exceed two (2) stories in height and a private garage for not more than three (3) cars. The dwell-
ing must be completed within one (1) year cf commencement of construction.
3. THE MINIMUM AREA OF DWELLINGS SHALL BE AS FOLLOWS: No one-story ("ranch -style") house shall be
erected on any part of the above -described property unless the ground floor area thereof shall be a. minimum of 912 square feet.
In the case of a structure of bi-level or two-story coittruction, the ground level of said structure must have a minimum area of
864 square feet. In the use of a structure of "split-level." "multi -level," or "tri-level" construction, the ground level (main
level) and the upper level (or level immediately above the ground level in the case of a multi -level house) must have a total
minimum area of ,912 square feet. Garages, basements, crawl spaces, an unenclosed or screened spaces such as porches, breeze-
ways, or carports are excluded from the computation of such area.
4. BUILDING LOCATION: No dwelling structure shall be located on any site nearer than fifty (50) feet to the front site
line. No dwelling structure shall be constructed on any site without the specific approval of the architectural control committee.
5. ARCHITECTURAL CONTROL COMMITTEE: No building shall be erected, placed, or altered on any site until tho
construction plans and specifications and a plan showing the location of the structure have been approved in writing by the
Architectural Control Committee as to quality of workmanship and materials, harmony of exterior design with existing struc-
tures, and as to location with respect to topography and finish grade elevation. No fence or wall shall be erected, placed, or al-

E. Spence, and John W. Butcher, all of 1331 Spruce Street, Boulder, Colorado. A majority of ,the Committee may designate
a representative to act for it. In the e\ ent of death or resignation of any member of the Committee, the remaining members
shall have full authority to designate a successor. Neither the members of the Committee, nor its designated representatives
shall be entitled to any compensation for services performed pursuant to this covenant. At any time after two years from the
date of the recording of these covenants by the Weld County Clerk and Recorder, the then record owners of a majority of the
lots shall have the power, through a duly recorded written instrument, to change the membership of the Committee or to
withdraw from the Committee or p 'ester° to it any of its powers and duties. In the event the Committee or its representative
fails to act in regard to plans and spec!f'ications submitted to it within 30 days after plans and specifications have been sub-
mitted to it, or in any event if no suit to enjoin the construe tion has been commenced prior to the completion thereof, am
proval will not be required and the related covenants shall be deemed to have been fully complied with.
6. DWELLING MATERIALS: No residence shall be built of any kind of material that ts commonly known as "boxed"
or "sheet metal" construction unless the same shall be covered over upon the outside walls with weatherboard, siding, brick,
stone, or other equivalent veneer material. Any building placed, erected, or maintained upon any lot in the tract shall be
entirely constructed thereon, and the same shall not, nor shall any part thereof, be moved or placed thereon from elsewhere.
If outbuildings are constructed, they will be constructed of a similar design and quality so as to be in conformity with the
principal dwelling units located on the property.
7. TEMPORARY STRUCTURES: No structure of a temporary character such as a mobile home, trailer, shack, barn, or
outbuilding shall be used as a permanent residence, except that a mobile home may be occupied on a temporary basis for a
period not to excoed six months while a permanent dwelling is under construction and only if the builder occupies the mobile
home while the permanent dwelling is under construction an d provided that the occupant of the mobile home has obtained
a building permit from Weld County and has otherwise corn plied with Weld County rules, regulations and procedures re-
garding occupancy of mobile homes for the purpose of building a permanent dwelling.
8. NUISANCES: No noxious or offensive activity shall be carried on upon any lot, nor shall anything be done thereon
which may be or may become an annoyance or nuisance to the neighborhood.
9. SANITARY FACILITIES: Sanitary facilities shall be approved by local health authorities, and be within the dwelling
except for outflow lines and leaching fields. Privies, outhouses, Chemical toilets, etc., are expressly prohibited.
10. AGRICULTURAL AND LIVESTOCK ACTIVITIES: Nurseries, greenhouses, and the grazing of livestock shall be per-
mitted provided offensive odors and dust are confined to the premises. The architectural control committee shall have the
authority to recommend the installation of such procedures and equipment as may be necessary to fulfill the intentions or
these covenants regarding odors and dust. All agricultural ac tivities and any raising of livestock must be incidental to, and a
part of, the normal residential land usa of the property and not be commercial in pal ure; sale of agricultural products and
livestock shall be restricted to incidental purposes. Commercial feed lots or yards are hereby expressly prohibited. Animal
pens, stalls, cages, and enclosures shall be maintained on a regular basis to assure a neat and orderly appearance and a clean
and health atmosphere. Animal enclosures shall be subject to the terms and conditions of paragraph G (Dwelling Materials) as
herein provided.
11. NO TRAILERS, FARM MACHINERY OR MOTOR VEHICLES of any kind, including cars, trucks, tractors, motor-
cycles, or the like, may be stored, junked or otherwise maintained in an idle or unworkable condition. Only those vehicles and
machines of good running condition which are currently licen sed and registered are permitted.
12. NO LOT SHALL BE USED OR. MAINTAINED AS A DUMPING GROUND for rubbish, trash, garbage, or any other
form of solid, semi -solid, or liquid waste. Waste shall not be kept except in sanitary containers. All facilities for the storage
or disposal of waste materials shall be kept in a clean and sanitary condition.
13. WHERE LIVESTOCK IS KEPT, animals and corrals must be sprayed to control insects.

14. EACH LOT MUST BE KEPT IN NEAT APPEARANCE: Weeds must be kept cuton all grounds including grounds
notused for lawns or gardens.
15. EASEMENTS RESERVED: Eas. ments for installation and maintenance of utilities and drainage facilities are re-
served as shown on the recorded plat.
16. SIGNS: No sign of any kind shall be displayed to the public view on any part of the above -described property ex-
cept one professional sign per dwelling of not more than 10 square feet in area, one sign of not more than 5 square feet adver-
tising a dwelling for sale or rent, and signs used by a builder to advertise dwellings or a dwelling during the construction and
sales period.
17. 'OIL AND MINING ACTIVITIES: No oil drilling, oil development operations, oil refining, quarrying or mining opera-
tions of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be
permitted upon, in or under any lot. No derrick or other structure designated for use in boring for oil or natural gas shall be
erected, maintained, or permitted upon any lot.
18. TERM: The restrictions and limitations

shall be binding upon all parties and all persons claiming any part of the above described real property under said parties to
these covenants for a period of twenty-five (25) years from date these presents are recorded in the Office of the County Clerk
and Recorder of Weld County, Colorado, after %which time they shall automatically be extended for successive periods of
ten (10) years unless an instrument signed by
the then owners of a majority of the real property hereinabove described has been
recorded in the office of the said County Clerk and Recorder agreeing to change said covenants in whole or in part.
19. ENFORCEMENT: The owner of owners of any of the above -described real property may enforce the restrictions
and limitations herein set forth by proceeding at law orequity against any person or persons violating or attempting to violate
any of the said restrictions and limitations either to recover damages for such violation or to restrain such violation or at-
tempted violation.
20. SEVERABILITY: V E R A B I L I TY : Invalidation or modification of any one of these restrictions and limitations herein set forth by
judgment, Court Order, State or County planning authority, or the like, shall in no way affect any of the other provisions
which shall remain in full force and effect.
21. APPLICABILITY: Each paragraph of the restrictions and limitations as set forth herein shall apply to all lots or
portions of lots contained within the exterior boundaries of Casagrande Estates.
22. APPEARANCE OF LOTS: Each lot at all times shall be kept in a clean, sightly, and wholesome condition. No
trash, litter, junk, boxes, containers, bottles, cans, implements, machinery, lumber, or other building materials shall be permitted
to remain exposed upon any lot so they are visible from any neighboring lot or streets except as necessary during the period of
construction. In the event any structure is destroyed, either wholly or partially by fire or any other casualty, said structure
shall be promptly rebuilt or remodeled to conform with these covenants; or if the structure is not to be rebuilt, all remaining
portions of the structure, including the foundations and all debris, shall be promptly removed from the property.
No elevated tanks of any kind shall be erected, placed, or permitted upon any part of said property. Any tanks used
in connection with any residence constructed on said property, including tanks for storage of gas or oil, must be below
ground. Ail 1 pcs of rcfrigerathig, cooling, or heals it; apparatus must be concealed. No garbage or trash cans or receptacles
shall be maintained in an exposed or unsightly manner.
