The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.

GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for a Brewery,
Brewpub, a Single -Family Dwelling unit per lot other than those permitted under Section 23-3-20 A. and
any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial
or Industrial Zone Districts (a Restaurant, Coffee Shop, Event Barn, and Retail store) provided that the
property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions district and two building mounted signs one for the
restaurant and one for the coffee shop in the A (Agricultural) zone
This project is south of and adjacent to CR 74 and is east of Highway 257.

Access is from CR 74.
ROADS AND RIGHTS -OF -WAY
This portion of County Road 74 is under the jurisdiction of the City or Town (municipality) of Windsor. The
municipality has jurisdiction over access to the road. Please contact the municipality to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgov.comidepartments/qublIcworks/permIts/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
Drainage Requirements:
This area IS within an Urbanizing Drainage Area:
Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on
the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm
falling on the undeveloped site for URBANIZING areas.
Detention Pond summarized in a Drainage Report:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must
include a certification of compliance stamped and signed by the PE which can be found on the engineering
website. General drainage report checklist is available on the engineering website. More complete
checklists are available upon request.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Department of Public Works)
B. The plan shall be amended to delineate the following:
1. Show the approved Municipality of Windsor access(es) on the site plan and label with the approved
access permit number if applicable. (Department of Public Works)
2. The applicant shall show and label the accepted drainage features and drainage flow arrows.
Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and
shall include the calculated volume. (Department of Public Works)
3. The applicant shall show the drainage flow arrows. (Department of Public Works)
4. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Department of Public Works)
Prior to Construction:
A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner shall control noxious weeds on the site. (Department of Public Works)

Environmental Health Services has reviewed this proposal for a Site Specific

Zone Districts (a Restaurant, Coffee Shop, Event Barn, and Retail store) provided that
the property is not a lot in an approved or recorded subdivision plat or lots parts of a map
or plan filed prior to adoption of any regulations controlling subdivisions in the A
(Agricultural) Zone District.
There is a house being constructed which is served by North Weld Water District and a
septic system permitted for 4 bedrooms (SP -1700378). The septic system has not
received final approval as of July 5th, because a letter from the Engineer approving the
system has not been received. It is the applicant's responsibility to comply with the
requirements of North Weld Water District.
Noise will be restricted to the commercial level. The application indicates noise will be
controlled by keeping bands inside the barn and facing open windows towards the
center of the property.
The restaurant, coffee shop and all food facilities onsite must adhere to the Colorado
Retail Food Establishment Rules and Regulations. The Consumer Protection Division of
Weld County Environmental Health Services shall be contacted for plan review and
licensing requirements for all proposed food establishments at the facility. In addition,
the OWTS for those facilities must be designed by an Engineer and meet Policy 6 of the
State's Water Quality Site Application Policy which regulates multiple OWTS on a single
parcel. Also, any OWTS with the capacity to serve 20 or more persons per day must be

permitted as an Underground Injection Control (UIC) Class V Injection Well through the
Environmental Protection Agency (EPA) as necessary.
We recommend that the following requirement be incorporated into the permit;
Prior to the issuance of Certificate of Occupancies:
A. An on -site waste water treatment system is required for all the proposed
structures and shall be installed according to the Weld County On -site
Waste Water Treatment System Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized.
5. Fugitive dust shall attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
6. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. A permanent, adequate water
supply shall be provided for drinking and sanitary purposes.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Onsite Waste Water Treatment Systems.
8. Any large -capacity septic system (a septic system with the capacity to serve 20
or more persons per day) shall comply with the Underground Injection Control
(UIC) Class V Injection Well requirements of the Environmental Protection
Agency (EPA).
9. Policy 6 of the Colorado Department of Public Health and Environment, Water
Quality Control Division's (WQCD) Regulations shall be adhered to for multiple
septic systems on a single parcel.
10. In the event the septic systems require a design capacity of 2,000 gallons or
more of sewage per day the applicants shall adhere to the requirements of the
Colorado Department of Public Health and Environment, Water Quality Control
Division's (WQCD) Regulations.
11. The facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S.
12. The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
13. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Ms. Aungst,
The subject property is located within the Town of Windsor's Growth Management Area
(GMA) and per the Town's Comprehensive Plan, the Land Use Plan depicts this area as
"Neighborhood & General Commercial" to the east and "High Density Estate Single Family
Residential" to the west. A commercial node is depicted north and east of this site. The
property is eligible for annexation and Town infrastructure is anticipated to be available in
the near future, as described herein, which would support the urban -level development
proposed. The following is a summary of major comments but please note additional
review comments are provided on the attached drawings:
1. Weld Country Road (WCR) 74/ Harmony Road was annexed by the Town
of Windsor in 2018; therefore, all access and associated road
improvements must be approved by the Town. The Town does not
authorize a new access to WCR 74 at this time. Site access should be
taken from the existing shared access easement west of the property
noted on Recorded Exemption Numbers 0807 -05 -1 -RE -3303 and 0807-
05 -1 -RE -4682.
2. Per Town of Windsor Streets Design Criteria, a left turn deceleration lane
is necessary for any access with a projected peak hour left ingress
turning volume greater than ten (10 vph) vehicles per hour. Furthermore
a right turn deceleration lane is required for any access with a projected
peak hour right ingress turning volume greater than twenty five (25 vph)
vehicles per hour.
3. A traffic impact study (TIS) is required to determine projected peak hour
turning volumes and required access improvements. Given the type of
use planned, it is anticipated that peak hour volumes will be reached for a
left turn deceleration lane, and possibly a right turn deceleration and
acceleration lane.

4. Please prepare and submit to Windsor road improvement plans for lane
improvements identified in a TIS prepared by qualified traffic engineer.
Any work in the right-of-way (including utilities) requires submittal of an
application to Windsor for review and approval.
5. The large parking lot adjacent to CR 74 could have negative visual
impacts and/or headlight glare on the residences to the north of the
property. Please provide additional landscaping to mitigate. Per
Windsor/Weld IGA: "Development proposing...non-residential uses that
may have negative impacts on neighboring residential properties within
1,000 feet shall be screened from view..."
6. The property is located in Windsor's water service area. There is a
service area agreement between Windsor and North Weld Water District.
The applicable section out of the agreement is included on drawing
comments.

referral PRE17-0242.

Subject: Pre -Application Referral for PRE17-0242 (7674 WCR 74)
Dear Mr. Parko,
The Town of Windsor Planning Commission has reviewed this referral in accordance with the
Weld County -Windsor Coordinated Planning Agreement (CPA), and has included
recommendations regarding this land use concept for your consideration.
The property is located within the Town of Windsor's Growth Management Area (GMA) and per the
Town's Comprehensive Plan, the Land Use Plan depicts this area as "Neighborhood & General
Commercial" to the east and "High Density Estate Single Family Residential" to the west. A major
commercial node is depicted directly north and east of this site. The property is eligible for
annexation and Town infrastructure is anticipated to be available in the near future, as described
herein, which would support the urban -level development proposed in this pre -application referral.
The property is located in the Windsor sewer service area and is located in Windsor's water service
area (south of WCR 74); however, the water system network is not yet installed. Although service
is not currently available nearby, Windsor is currently working on the design of the sanitary sewer
interceptor, which will extend to WCR 74 and SH 257. The sanitary interceptor would serve a
proposed development (Rocky Mountain Sports Park) located immediately north of the subject
property. While the Town has not yet received any formal submittals regarding the sports park, the
Town has had pre -application meetings with the interested parties and it is anticipated that
construction of the interceptor could occur as soon as next year. Specific alignments have yet to
be determined.
The Town of Severance is leading a WCR 74/Harmony Road corridor planning effort with Weld
County, CDOT and the other communities in the WCR 74/Harmony Road corridor from U.S. 85 to
1-25. Additionally, Windsor is currently reviewing plans for WCR 74/Harmony Road improvements
associated with the Ridge at Harmony Road Subdivision approximately one mile to the west of the
subject property. Those plans will include landscaped medians that replicate the Harmony Road
cross-section that the Town of Timnath is currently implementing and planned to extend to WCR
13. Windsor intends to continue a similar road cross-section from WCR 13 to SH 257.
Improvements to WCR 74/Harmony Road will be necessary with proposed development along the
corridor, including the proposed sports complex directly north of the subject property. On an
arterial roadway such as this, access points would ideally be no less than one -quarter mile apart. In
this location, traffic volumes and topography will also play a key role in determining safe access

points. Therefore, it is desirable to coordinate a joint access location for the subject property and
adjacent properties that will align with the sports park access on the north side of WCR
74/Harmony Road.
Pursuant to the Coordinated Planning Agreement (CPA) between Weld County and Windsor,
the Planning Commission recommends the following to Weld County regarding the subject
proposal:
(1) The Town would be interested in meeting with the applicant to discuss annexation and
development opportunities for this property;
(2) The proposed uses of brewery, restaurant and large-scale events will require urban -level
infrastructure, including utilities and roadway improvements;
(3) Coordination of access on WCR 74/Harmony Road with adjacent properties;
(4) Coordination of improvements on WCR 74/Harmony Road, including, but not limited to
acceleration and deceleration lane requirements, as determined by a traffic engineer;
(5) Providing stormwater detention consistent with County requirements or Town of Windsor
drainage master plan requirements, whichever are more restrictive;
(6) Address fire protection; and
(7) Adherence to the CPA design standards, as adopted between Windsor and Weld
County.

Diana,
The applicant left me a voice message after I reached out to her about the site. It is very unlikely
that her proposal will increase traffic at the intersection by more than 20%. The Rocky Mountain
Sports Park impacts will be significantly greater and they will have major impacts to the state
highway system.
CDOT has no comment regarding this proposal.

We have explained in previous emails and on the phone why we have not done any traffic studies. There was the
issue with the annexation and the Sports Park. At this point we need to know specifically what is needed. There are
multiple levels with a wide cost range for traffic studies. Who should I address with regard to this; Evan or someone at
Windsor.
