RESOLUTION /_/
WHEREAS, a public hearing was held on February 2, 1976, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing a petition of the Weld County Planning Commission
requesting a change of zone from "C" Commercial District to "A" Agricultural
District of a parcel of land described as follows:
The East Half of the Southeast Quarter (EZSEq) of Section
10, Township 2 North, Range 68 West of the Sixth P. M. ,
Weld County, Colorado, and
WHEREAS, the Petitioner was present, being represented by the
Weld County Zoning Administrator, Mr. Thomas Honn, and
WHEREAS, this area was rezoned from "A" Agricultural District to
"C" Commercial District on or about June 26, 1963, by Resolution of the Board
of County Commissioners with certain conditions, and
WHEREAS, by Resolution adopted June 13, 1973, the Board did extend
said zoning of "C" Commercial District to June 1, 1974, on condition that the
then owners of the land proceed with due diligence to effect development of the
area so rezoned; otherwise, that the Board would, for good cause shown, on
its own motion revert the area to its original zoning, and
WHEREAS, PURSUANT TO NOTICE a hearing was held on August 28,
1974, on the matter of development of said area, and for good cause shown,
the matter of development of the area was continued and extended until November
20, 1974, for further progress report of development, if any, and
WHEREAS, a considerable period of time has passed and to the present
time there has been no evidence of any development on this land so rezoned, and
WHEREAS, the Weld County Planning Commission has requested and
recommended that this area be rezoned Agricultural, as originally zoned, and
WHEREAS, the Board has carefully considered the petition, evidence,
testimony, and recommendations of the Weld County Planning Commission,
and given the same such weight as in its discretion deems proper, and is now
fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of the Weld
County Planning Commission for rezoning of the hereinabove described
property, from "C" Commercial District to "A" Agricultural District be
granted and that said area be, and it hereby shall, revert to Agricultural
District, as originally zoned.
