Gentlemen:
Reference is made to your letter of March 9, 1979 regarding annexation
of the west half of Weld County Road 53.
Once the City of Kersey annexes land on both sides of the County Road,
the road becomes the responsibility of the City, and thus the County
would no longer have any jurisdiction.

Dear Commissioners:
Enclosed please find copies of a resolution and an ordinance adopted
by the Town of Kersey Board of Trustees on February 20, 1979. These
documents were adopted for the purpose of annexing a parcel of land,
known as Lots 2 and 3 of Sandy Knolls Estates, to the Town of Kersey.
With this annexation, the Town limits now incorporate property on
both sides of County Road 53, also known as First Street in Kersey.
At the present time, only the east half of First Street, south of
the railroad tracks, is in the Town limits. It is our understanding
that you will probably want us to assume control of the west half
of First Street or County Road 53 within the Town boundaries now
that the annexation has been completed.
Please let us know your wishes concerning this matter. Thank you.

ORDINANCE NO. 135
AN ORDINANCE ANNEXING TO THE TOWN OF KERSEY, WELD
COUNTY, COLORADO, THE PROPERTY DESCRIBED HEREIN
AND SHOWN ON THAT CERTAIN PLAT DESIGNATED AS LOTS
2 AND 3 OF SANDY KNOLL ESTATES.
WHEREAS a petition for annexation of certain territory herein-
after described has been filed with the Town Clerk of the Town of Kersey,
Colorado, and thereafter referred by the Town Clerk to the Planning
Commission and the Board of Trustees; and,
WHEREAS said petition for annexation has been duly signed by
the owners of one hundred percent (100%) of all the property described
in said petition; and,
WHEREAS said petition is accompanied by a plat and annexation
map of the territory proposed to be annexed; and,
WHEREAS said petition for annexation and the accompanying infor-
mation conform in all respects to the requirements and provisions of the
Town's regulations concerning annexations and the requirements set forth
in Article 12 of Title 31 of the Colorado Revised Statutes, as amended; and,
WHEREAS notice of a public hearing has previously been
published and a public hearing held on the 20th day of February, 1979; and,
WHEREAS no opposition was voiced to the proposed annexation
at said public hearing;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
TOWN OF KERSEY, COLORADO:
Section 1. That annexation of territory in Weld County, Colorado,
described as follows, to wit:
Lot 2 and Lot 3 of SANDY KNOLL ESTATES (First Filing)
located in the SE', Section 20, T. 5N. , R 64 W. of
the 6th P.M. , according to the recorded map or plat
thereof, Weld County, Colorado.
is hereby accepted and approved and upon the effective date of this ordinance,
the annexation of said land and the territory hereinabove described shall
become complete, and said land shall be annexed to and become a part of
the Town of Kersey, Colorado, for all intents and purposes. Said territory
is then and shall be subject to all ordinances of the Town of Kersey in
any way effecting said land, including zoning and sub-division ordinances
of the Town of Kersey, Colorado.
Section 2. The proper officers of the Town of Kersey, Colorado,
are hereby authorized and directed to do all things necessary to complete
the annexation of the aforesaid described territory.
Section 3. The Petition for annexation of the above described
property submitted by ROBERT L. HOFF and BARBARA J. HOFF is hereby
approved and the property therein described and described above in
this ordinance is hereby annexed to the Town of Kersey, Weld County,
Colorado.
Section 4. This ordinance shall take effect and be in force
immediately following the expiration of thirty (30) days after the
publication of this ordinance, as required by law.
PASSED, ADOPTED, SIGNED AND APPROVED this 20th day of
February, 1979. •

A RESOLUTION STATING FINDINGS OF FACT AND CON-
CLUSIONS OF THE BOARD OF TRUSTEES IN REGARD TO
A CERTAIN ANNEXATION.
WHEREAS a petition for annexation of certain territory herein-

annexation, to wit:
Lot 2 and Lot 3 of SANDY KNOLL ESTATES (First Filing)
located in the SE', Section 20, T. 5N. , R 64 W. of
the 6th P.M. , according to the recorded map or plat
thereof, Weld County, Colorado.
Section 2. The requirements of 31-12-104 and 31-12-105 have
been met.
Section 3. No election is required under Section 31-12-107(2)
C.R.S. 1973.

Section 4. The above described territory shall be annexed
pursuant to the requirements of Article 12 of Title 31, C.R.S. 1973,
and that the above territory will become subject to the ordinances and
regulations of the Town of Kersey, Colorado.
PASSED, APPROVED AND ADOPTED this 20th day of February, 1979.
