All work shall be in conformance to the Town of Hudson' s Standards and Specifications, approved construction, and traffic control plans. 2. All paving shall conform to the Standards and Specifications for Road and Bridge Construction, Colorado Department of Transportation, 1999 Edition or as amended. 3 . Prior to digging, please call Utility Notification Center of Colorado (811 ) 4. The contractor is required to schedule a proof rolling of sub-grade prior to installation of sub-base, asphalt or concrete pavement material . 5 . The applicant will be required to schedule a final inspection as outlined on this permit. Failure to complete the final inspection and correct any discrepancies within 30 days of the completion date as shown above will result in forfeiture of the applicant' s deposit and a revocation of the permit. 6. The applicant shall carry and maintain in full effect at all times commercial general liability insurance, including broad form property damage, completed operations contractual liability, explosion hazard, collapse hazard, underground property damage hazard, commonly known as XCU, for limits not less than one million dollars ( L000,000) each occurrence for damages of bodily injury or death to one or more persons; and five hundred thousand dollars ($500,000) each occurrence for damage to or destruction of property. 7. Applicant shall not be obligated to hold harmless or indemnify the Town for claims or demands to the extent that they are due to the negligence or will full and wanton acts of the Town or any of its officers, employees, or agents. 8 . Before a public right-of-way permit is issued, the applicant shall file with the Town a bond or letter of credit, at the applicant' s choice, in favor of the town in an amount equal to the total cost of construction, including labor and materials but excluding the cost of any facilities being installed, or five thousand dollars ($ 5 ,000), whichever is greater. The bond or letter of credit shall be executed by the applicant as principal and by at least on surety upon whom service of process may be had in the state, The bond or letter of credit shall be conditioned upon the applicant fully complying with all provisions of Town ordinances, resolutions and regulations, and upon payment of ail judgments and costs rendered against the applicant for any violation of any Town resolution, regulation or ordinance or state law arising out of any negligent or wrongful acts of the applicant in the performance of work pursuant to the permit. 9. This pipeline will carry crude oil through the Town boundary from south to north a . The WCR 16 crossing location is 1 ,065 feet west of WCR 51 b . The minimum pipe cover is 4' within the floodplain (cut & cover construction ) c, The maximum operating pressure is 1,480 pounds per square inch gage ( prig ) d . Operating temperature of 100 degrees ( Fahrenheit) e . The pipeline will be bored under the WCR 16 right-of-way at a depth of 10' to 11' below the existing grades f. Pipeline markers will be installed on each side of the Town's right-of-way g . WCR 16 will not be closed during the construction of this pipeline 3 . DJ South Gathering, LLC has obtained easements from private property owners to construct and operate this pipeline 4. No permanent fill will be placed within the Jim Creek floodplain and the area will be restored to pre- project contours 5 . The proposed Pipeline involves the construction of a 16-inch diameter carbon/steel pipeline that will transport crude oil beginning at the proposed crude oil delivery point facility known as " Bennett Station" located in Adams County. The Pipeline will travel north from " Bennett Station" into unincorporated Weld County, entering Weld County just north of the intersection of Weld County Road 57 and Weld County Road 2. At this point, the Pipeline will continue to travel in a general northwest direction through the Town of Hudson jurisdictional boundaries and Town of Hudson maintained County Road 16 Right-of-Way . The Pipeline will traverse approximately 21 miles in a general northwest direction through Weld County and then end at the existing oil and gas transloading and storage facility (Destination Point) located southwest and adjacent to the intersection of Weld County Road 49 & Weld County Road 30 . Project Location Information : Tetra Tech has accounted for one ( 1 ) Town of Hudson Right-of-Way crossing in the overall Pipeline project . The portion of the Pipeline that will cross the Town of Hudson's maintained County Road 16 Right-of-Way is generally located in the SE Y4 of Section 30, T2 N , R64W of the 6th P . M . Weld County , Colorado. More specifically, the crossing site is proposed to be located approximately 1 , 065 feet west of the Weld County Road 51 and Weld County Road 16 intersection (see Map Figure 1 ) . Applicant Information : DJ South Gathering , LLC is the operator of the facility/pipeline . Tetra Tech is preparing and submitting the application on behalf of the applicant. Pipeline construction will be completed within a permanent pipeline easement. There is one ( 1 ) parcel within the mapped floodplain zone that will be crossed by the proposed pipeline in the Town of Hudson's jurisdictional boundaries. ICJ South Gathering, LLC has obtained easements to construct and operate their proposed pipeline across this subject property. Attached in the application materials is a copy of the recorded easement agreement and the application for this Floodplain Permit has been signed by the land owner being Mr. Lloyd Land. The applicant is .DJ South Gathering, LLC. Articles of Incorporation for ICJ South Gathering, LLC are attached and a certificate of good standing for the LLC, from the Secretary of State is also attached, DJ South Gathering, LLC and its construction general contractor (TBD), will be constructing the pipeline and will be responsible for conducting the work in accordance with the permit conditions. DJ South Gathering, LLC Authorized Agent has signed the permit as the applicant. Construction is expected to begin as soon as all permits are approved and no specified date for start of construction has been given at this time. The "Jim Creek" floodplain is designated as Zone A. Map Figure 1 depicts the pipeline route where it crosses the FEMA "Jim Creek" floodplain and the Town of Hudson's Municipal boundaries. Map figure 1 also shows the individual extent of the floodplain at the pipeline crossing locations and the parcel data for affected property owner crossed by the pipeline in the floodplain, Map Figure 2 Shows the remainder of the length crossed in the FEMA "Jim Creek" floodplain and the parcel info for that area crossed, which is located entirely in unincorporated Weld County. The pipeline will be constructed under the "Jim Creek" floodplain by a general contractor. Installation in the mapped floodplain will be primarily constructed by trench and cover technique and underground bore where needed. No permanent fill will be placed within the floodplain boundaries and areas will be restored to the pre-project contours. The pipeline will not change base flood elevations and is not expected to cause undue harm to utilities with proper construction methods. There is no proposed above-ground equipment along the pipeline route located in the designated floodplain crossing areas. The route and course of the right-of-way and easement conveyed hereby ("Right- of-Way Lands") are more generally depicted on Exhibit "A" attached hereto and made a part hereof. The width of the Right-of-Way Lands is Seventy feet (74') during construction, and subsequent to construction the width of the Right-of- Way Lands is Thirty feet (30'). If there is a deviation in the Right-of-Way Lands as constructed, then DJSG shall record a Notice of Pipeline Location along with an as-built survey plat to amend the description of the Right-of-Way Lands. DJSG shall not install permanent above ground surface appurtenances without the written consent of Grantor, which consent will not be unreasonably withheld by Grantor. Notwithstanding the foregoing, DJSG shall be allowed to install pipeline markers, test leads, corrosion control devises, and other above ground surface appurtenances as required by federal, state or governmental regulations. 2.. ` erne*rte Work Specs During construction of the pipeline(s) or future operations DJSG may require, from time to time, additional temporary work space parallel and adjacent to the Right-of-Way Lands to construct, maintain, inspect, operate, repair, replace, alter, modify, reconstruct, mark, monitor, abandon or remove the pipeline together with ail appurtenances. Grantor agrees to negotiate in good faith DISG's use of such additional temporary work space as reasonably necessary to conduct such tasks in exchange for reasonable additional compensation. Any additional temporary work space requested by DJSG located outside of the width of the Right-of-Way Lands during construction shall terminate no later than 90 days after initial disturbance, 3. Pipeline Depth and Reclamation. At the time of construction and installation, the pipeline will be buried at a depth of not less than sixty inches (60") below the surface of the ground. To the extent reasonably practicable and within a reasonable period of thne after completion of construction, DJSG shall level, restore, compact, reseed and reclaim any lands affected by DJSG's operations to the condition that existed at the time immediately prior to the placement of DJSG ' s pipeline. DJSG agaves to warranty all reclamation work on Grantor's lands for a period one year after completion of initial reclamation . DJSG shall bore under all cement or other ditches, canals, runways and taxiways serving the subject property, =less otherwise approved by Grantor, which approval shall not be unreasonably withheld. DJSG shall repair and/or restore any fence(s) on or adjacent to the Right-of-Way Lands that are removed or severed by DJSG during the course of the operations provided for in this Grunt to the condition such fence was in prior to its removal or severance by DISC'.. If necessary to prevent the escape of Grantor' s livestock, DJSG shall construct temporary gates or fences in those areas affected by MSG ' s operations as provided for in this Grant. 4. Warranty. Grantor represents to DJSG that Grantor is the sole owner in fee simple of the Right-of-Way Lauds subject to the burden of this want and that Grantor has full right, power and authority to enter into this Grant. Grantor makes no warranty of title. 5. Surface Modification. DJSG shall have the right from time to time to cut, mow, or otherwise remove all trees, undergrowth, vegetation, and other obstructions from the Right-of-Way Lands or temporary work space that in its judg;rnent may injure, endanger, or interfere with the exercise by DJSG of the right, privileges and rights-of-war and easements hereby granted. Grantor agrees not to increase or decrease the since elevation on the Right-of-Way Lands without DJSG's prior written permission, which shall not be unreasonably withheld. Grantor agrees not build, create, construes permit to be built, any obstruction, building, fence, reservoir, engineering works or other structures or improvements over, under, on or across the Right-of-Way Lands without the prior written consent of MSG, which shall not be unreasonably withheld. Notwithstanding anything to the contrary contained herein, if any proposed obstruction, building, fence, reservoir, engineering works or other structures or improvements proposed by Grantor endanger the integrity or safety of the pipeline provided for herein or prohibit or create an unnecessary burden on DJSG ' s ability to safely operate its pipeline, DJSG, in its sole discretion, shall have the ability to withhold consent to build such obstruction, building, fence, reservoir, engineering works or other structures or improvements. 6. Consideration and Rcirnhr?n Gana.
