RE: APPROVAL OF RECORDED EXEMPTION NO. 346 - GRACE E. CARLSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 30th day of October, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 346, being the property of
Grace E. Carlson, described as the South Half Southeast Quarter
and the Northeast Quarter Southeast Quarter of Section 14, Town-
ship 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows:
The South Half of the Southeast Quarter and the
Northeast Quarter of the Southeast Quarter all
in Section 14, Township 5 North of Range 65 West
of the 6th P.M. , County of Weld, State of Colorado.
The above described parcel is subject to existing
right of way for Highway 34 along the Southerly
side thereof.
The above described parcel contains a gross acreage
of 120.0 acres Wore or less.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owend by Grace E. Carlson, be and hereby is, exempt

pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, provided that 50 feet be reserved for a right-of-way

RE : Recorded Exemption 346
Dear Commissioners:
The attached application, plat , and related items are in reference
to a request by Mrs. Grace E. Carlson for a recorded exemption .
The parcel of land under consideration is described as the S§SE*
and NEQSE4 Section 14, T5N, R65W of the 6th P. M. , Weld County,
Colorado. The property contains approximately 120 acres of Class
II , IV, VI and VII irrigated soils. The request is to split the
property into parcels of 6. 88 acres and 113 acres , more or less.
The property is located approximately 1-1/2 miles southeast of the
City of Greeley on the north side of U. S. Highway 34.
The intent of Mrs. Grace Carlson is to convey the title of the 6. 88
acre parcel to Mr. Ed Carlson, Grace Carlson' s son , for financing
and estate planning purposes. Ed now lives on the farm and is en-
gaged in the farming operation. He would like to build a new house
on the 6. 88 acre parcel and remove the existing residence which is
presently located on this parcel .
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The proposed split conforms with the intent clause of the re-
corded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) , the intent clause of the Agricultural
Zone District (Section 3 . 3 A. of the Weld County Zoning Reso-
lution) , and the Weld County Comprehensive Plan in that the
uses will be compatible with surrounding agricultural uses.
The request will allow agriculture and related uses to be the
predominant land uses. The existing improvements area will be
utilized for the construction of the new residence. There will
no reduction in the amount of land currently being used for
agricultural production.

2. The Greeley Planning Commission has set forth no objections to
this request .
3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
The Greeley Planning Commission has, in a letter dated October 26,
1978, requested that 50 feet be reserved along the east lot line of
Lot B for a future arterial street . The Department of Planning
Services Staff is requesting that the recorded exemption plat be
amended to show a 50 foot future right-of-way reservation as re-
quested by the Greeley Planning Commission. This should be accom-
plis prior to recording the recorded exemption plat .

Dear Mr. Cunliffe:
We have reviewed the application for a Recorded Exemption from Grace
Carlson. We have no objections to the exemption; however, we would note that
the applicants may want to give consideration as to the location of the home
in order to mitigate noise impacts. The area of the requested exemption is
presently bounded on the south by State Highway 34 and in the future would
be bounded on the north by the extension of S.H. 34 when it is constructed.
To provide for adequate protection from highway-generated noise, our normal
setback recommendation for residential buildings is 150 to 200 feet from the
centerline of the highway.

Planning Commission recommended no objection. The Commission did,
