RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR 5225 ESTATES
PLANNED UNIT DEVELOPMENT, PUDF17-0002 - WAYNE HOWARD AND SHARYN
FRASER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 29, 2017, the Board approved the application of
Wayne Howard and Sharyn Frazer, 6450 CR 52.25 Johnstown, Colorado 80534, for a concurrent
Change of Zone and Planned Unit Development on the following described real estate, to wit:
Lot B of Amended Recorded Exemption,
AMRE-3702; being part of the SE1/4 SW1/4 of
Section 30, Township 5 North, Range 67 West of the
6th P.M., Weld County, Colorado, and
WHEREAS, on October 11, 2017, the Board of County Commissioner of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements for Planned Unit Development, PUDF17-0002, between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, and Wayne
Howard and Sharyn Frazer with terms and conditions being as stated in said agreement, and
accepted personal check #4872, drawn on the Credit Union of Colorado, 7541 E. Iliff Avenue,
Denver, CO 80231, in the amount of $54,500.00, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and recommend release of said collateral.
WHEREAS, upon recommendation of staff, the Board deems it advisable to release said
collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the cash payment, in the amount of $54,500.00 be, and hereby is,
canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Brief description of the issue:
The Department of Public Works received a request from Wayne Howard, requesting that the Board of County
Commissioners release the currently held collateral for 5225 Estates PUD in the amount of $54,500.00. The
collateral is currently being held for a waterline. This waterline has been installed and tested according to Little
Thompson Water District specifications.
Weld County Public Works, Planning Services and the County Attorney's Office have reviewed the documents
and recommend the release of collateral.
What options exist for the Board?
1. Have this BOCC Hearing item be placed on the next available agenda as part of the Regular Agenda.

The water system improvements required for your 5225 Estates development have been completed.
The improvements; including 2,680 lineal feet of 6 -inch waterline, a bore under the Hillsborough
Ditch, and service connections have been installed and tested according to Little Thompson Water
District specifications. A bill of sale has been provided, Little Thompson Water District has provided
the as-builts, and fees have been waived for the construction observation per our agreement dated
September 8th, 2017. Little Thompson Water District is now committed to serve the lots in 5225
Estates. The two-year warranty starts on April 23rd, 2018 and ends April 23rd, 2020.
