I, FARFRUMWURKIN, LLLP;Hwy 52, LLC; James Gary Eddleman and Barbara K. Eddleman; and Kenneth L.Schell and Judith Ann Schell, the undersigned landowners, in accordance with Colorado law, hereby petition the Town of Frederick and its Board of Trustees for a serial annexation consisting of two parts to the Town of Frederick of the following described unincorporated territory located in the County of Weld and State of Colorado, to -wit: See Exhibit A As part of this petition, your petitioner further states to the Board of Trustees of Frederick, Colorado, that: 1. It is desirable and necessary that the territory described in Exhibit A be annexed to the Town of Frederick. 2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as amended, exist or have been met in that: a. Not less than one -sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Frederick or will be contiguous with the Town of Frederick within such time as required by 31-12-104. b. A community of interest exists between the area proposed to be annexed and the Town of Frederick. c. The area proposed to be annexed is urban or will be urbanized in the near future. The area proposed to be annexed is integrated with or is capable of being integrated with the Town of Frederick. e. No land within the boundary of the territory proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street, road or other public way. f. No land within the boundary of the area proposed to be annexed which is held in identical ownership, comprises twenty acres or more, and which, together with the buildings and improvements situated thereon has an assessed value in excess of two hundred thousand dollars ($200,000.00) for ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. g. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. j• The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Frederick more than three miles in any direction from any point of the boundary of the Town of Frederick in any one year. Prior to completion of the annexation of the territory proposed to be annexed, the Town of Frederick will have in place a plan for that area, which generally describes the proposed: Location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the Town of Frederick; and the proposed land uses for the area; such plan to be updated at least once annually. k. In establishing the boundary of the territory proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the territory to be annexed. The Town of Frederick will not deny reasonable access to any landowners, owners of any easement, or the owners of any franchise adjoining any platted street or alley which is to be annexed to the Town of Frederick but is not bounded on both sides by the Town of Frederick. 3. The owners of more than fifty percent of the area proposed to be 2 annexed, exclusive of dedicated streets and alleys, have signed this petition and hereby petition for annexation of such territory. 4. Accompanying this petition are four copies of an annexation map containing the following information: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary of the area proposed to be annexed, said map prepared and containing the seal of a registered engineer; c. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted, the boundaries and the plat numbers of plots or of lots and blocks; d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous boundary of the Town of Frederick and the contiguous boundary of any other municipality abutting the area proposed to be annexed, and a showing of the dimensions of such contiguous boundaries. 5. Upon the Annexation Ordinance becoming effective, all lands within the area proposed to be annexed will become subject to all ordinances, rules and regulations of the Town of Frederick, except for general property taxes of the Town of Frederick which shall become effective as the January 1 next ensuing. 6. Box 435 Frederick, CO 80530-0435 Contents Project Description 3 Municipal Services 3 Method of Financing the Extension of the Municipal Services 3 Special Districts 4 School District Impact 4 Exhibits 4 Project Description The project is the proposed annexation of approximately 351.83 acres into the Town of Frederick. Currently the property has the zoning designation for the property of "A", Agricultural, by Weld County. In conjunction with the proposed annexation, the zoning is proposed to change to Planned Unit Development Overlay (PUD-O), containing Residential Low Density (R-1) and Highway 52 Commercial Corridor (C -H52) designation. The development of the land will include single family attached homes, detached homes, and mixed use development. The annexation is an assemblage of 8 parcels with 4 different land owners. The location of the property is generally the northeast and northwest corner of State Highway 52 and CR 3 34. Municipal Services Municipal services for the Shores on Plum Creek Annexation will be provided in the following manner: • Electricity Electric services are available to be served by United Power. • Sanitary Sewer Sanitary sewer service could be provided by either the Town of Erie or St. Vrain Sanitation, and will be determined based on negotiated service agreements with final approval from the Town of Frederick. • Water Water service is available to be served by Left Hand Water. • Fire The property will be served by the Frederick -Firestone Fire Protection Department. • Police Police service will be provided by the Town of Frederick Police Department. • Street Maintenance Maintenance of public roadways within the annexation will be provided by the Town. Method of Financing the Extension of the Municipal Services The Shores on Plum Creek Metropolitan District Nos. 1-5 Service Plan will serve the best interests of the taxpayers, property owners and development of the property within The Shores on Plum Creek development, will minimize non -interested party obligations, and will maximize both development and absorption within the Districts and the Town of Frederick without delays in development. The formation of the Districts will allow for financing and development to pay for only those improvements and costs which are a direct benefit to the property within the Districts. Special Districts See Exhibit A for an executive summary and map of the proposed special districts. School District Impact The property to be annexed is proposed to be zoned (R-1) Residential Low Density, (R-2) Residential Medium Density, and (C -H52) Mixed -Use Highway 52; and development is not anticipated at this time. Re: Executive Summary for Proposed The Shores on Plum Creek Metropolitan District Nos. 1-5 Date: February 16, 2018 The proposed formation of The Shores on Plum Creek Metropolitan District Nos. 1-5 (the "Districts") encompasses the land generally located at the southwest corner of State Highway 52 and WCR 3% and is estimated to include approximately 256.70 acres of residential and mixed use development and approximately 88.183 acres of future inclusion area property, all entirely within the boundaries of the Weld County (the "County"). The Districts are proposed to provide services and powers provided for metropolitan districts authorized by the Special District Act, pursuant to Title 32, C.R.S. and provided within similar districts within the Town, for consideration on the next possible public hearing of the Board of County Commissioners in order to meet the requirements of a formation election in November 2015. Preparation of the Financing Plan was provided by George K. Baum & Company. The Developer of The Shores on Plum Creek community is Farfrumwurkin, LLC. Construction cost estimates were assembled by the Developer with consultation with the District Engineer, Permontes Group, which has experience in the costing and construction of similar facilities. Developer representatives will make up the initial District Boards in order to develop the area in accordance with approved development plans with the Town. The new Districts will help pay for and structure the financing of public improvements and to make the lots and the property permit ready and will help absorb finished lots, homes and commercial property into the Town tax base. I. Major Service Plan Points for The Shores on Plum Creek Metropolitan Districts. • 256.70 acres of property in the initial boundaries within the Town of Erie, County of Weld. 88.183 acres of additional property in the Inclusion Area Boundaries. • Completion of over $59,029,501 million of Public Improvements necessary for the entire project including significant on- and off -site improvements needed to bring the development to permit ready status. • Anticipated development of at least 465 single family homes and 524 multi -family units, approximately 261,424 square feet of commercial development, and 399,446 DN 1770116.1 COLORADO SPRINGS I DENVER I JEFFERSON CITY I KANSAS CITY I OMAHA I OVERLAND PARK I SPRINGFIELD I ST. LOUIS L.1 SpencerFane square feet of mixed use development depending upon final zoning and plat approvals. • The estimated assessed value at full build -out is $50,879,683 with additional oil and gas assessed valuation of $95,808,039 possible based upon initial projection. • The estimated cost of the public improvements needed for the project is $59,029,501 which is needed for development of the property within the Districts. • Public Improvements need additional financing from the Districts to complete. • Debt is proposed to be issued in one or more series of bond issuances to allow for financing of constructed infrastructure and expedient completion of the Development. • Maximum Mill Levy of 50 mills for debt and 15 mills for operations and administration is requested, consistent with the Town's model service plan. • Total projected mill levy of for both operations and maintenance and debt for District Nos. 1-5 is currently 50 mills, which allows for financing of $39,265,000 based upon initial financial plan estimates. • Requested Debt Authorization of $43,191,500 allows for 110% coverage to allow for contingencies and financing variations based upon changes to construction costs, development build out and absorption of the project. • Maximum voted interest rate of 15%, maximum underwriting discount of 5%. • Metropolitan district powers allowed by the Special District Act and consistent with other Weld County metropolitan districts. • It is the intent of the Districts to provide for covenant enforcement, design review and operations of District improvements in lieu of a homeowners or property owners association to the extent feasible and necessary for ongoing operations and maintenance of District infrastructure, improvements, facilities and services. • Formation election after approval of the Service Plan in November -December 2015. • There are no current residents within the Districts and no debt or bonds have been issued. • Mill levies, interest rate limitations and underwriting discounts will be consistent with the present County -imposed limitations with other service plans approved by the Town. • Maximum term of any bond issue is 30 years for General Obligation Bonds. 2 DN 1770116.1 SpencerFane • Intergovernmental Agreement with County of Weld to implement Service Plan restrictions. We are excited about this property as it already has many attributes that contribute to the development of a high quality community. The two planned lakes through the property provide an excellent opportunity for recreation within the community. This annexation is an assemblage of 8 different parcels with 4 separate owners. This opportunity is unique in that seldom can one assemble multiple parcels with multiple owners to plan a community such as this in the Town of Frederick as well as other communities. It presents a unique opportunity to not only master plan a great community, but to also master plan and construct a substantial part of the Town's planned infrastructure in the area. Our goal is to develop a community that utilizes the previously mentioned attributes of the property to provide future residents a high quality of life. We plan to include Residential low Density, Residential Medium Density, and Mixed -Use Highway 52 zoning districts having a PUD Overlay. We envision a variety of housing types including attached, detached, and multifamily homes. The concept plan envisions higher density in the southerly and easterly portion of the community as a transition from the adjacent commercial with less density as we approach and the northerly and westerly boundary of the project. The proposed land use requires a Comprehensive Plan Amendment to be processed simultaneously with the proposed Annexation. The existing Comprehensive Plan for the property does not consider the change of conditions that affect the optimum development of the property. Therefore, the Comprehensive Plan requires the proposed amendment. The change in conditions for the property include, the market demand for smaller yards, ongoing demand for rental apartments, the increased volume of traffic on SH 52, the completion of a now full 1,600 -acre foot water storage reservoir, and the growing demand for retail and commercial uses along SH 52. The proposed amendment is compatible with the surrounding area, and the goals and policies of the Town. The proposed amendment is appropriate and compatible with the surrounding area and nearby development in Erie and Frederick. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. J. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Frederick more than three miles in any direction from any point of the boundary of the Town of Frederick in any one year. Prior to completion of the annexation of the territory proposed to be annexed, the Town of Frederick will have in place a plan for that area, which generally describes the proposed: Location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the Town of Frederick; and the proposed land uses for the area; such plan to be updated at least once annually. k. In establishing the boundary of the territory proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the territory to be annexed. Currently the property has the zoning designation for the property of "A", Agricultural, by Weld County. In conjunction with the proposed annexation, the zoning is proposed to change to Planned Unit Development Overlay (PUD-O), containing Residential Low Density (R-1) and Highway 52 Commercial Corridor (C -H52) designation. The development of the land will include single family attached homes, detached homes, and mixed use development. The annexation is an assemblage of 8 parcels with 4 different land owners. The location of the property is generally the northeast and northwest corner of State Highway 52 and CR 3 %. Municipal Services Municipal services for the Shores on Plum Creek Annexation will be provided in the following manner: • Electricity Electric services are available to be served by United Power. • Sanitary Sewer Sanitary sewer service could be provided by either the Town of Erie or St. Vrain Sanitation, and will be determined based on negotiated service agreements with final approval from the Town of Frederick. • Water Water service is available to be served by Left Hand Water. • Fire The property will be served by the Frederick -Firestone Fire Protection Department. • Police Police service will be provided by the Town of Frederick Police Department. • Street Maintenance Maintenance of public roadways within the annexation will be provided by the Town. Re: Executive Summary for Proposed The Shores on Plum Creek Metropolitan District Nos. 1-5 Date: June 1, 2017 The proposed formation of The Shores on Plum Creek Metropolitan District Nos. 1-5 (the "Districts") encompasses the land generally located at the southwest corner of State Highway 52 and WCR 3% and is estimated to include approximately 256.70 acres of residential and mixed use development and approximately 88.183 acres of future inclusion area property, all entirely within the boundaries of the Weld County (the "County"). The Districts are proposed to provide services and powers provided for metropolitan districts authorized by the Special District Act, pursuant to Title 32, C.R.S. and provided within similar districts within the Town, for consideration on the next possible public hearing of the Board of County Commissioners in order to meet the requirements of a formation election in November 2015. Preparation of the Financing Plan was provided by George K. Baum & Company. The Developer of The Shores on Plum Creek community is Farfrumwurkin, LLC. Construction cost estimates were assembled by the Developer with consultation with the District Engineer, Permontes Group, which has experience in the costing and construction of similar facilities. Developer representatives will make up the initial District Boards in order to develop the area in accordance with approved development plans with the Town. The new Districts will help pay for and structure the financing of public improvements and to make the lots and the property permit ready and will help absorb finished lots, homes and commercial property into the Town tax base.
