ON A TEMPORARY BASIS DURING CONSTRUCTION AND REMOVED POST
CERTIFICATE OF OCCUPANCY IN THE A (AGRICULTURAL) ZONE DISTRICT -
MOUNTAIN VIEW FIRE RESCUE DISTRICT
A public hearing was conducted on November 7, 2018, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 27, 2018, and duly published
October 2, 2018, in the Greeley Tribune, a public hearing was conducted to consider the request
of Mountain View Fire Rescue District, for Uses similar to the uses listed as Uses by Special
Review as long as the Use complies with the General Intent of the A (Agricultural) Zone District,
(vehicle service/repair establishment for emergency vehicles) including up to five (5) construction
trailers and ten (10) conex storage containers used on a temporary basis during construction and
removed post certificate of occupancy in the A (Agricultural) Zone District. Frank Haug, Assistant
County Attorney, made this a matter of record.
12 Chair Moreno reviewed for the applicant and the public, the procedures to follow should this
case result in a tie vote due to four Commissioners being present and Commissioner Cozad
excused.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated the site is approximately four (4) acres and provided the adjacent County roads. He
mentioned there is a Special Use Permit for a communication tower, and a Class II groundwater
disposal well located immediately adjacent to the east of the site. He indicated the site is within
the three (3) mile referral area of the City of Dacono, and the Towns of Erie and Fredrick. He

stated the Town of Erie returned a referral which indicated an Access Permit is required, and
potential additional requirements. Mr. Ogle reviewed the locations of adjacent residents and
stated no letters or phone calls had been received from surrounding property owners (SPO)
regarding the application. He indicated the applicant is proposing to construct a new emergency
vehicle maintenance shop to replace the existing shop. He provided the hours of operation, and
stated the shop will employ up to five (5) emergency vehicle technicians. He indicated there will
be up to 25 people visiting the site on average and described the surrounding land uses. He stated
16 referral agencies reviewed the application and four (4) offered comments that were addressed
through the Conditions of Approval and Development Standards. He provided images of the site
and surrounding views and entered the favorable recommendation of the Planning Commission
into the record as written.
Evan Pinkham, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements and stated the site accesses onto County Road (CR) 7
which is maintained by the Town of Erie. He mentioned the applicant will need to work with the
Town of Erie regarding access and any other improvements the town may require. He indicated
the Department of Public Works is requiring proof of an access permit, if applicable, and a Final
Drainage Report. He stated if the applicant is disturbing more than an acre, a Weld County
Grading Permit will be required. Mr. Pinkham presented the drainage and grading requirements.
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provision, stating the Left Hand Water District provides water, they will be installing a commercial
septic system, and in the future they may get a tap from the St. Vrain Sanitation District. She
mentioned the septic system will need to be installed prior to the Certificate of Occupancy. She
indicated there will be fuel storage onsite with secondary containment, and any floor drains are
not permitted to drain to the septic system. Ms. Light stated there is a Commercial noise standard
and Development Standards #8-22 address Environmental Health items.
12 Steve Stienbecker, represented the applicant, thanked staff and provided history of the
proposed project. He indicated there will be a need for a fire station which will pair with the
proposed facility. He stated the applicant agreed with the conditions as provided.

12 In response to Chair Moreno, Mr. Steinbicker reiterated they agree with the proposed
Conditions of Approval (COA) and Development Standards (DS).
12 In response to Commissioner Kirkmeyer regarding spill control, Mr. Steinbicker explained
this will be a facility with different fluids within the fluids and mentioned the spill control is mainly
for the secondary containment for the gas. In response to Commissioner Kirkmeyer regarding
landscaping and screening, Mr. Ogle stated there is an outside storage component to the east of
the fire station that Planning staff has asked the applicant to screen. Commissioner Kirkmeyer
suggesting adding "of the outside storage area" to COA #1.D.5 regarding the landscaping and
screening. Commissioner Kirkmeyer recommended deleting DS #3 concerning the hours of
operation and the Board agreed. Commissioner Kirkmeyer suggested adding the word "existing"
and deleting "screening"in DS#7 regarding the landscaping, and creating a new DS#8 regarding

the screening of the outside storage area. Commissioner Kirkmeyer also suggested deleting DS
#16 regarding the noise levels. The Board agreed.
In response to Chair Moreno, Mr. Steinbicker indicated they have reviewed, and agree to
abide by, the Conditions of Approval and Development Standards, as amended.
Commissioner Kirkmeyer moved to approve the request of the Mountain View Fire Rescue
District for a Site Specific Development Plan and Use by Special Review Permit, USR18-0076,
for Uses similar to the uses listed as Uses by Special Review as long as the Use complies with
the General Intent of the A (Agricultural) Zone District, (vehicle service/repair establishment for
emergency vehicles) including up to five (5) construction trailers and ten (10) conex storage
containers used on a temporary basis during construction and removed post certificate of
occupancy in the A (Agricultural) Zone District, based on the recommendations of Planning staff
and the Planning Commission, with the Conditions of Approval and Development Standards as
amended and entered into the record. The motion was seconded by Commissioner Conway, and
it carried unanimously. There being no further discussion, the hearing was completed at 10:16
a.m.
This Certification was approved on the 14th day of November, 2018.
