I. BENJAMIN F. TWOMBLY, of the City of Fort Lupton,
County of Weld, and State of Colorddo, do hereby make, publish
and decla•-e this my last WILL AND TESTAMENT, in manner and form
following:
FIRST: I direct that all my just debts and funeral
expenses be paid as soon after my decease as conveniently can
be done.
SECOND: I give and bequeath to my sister, Mrs.
Katie S. Smith, wife of James S. Smith, now living near Helena,
,lontana, should she survive me, One Thousand Dollars (01,000.00)1
should she depart this life before me, it is my will that said
bequest lapse and revert to and become part of my residuary estate.
THIRD: I give and bequeath to my children, Sarah A.
Monismith, wife of Dr. A.T. Monismith, now living in Port Lupton,
Colorado, Della Louise Griffith, wife of O.W. Griffith, now
living near Durango, Colorado, Margaret May Twombly, now living
in Fort Lupton, Colorado, and Lena Marie Twombly, now living in
Fort Lupton, Colorado, one half of all my personal property, of
whatever kind or nature, of which I may die seised or to which
I may be entitled to at the time of my decease, they to share
equally therein. Should any of my said children depart this
life before me leaving issue surviving her or them, then and in
that event, the share or shares of such deceased child or children
shall go to such surviving issue, per stirpes, Should any of my
aforesaid children depart this life before me leaving no issue
surviving her"or them, then and in that event, the share or shares
of such deceased child or children shall lapse and such share or

shares shall be divided equally among my aforesaid surviving

FOURTH: I give and devise to my wife, Nary
Magdalena Twombly, the balance of my personal estate of which
I may die seized or to whioh I may be entitled to at the time
of my decease.
FIFTH: All the rest, residue and remainder of my
estate, real, personal or mixed, wheresoever situate, of which
I may die seized'or to which I may be entitled to at the time
of my deceased, I give,, devise and bequeath to my wife, Mary.,
Magdalena Twombly, to have to and to hold to her sole use and
benefit during her life, with remainder over to my aforesaid
children to vest in them and their heirs, subjeot to the fol-
lowing limitations, in fee absolutely and forever. It is my
will that my said children, upon the decease of my said wife,
shall take share and share alike in said estate, should they
all be living, except that I reserve to those of my aforesaid
children who shall be ,living and unmarried at the time of
the decease of my said wife, Mary Magdalena Twombly, the sole
use end possession of those premises known as the "home place",
together with all the tenements, hereditaments and appurtenances
thereunto belonging, described

Sixty-six West of the 6th Principal Meridian, which premises
such child or children shall have and hold to her or their sole
use and benefit until such time as all of my said unmarried
daughters shall be either mattied or deceased. Upon the

to the decease of my said wife, leaving no issue her or them
surviving, then and in that event, the share or shares of
such deceased child or children shall descend to and vest in
fee equally in my surviving child or children, or in their
issue them surviving.
SIXTH:. Should any of the gifts, bequests and devises
made. by me in this my last WILD AND TESTAMENT, lapse or fail for
any reason, I direct that the gifts, bequests or devises so
lapsing and failing shall go to and form part of my residuary
estate and I hereby nominate, constitute and appoint my wife,
Mary Magdalena Twombly, as my residuary legatee.
SEVENTH: I nominate', Constitute and appoint my wife,
Mary Magdalena Twombly, of the City of Port Lupton, State of
Colorado, executrix of this my last WILL AND TESTAMENT.
In theevent of the death, refusal or inability to
act of said Mary Magdalena Twombly, I hereby nominate and appoint
Sarah A. Monismith, wife of -Dr. A.T. Monismith, now living at
Port Lupton, Colorado, as executrix in her place and stead. I
further direct that neither of the persons above named as
executors shall be required to give any bond or security for
the proper discharge of their duties.
EIGHTH: I hereby revoke all former and other Wills
and Testamentary dispositions by me at any time heretofore made.

DECREE
And now on the 23rd day of April, A. D. 1923, comes
Mary M. Twombly, the executrix of the estate of Benjamin F.
Twombly, deceased, and presents to the court a final report
of her acts and doings as such executrix, asks that the same
be approved and that she be discharged and said estate de-
creed to be fully administered according to the law.
And it appearing to the Court from the records and
files herein, and the Court doth find that Benjamin F. Twombly
departed this life on or about the 2eth day of January, A. L.
1921, and thereafter Mary M. Twombly was duly appointed execu-
trix of said estate.
And it appearing to the Court and the Court doth
find that a notice to creditors to file claims against said
estate was published, in the manner and as required by law,
and that all claims alloyed by the Court against said estate,
and all costs of administration, including Inheritance Tax and
fees have been paid.
And the Court doth further find that more than one
year has elapsed since letters were issued herein, and that
there has been published, in the awn ner and as required by
law, and in accordance with an order of this court, a notice
that said final report would be presented for approval on
Monday, the 13th day of February, A. D. 1923, and that the
hearing thereon was rs:rcularly continued to this date.

doth find that said Mary M. Twombly has received for and
on behalf of said estate the sum of Forty-four thousand
One hundred fifty-four and 83/100 ($44,154.83) Dollars, and
has expended the sum of Fourteen thousand Two hundred ninety-
five and 81/100 ($14,295.81) Dollars, leaving in her hands in
cash the sum of Twenty-nine thousand Eight hundred fifty-nine

I, Mary Magdalena Twombly, of the 'City of Fort
Lupton, County of Weld, and State of Colorado, do hereby
make, publish and declare this my LAST WILL and TESTAMENT,
in the manner and form as follows:
FIRST: I direct that all my just debts and funeral
expenses be paid as soon after my decease as conveniently
con be done.

two of said shares, that is to say one-fourth of my entire
estate to my daughter, Della Louise Griffith, wife of C. W.
Griffith, now living near Durango, Colorado; I give and
bequeath two of said shares, that is to say, one-fourth
of my entire estate to my daughter, Margaret May Twombly,
now living in Fort Lupton, Colorado; I give • and bequeath
two of said shares, that is to say one-fourth of my entire
estate to my daughter, Lena Marie Apel, now living in Fort
Lupton, Colorado; I give and bequeath one share, that is
to say one -eighth of my entire estate to my granddaughter,
Helen Margaret Monismith, now living in Fort Lupton,
Colorado; and I give and bequeath one share, that is to
say one -eighth of ray entire estate to my granddaughter,
Carol Louise Monismith,- now living in Fort Lupton,
Colorado; subject however, to the following limitations:
Should any of my aforesaid children or grandchildren
depart this life before me, leaving issue surviving her or
them, then and in that event, the share or shares of such
deceased child, children or grandchildren shall descend
and go to such surviving issue per stirpes. Should any
of my aforesaid children or grandchildren depart this life
before me, leaving no issue surviving her or them, then
and in that event, such devise and bequest as to such
deceased child, children or grandchildren shall lapse,
and such share or shares shall be divided equally among
my aforesaid children and grandchildren or their issue
them surviving.
THIRD: I nominate, constitute and appoint my son-in-
law, Doctor Arthur T. Monismith, now residing in Fort Lupton,
-Colorado, as executor of this my last WILL and TESTAMENT.
FOURTH: I authorize and empower my executor herein -
above named, and his successor or successors, to sell and
dispose of all or any of the real, personal and mixed estate
of which I may die seized or possessed, at public or_private
sale, at such time and on such terms and conditions as he,
the successor or successors shall deem meet and proper, and
to execute, acknowledge and deliver all proper writings, deeds,
conveyances and transfers thereof.
FIFTH: I hereby revoke all former and other Wills and
Testamentary dispositions by me at any time heretofore made.
